No doubt this is amongst the evidence that the judges neglected to listen to before their extraordinary cancelling the arrest warrant?

Abuse victim thinks he is her tormentor

Braunschweig. The Braunschweig Regional Court is hearing CB for child abuse, including a crime in 2007.
  • May 28, 2024: The trial now turns to the fifth accused case from 2007: The victim, now 27 years old, is "very, very sure" that Christian B. was her perpetrator. According to the indictment, B. is said to have ambushed, grabbed and masturbated the then ten-year-old girl on a stretch of beach. She wants to recognize B. by his grin and teeth.

The abysmal court reporting does leave a lot to be desired when it comes to trying to keep up with events; which makes it understandable that you are unaware that as at present no verdict has ever been handed down in this particular child abuse case.

After his arrest in the playground of Sao Bartolomeu de Messines, arrangements for CB's deportation to Germany to answer a European Arrest Warrant were completed.

Which means that the present trial is the only one to address the circumstances of the crime committed against the Portuguese playground children in 2017.
The Braunschweig judges appear to have driven a coach and horses right through the middle of all five charges including that one ;)

Certainly seems to be ego driven. Their case is the problem. If it wasn’t, I sure the arrest warrant wouldn’t have been cancelled.

The smallish area where the PJ put together a list of 600 known paedos? It’s been argued on here that the Algarve was rife with sex criminals - from people who live there.

IMO the prosecution haven’t shown that only one person was responsible nor the it was their suspect.

So yes, given the above, I think it’s entirely possible.
 
He did say at the time he was taking a pee even though there were public toilets were yards away. When asked why he didn’t use the public toilets CB said he was desperate. One of the fathers of the children he exposed himself to checked the area and it was bone dry . Yet somehow the defence clutching at straws claimed maybe he was just shaking after he urinated , yet the ground was bone dry. With regard to beach assault at Salema JE picked out CB from a collection of 8 photos when she could have chose none.
In the photo ID process, the victim said she was 50% sure CB was her attacker. After CB was publicly outed and accused of a globally notorious crime, she increased her certainty to 80-90%. It’s odd that despite the universally understood fact that memory deteriorates over time, her’s improved. Perhaps she has the same life coach as JT.

This poor girl went through an ordeal I wouldn’t wish on anyone - I am not underplaying that. However, because she is a victim does not mean that she has identified the correct person as the criminal.

Let’s see what the result of these two cases. I think they are their best chance of a result.

IMO JE's certainty would have been increased by the public release, in July 2020, of a video taken less than 2 weeks before she was attacked. Not only could she view him from several angles, she could also hear the tone of his voice. The photo ID process had already taken place.
There is also a good still in the video of CB's rabbit teeth.

One aspect of criminal trials in Germany I have just read about is that the lay judges are not allowed access in the main to the full prosecution files. As those same judges are guided by the presiding judge I can now see why it's so important all 3 of the judges in the current trial are impartial and don't fail to disclose fundamental prosecution evidence to the lay judges.
 
I think the prosecutors are just doing their job and making whatever arguments they can.
I agree that the prosecutors are acting within the confines of their duties. Which raises the question about what on earth the judges were doing with charges which had been brought in 2022 and suddenly became incompetent at the eleventh hour of the five trials to which they referred.

The judges are there to do their job too and should strike an appropriate balance between the defence and the prosecution. But in a trial which saw the accusation of bias against one of the judges of the start of the trial, it appears that accusation of judges' bias are rife in this trial.

The court last week confirmed CB's legal team had applied to get the arrest warrant overturned.
His lawyer FF said he could soon be released from prison if it proved successful.

“If it is overturned and he is ultimately acquitted, he would be released in spring next year at the latest,” he told Sky News.

He added: “I am sure this will be granted. I can’t imagine it any other way.
“After the evidence had been taken, not a single accusation had been substantiated in such a way that one can speak of a suspicion of an offence.”

From that, one wonders what exactly the grounds are to justify an arrest warrant being arbitrarily lifted particularly in relation to German law and the exposure of male genitalia (whether in a state of arousal or none) in the children's playground.

There’s a danger especially IMO in being so invested in the bigger case - that just normal old criminal litigation gets over interpreted.

The prosecution appeal was a long shot. but probably the only argument they had. no doubt there is bad feeling. not uncommon!

What i am saying is similar things happen every month in cases across the land but we are all hanging on it.

Judges make rulings in cases. One party or other feels it’s biased. but getting Judges removed for actual bias is highly unlikely based only on an adverse ruling. MOO

I'm inclined to agree with you here, that because this case is so loaded with the history of how CB came to be on trial for these five cases, people are, as you say, reading all manner of nefarious intent into what is really just fairly commonplace litigation tactics. Bottom line, the prosecution's case against CB seems, on the whole, to have numerous weak spots and accusations of bias on the part of the court can't change that.
