How important was the information when he never disclosed it? He was giving a news conference about RK the minute RK walked out of his deposition. jmo
 
Actually what JB is floating in this motion is both the ability to seek redaction of certain parts of the call, if it is going to be released or the ability for the Defense to listen to the call as well so they can make intelligent objections.

Damage control but JB may get relief in terms of redaction or the ability to listen and object further. Such a distraction and rabbit hole.........
IMHO that most of this motion was not written by Baez. The whiny part probably was, but the rest was written by someone who actually may know the law.

Do you think Judge Perry has enough information already, after hearing the tape himself, and knowing that the institution recorded it, to go ahead and make his ruling?
 
I'm thinking maybe JB was trying to set up RobinL's testimony to use as his secret weapon come trial time to throw doubt on the SA's case. I don't think he would have ever come forth about the phone calls. All his planning backfired when the jail notified the SA of the phone calls and JB got caught with his hand in the bag so to speak. Now he's trying to paddle backwards as fast as he can, but he's already gone over the falls.

I'd assume LDB is thinking: Game, Set, ........ and leave JB to hang himself. He is making a mountain out of a seemingly trivial motion. He obviously said something damaging things... fun, fun, fun.

Baez has asked the court to seal the May 31 call of a conversation he had with state prison inmate Robin Lunceford. The prosecution wants it included in discovery, which would make it public.

Yes, I think he does but he will likely throw JB a bone to save [his] face.
 
Baez complains about not knowing the conversation was recorded and even tries to claim that because it was 2 months ago, how could anyone expect him to remember...
WTH? He's the one who told Casey not to make calls for this reason...DUH


I would be highly concerned if my lawyer who has been handling my case for approximately two years... openly claims he can't be expected to remember a conversation as far back as two months ago. JB's response to the state's motion only reinforces how foolish he is looking. Yes, LDB highlighted his foolishness, but he happily put it on the table for her to use. Did he seriously think there would be no rebuttal to his motion?

I don't get the feeling he is trying to redirect focus from something else that is going on, instead.. all I get is a feeling that between this phone call issue and the facebook photos that he is having one huge royal temper tantrum and inserting personal ego issues into his defense of Casey. This will not do her case one bit of good and frankly, as much as I dislike her.. she needs all the help she can get.

I seriously try not to trash the guy (although I think very little of his "talents" and style of defense) but at the same time.. someone who actually likes him in his personal life.. needs to do an "intervention".

Reminds me when JB said early on in this case that it would not benefit KC's case in any way if she told where her child was, or something to that effect. So is this more of the same. "We have damning evidence that will hurt the States' case but we are not going to tell you." Okay, is this part of KC's guessing game defense. If this evidence does not hurt KC why can't it be revealed. Plus it's part of an investigation of another crime. How much discovery have we gotten from defense? Anyone know????? jmo

LDB sure has got him right where she wants him. JB might want to reconsider playing with the big boys and girls. He's no match.

I agree. LDB doesn't need to embarrass JB...he can do that all by himself.
 
Good thing only the State has to pay for these ridiculous motions (not!).

PS- motions are a great way for attorneys to amass hours and drive up revenue
PPS- ya know I love all the lawyers onboard here :)

Hi Madjgnlaw, I kind of think that news article that you're quoting is actually wrong, IMO. The state really doesn't care one way or the other about the tape being released, and has said as much in their response. They only filed their response because Perry ordered them to. JMO

I think the State is somewhat ambiguous about the calls, they do ask that the motion be denied.

It sounds like JB, he's complaining about the tips not being ready and the cost, yada, yada, yada, his typical whining and need to have the last word.

I don't know but am I the only person who sees something hinky going on? His arguments don't make sense, but he is actually forming sentences and it flows. Nope, not Baez OR CM, even though I see JB signed it.
