GUILTY WY - Jesse Speer for kidnap, rape of 10yo girl, Cody, 8 Oct 2012

Taking this to trial WILL REVICTIMIZE the victim. GRRRRRRRRR
 
Taking this to trial will further alienate him from his family IMO. ALL of the sick and dirty details WILL COME OUT and disgust everyone he loves even more than they already are. Bad decision, Speer. JMO
Don't be too upset about him pleading guilty. I know a few things about the law from personal experience, and people very rarely- if ever- plead guilty right away. There are time limits involved so most lawyers just start out with a Not Guilty plea. As his lawyer gets the case together, he may very well change it to a guilty plea.

Way back in the 1970's I was parked on the wrong side of the street in NYC where I lived. I couldn't get the car to start so I had to leave it until I could get a repair shop there. I left a sign on the windshield but my vehicle was cited anyway. I decided to go to traffic court and explain the problem. I pleaded Guilty With An Excuse which was one of the choices on the form. I really was guilty but there was a reason, so the plea made sense to me.

NEVER, EVER plead Guilty With An Excuse. Even though it was a choice on the form, as far as the law is concerned you can only plead Guilty or Not Guilty. If you plead Guilty and you are indeed found guilty by the judge, you cannot file an appeal. If I had pleaded Not Guilty and the judge found me guilty, I could file an appeal.

So, I wouldn't get too excited about the plea right away. It very well might change when they are offered a plea deal.
 
A Montana man charged with kidnapping and assaulting an 11-year-old girl from Cody was bound over to District Court on Thursday on three additional felony charges.

According to a Park County Courthouse news release, Jesse Paul Speer, 40, was charged after a preliminary hearing in Circuit Court, Fifth Judicial District, with aggravated assault, sexual abuse of a minor in the first degree and sexual abuse of a minor in the second degree.

Alleged kidnapper pleads not guilty to more assault charges

The additional charges – sexual assault in the first and second degree and aggravated assault – remained sealed by law until mid-January when Circuit Judge Bruce Waters found there was enough evidence for the case to move to district court.

Court documents accompanying the additional charges reveal that police have uncovered apparent DNA evidence which matches a profile obtained from the girl’s body and clothing to samples taken from Speer’s hair and inside cheek.

Even though this article was dated Oct 8 of 2013, the material sounds like it was written last year before he entered a plea. He waived the preliminary hearing that was scheduled for Nov 16 of 2012 (rescheduled for Nov 19) which automatically sent his case to district court for arraignment where he later pleaded not guilty on December 21 of 2012. After some hearings in early 2013, they set the trial date for Oct 7-25 of 2013.

Just learned of this case, any chance this photographer is responsible for any crimes in Canada?

This was a terrible case but the victim was able to get away and was lucky enough to be found by some hunters on their way home off the mountain. There were reportedly hundreds of pictures (snapshots) of unidentified (naked?) girls in his truck. I don't believe any info has been released about the pictures or the girls. Since Speer was known to travel from his home in Montana all over for his photography, I sure wouldn't rule out Canada as a place he may have traveled. Do you have a case in particular you are concerned about?

District Court Judge Steven Cranfill scheduled the change of plea and sentencing hearing in a Monday order.

One thing that I keep thinking about is all the pictures that were in his truck. There has been no information put out into any investigation into identities or other cases that may be involved.
Once this hearing is over and hopefully he is convicted of all the felony counts for this case, will the other girls and pictures go by the wayside?
