CHICAGO -- Drew Peterson, the former Chicago-area police sergeant who was convicted in 2012 of killing his third wife, is set to return to court this month after a judge agreed to hear his motion to vacate the verdict.

Will County Judge Edward Burmilla scheduled the Jan. 21 hearing after finding a 'œgist of a constitutional' claim in Peterson's six-page handwritten motion, according to the Chicago Tribune. Burmilla assigned Peterson a public defender and two investigators from the public defender's office.

Peterson, from the Chicago suburb of Bolingbrook, is serving a 38-year prison sentence in the 2004 killing of Kathleen Savio. He will follow that sentence with 40 more years after he was convicted in 2016 of plotting to kill the prosecutor who put him behind bars.

In his motion filed in October, Peterson argues that his lead attorney, Joel Brodsky, did not provide effective counsel. Peterson contends that Brodsky threatened other attorneys with removal from the case if they disagreed with him, and that he wanted to testify in his own defense but that Brodsky would not allow it. Peterson also alleges prosecutorial misconduct and witness intimidation.

Further, he argues that two key witnesses who were allowed to testify under the state's hearsay law should not have been permitted to testify. The Illinois Supreme Court ruled in a unanimous 2017 decision that hearsay testimony from Savio and Stacy Peterson did not violate Drew Peterson's constitutional right to confront his accusers because of evidence that killed he them to prevent their testimony.

The Will County State's Attorney's office said in a 23-page written response that there was no merit to Peterson's claims, and denied any misconduct or witness intimidation.

I am pretty sure, if not totally positive, that the judge would have asked DP if he wanted to take the stand. AND the judge would have asked if his attorneys had tried to prevent him from making his own decision. I have never seen a murder trial where the judge failed to ask those questions of the defendant.

5/20/16: The jury selection process will start Friday, 5/20/16 in Randolph County in southern Illinois, where Peterson, 62, is serving a 38-year-sentence at the maximum security Menard Correctional Center. Opening arguments are scheduled to start Monday, with the trial anticipated to last at least one week. The use of hearsay testimony to convict Peterson in the death of his third wife was proper, the Illinois Supreme Court ruled Thursday, 9/21/16 in upholding the conviction. The high court, in a unanimous decision, found that hearsay testimony from Peterson's dead third wife & missing fourth wife did not violate his constitutional right to confront his accusers because of evidence that Peterson killed them to prevent their testimony.

6/18/18 Update: On Monday, 6/18/18, Peterson’s attorney Steve Greenberg filed a petition with the U.S. Supreme Court, asking it to review the decision of the state’s high court. In Greenberg’s 38-page filing, he alleges, among other claims, that the use of hearsay testimony — statements that Savio made to family members & in a written statement to police before she died, and statements Stacy Peterson made to her pastor & a divorce lawyer before her disappearance — should never have been allowed. The filing also questioned the legality of allowing divorce attorney Harry Smith to testify at trial about a telephone call in which Stacy Peterson indicated Drew Peterson had killed Savio. 12/14/20: The Will County State's Attorney's Office of Jim Glasgow issued a news release Monday announcing that an Illinois appeals court had rejected Peterson's appeal trying to overturn his conviction for a murder-for-hire that targeted Glasgow himself.

There is some kind of error here. 20 years haven't passed between when he was convicted and now. It's only been a little over 9 years.

Okay - my mistake... :rolleyes: my addition/subtraction was a bit off - and thanks for pointing it out! :)

He was 50 @ the time of the crime in 2003 (where my "mistake" starts out) - he was born 1/5/54 by the way. Arrested at 59 - and now 68.
 
Even if he got the murder conviction overturned, he'd still be in there for the rest of his life on the murder-for-hire charges, so what's the point? I guess it's just an ego-thing and not wanting to be officially known as a convicted murderer, or just wanting more media attention.
