    I find it more strange that the evidence in the HeB case was ordered by PJ to be destroyed less than 3 years after the crime. The order was issued 3 months after CB had been released from prison and less than 2 months before Madeleine disappeared.

    If not precisely recalling the contents of 2 short videos MS witnessed almost 20 years ago makes him an unreliable witness, then yes, he is, just as most people over a certain age would be. However, what he saw on tape clearly left a strong impression.

    Possibly because the only witness (MS) to the 3rd clip (approx.5 mins seen) showing the Italian-speaking victim couldn't recall enough facts and what he did recollect couldn't be corroborated by HeB. The first clip of an elderly woman, seen only by HeB, lasted approx 30 mins and much more...

    Perhaps the judge should establish the order in which the 2 witnesses viewed the alleged rapes on the tape and the duration of each. It's entirely possible HeB & MS viewed 3 rapes between them, with the one featuring the young girl tied to a post being the only excerpt they both saw.

    Isn't it down to the judge's discretion as to whether any evidence of a different serious crime found by chance during an illegal search in another case can be used by prosecution?
