    Discussion Thread #60 - 14.9.12 ~ the appeal~

Is it just me, but this step in the appeal process appears to be a waste of time in this particular case? I can understand how this step is used to avoid petty appeals, but in this case Judge Masipa's appeal decision has little or no effect. If Nel still wants to appeal the sentence and the...

@JudgeJudi ... I think we are on the same page. I had understood that the reporting of the injuries were just an example of inaccuracies and that means there will be more. I support your thoughts on her taking too shallow a view of the case. For me, the explanation may be that she was just...

The injuries mentioned in the judgement are certainly inaccurate, but I'm not sure their accuracy would have had a huge impact on her decision. Ignoring Saayman certainly would, of course. I've said on here before ... I think the level of debate between members on here and the collective...

As the case has divided the opinions of those close to the law in South Africa, from this alone, she must realise that another court could view the case differently. I can't see how she could argue that the case is clear cut. She had to SUBJECTIVELY decide if OP had intent. Subjectively...

Agreed. If I have a lot of deleting and re-organising to do on my iPhone, I always sync first and do the work on the laptop. It's just easier this way with a keyboard and mouse and I'm less likely to miss something.

At a push, he may have got away with involuntary action on one shot, but I think it would have been impossible to argue four involuntary shots.

BBM - I'm not sure why he would draw the neighbours attention to the house before he shot Reeva. He's lost control of the situation once he has alerted the neighbours. He would be taking a risk that neighbours may come to the house before he was ready or that the neighbours would now be awake...

@JudgeJudi - do you know if Masipa has ANY input to the process ? Does she have to explain why she came to her conclusion ?

Something that sticks out for me in your analysis ... Is it possible that Burger and Johnson heard the "Help, help, help" at the same time as everyone else, but just got the order of their events wrong ? If there had been "Help, help, help" before the shots, I would have expected the Stipps to...

@MURDERER SERVANT I don't think there were any warning shots. Reeva was standing against the door when she was shot. IMO If there had been any warning shots before this, she would have made herself as small a target as possible, curled up next to the toilet perhaps.

Thanks JudgeJudi. I've scanned the article you've tagged, but will give better/more attention later I have no problem in believing ear witnesses may have got their timings wrong, even getting the order of events wrong is possible. There is a test for cognative impairment where the assessor...

It's amazing what you can hear from a neighbouring house. I live on a small holding where the nearest neighbour is approx. 160 metres away across open land. At this distance there are three houses within 30 metres of each other. On a still day, if I stand outside my house, I can clearly hear...

Sorry. When i voted YES, the percentage went to 33% YES. I speculated (with flawed logic) that there could be very few voters if my vote took the percentage from 30% to 33%. The error was that I didn't know the percentage was 30% before I started. It was 30% when Estelle voted.

I know this recent case can't be directly compared with OPs, but just look at the sentence this South African killer got for CH ..... http://www.news24.com/SouthAfrica/News/Convicted-killer-sentenced-to-community-service-20140930 Apologies if it's been posted before and I've missed it.

Discussion between the verdict and sentencing

It's the Digital Spy forums. There are a HUGE number of posts on there, probably more active than Websleuths to be honest. Hope this link works for you, and you have a huge number of free hours available to read through it all :-) I think this is the current thread which has just started, but...

Discussion between the verdict and sentencing

I looked at this petition, but they are trying to measure support to re-instate premed murder .... and I just don't see that happening. I would be more interesting to seeing how much support Dolus Eventualis gets, not that it will have any impact I'm afraid. It would be the correct verdict in...
