I disagree, there is pretty strong evidence who was on top of whom. We also have witness testimony (the only witness who saw any part of the fight) collaborate GZ's version. We have injuries to GZ.
Also to clarify, TM started running while GZ was in his car, still on the phone with NEN.
I don't see that as a good thing. Not because of GZ, but because of the mob mentality of folks who do not get what they want and feel they need to threaten someone. This country's justice system works the way it does, the jury's decision should be final, people should move on without threatening.
But there is evidence that GZ sustained injuries as well as evidence that GZ was on his back and TM was on him. This isn't assumption, there is evidence that supports that theory.
And neither you or anyone else know what was said on that phone call. All you have is a witness who has credibility issues about lying as well as someone who never once thought TM was in any sort of serious trouble since she never bothered to follow up to find out what exactly happened to TM.
Let's use Mr. Guy's own argument - common sense. Absent of knowing anything else, if evidences points to someone on top of another, with a witness seeing the arms going in a down motion and the person on the bottom sustaining injuries, common sense say that's it's likely that the person on top...
