I am so very sorry and in no way did I mean any disrespect to Zahra concerning this alleged rape.

I guess I chose the wrong words. As I said LE did not take that mattress for testing (which really really bothers me) as it could be the smoking gun for these rape charges - all they need is Zahra's DNA and one or both of these .

What I was trying to say is that in the large scale of this murder investigation this "block house" has not been searched. CSI has not gone there to collect any type of evidence and we all know what LE did to the house on 21 ave.

If one of these guys hit her in the head and she died later on - how is that now going to be proven? If she has a fractured skull won't it be easy to lay it on one of these two "unusual people" than EB or AB?

Yes, I think it is a horrible allegation. Yes, I even think it might have happened. But, now with all this coming out - the reasonable doubt that will be raised by this info is very troubling.

Again, I'm sorry - I did not mean that post to come across the way it did. The news we got late yesterday upset all of us and emotions were running very high. I just saw this rape allegation as a diversion from EB and AB and a way to pin this on anyone and everyone they could.

It still bothers me that LE did not take that mattress for testing. I don't understand that at all. Taking LY's word for it (when LE went and questioned him) with his rap sheet doesn't mal ke any sense. Investigations rule people out as much as they will rpove who the perp (or perps) are.

I am beyond shocked that LE did not take potential evidence :banghead:

According to the documents, the Burke County Sheriff’s Office investigated a claim that Zahra Baker had been killed by one or two men who had raped her at a house in Hildebran. The men--cousins--are related to Baker's ex-husband. The tipster alleged that Zahra had been left at the home, and when her mother returned, the little girl had blood on her private area and legs.

According to the search warrants, one of the men had a relationship with Elisa Baker.

BBM-why is this the belief? Because it wasnt indicated in the warrants that were released? I doubt we are seeing all the warrants. We have been fed specific ones. Personally, I have faith in this department and in the FBI who have also been quarterbacking this investigation. I do not believe that there is a stone unturned. JMVHO>

So, LE did search this house and had a warrant for it at the time - yet they did not take the mattress. I have to keep my faith in LE as for why they didn't take it. It certainly had to be more than just LY's word that he "was airing it out because he had urinated on it". But, it still bothers me. Maybe LE was sure that this rape tip was fabricated. Maybe both LY and TY had firm alibis for the time this supposedly happened. I don't know. But it still bothers me because I keep going to the statement that TY supposedly "hit her in the head".

Ya know - you're right - LE could have gone back and taken it. Wouldn't they have gone back and stated that they did "seize" this mattress?

IIRC LE has THREE mattresses - one from the house, one from the landfill, and one from (undisclosed location). And I also recall reading an article that said that LE went back and retrieved a mattress. So, yes they could have gone back and taken it. Sure wish that reporter that spoke to LY last night would have asked him if LE took that mattress at any time.

I am going to put on my magic hat and project that LY would not have answered that question...but of course I could be wrong. People are talking to the media right now who might be material to the case. It can work both for and against them I believe.

Another possibility is that they didnt need to execute the warrant-that LY and SY were cooperative on letting them search and take what they wanted. Hence the no seizing of the products of the search?

I still find it disconcerting (to say the least) that the mattress was not swooped up as even possible evidence in the alleged rape of our little love. Can anyone tell me if it was seized in a subsequent visit?

OMG...I don't think I can even read any more about this case. I was also directed here from the Skelton thread (3 Michigan boys) and I am utterly speechless. I don't post much but I had to say I just don't understand how someone can do things like this to another human being, let alone that beautiful, little innocent cancer-survivor. Someone up thread said it, but count me in as another person who would have loved to have raised this child, given her love and shelter and protected her. Rest in peace, Zahra.

It states that LJY was questioned for 10 hours and he self reports he passed a LDT. He does not give a ringing endorsement of SY-but perhaps that is editing by the journalist.

Eyewitness News reporter Alan Cavanna contacted one of those men on Tuesday night. James Young denied the allegations, saying he was a family friend of the Bakers, but that he never saw Zahra at his home. He added that he was questioned by police for 10 hours and passed a lie detector test.


The other man named in the warrant is Young's cousin, Sammy.

Young said at one point, Elisa Baker and Sammy had a relationship, but said he doesn&#8217;t think his cousin had anything to do with Zahra&#8217;s disappearance.

I must be naive but I didn't think that this case could get much worse... I am truly sickened and so sad and so angry, I hope that the law comes down on the people who hurt this child like a ton of bricks, this make me despair of human kind, that poor poor girl

JMHO, but I'm not so sure about the allegations of rape by the men named backthread. (not disagreeing with any comments, just the allegation itself).

Rape? Sure but ---- JMHO---

1. Women can and do rape little girls too.

2. Who is this man who says his sister told him that this happened, and who is his sister and how does she know that this allegedly happened---for sure?

I'm still catching up but this part of the story does not pass the sniff test for me yet. Something's off. JMHO until I see something rock solid. Again, I am still trying to catch up with all the threads and it's going to take me more than just the few minutes I have today.

We are no where near the bottom, the truth is still a long way away. I am thankful we will never really know the full depth of what that sweet little girl endured. I think it's far far worse than we can even imagine.

Hey Kat......I'm kinda at the I think the rape happened, I'm just not sure it was by the 2 men stated. I think there is alot of family dysfunction with ALL of these family's and what I'm sensing is a banding together of the real perps to throw others under the bus. KWIM? I think there is some bad blood floating around and some see this as a chance to get even for a few things. IMO, blah blah blah.........

Hi Kat. Hope whatever is keeping you busy in RL is all good.

Those questions loom large in my mind. I've posed them for AY (Railbugfreak) in his Q&A thread with the hope that he can shed some light on the credibility of the allegations. Without an arrest or a statement from LE, I can't just accept that either of the Y cousins committed the rape without knowing more about the person(s) behind the story and their possible motivations.

I also have to say that photos shown on (public) FB sites of LJY compared to the video interview here http://www.wcnc.com/news/local/Search-warrants-in-Zahra-Baker-case-unsealed-111070214.html have me even more deeply concerned. He has some of the same decline in physical appearance that people have noted about EB. Lost weight, drawn look, worsened complexion. Things that may indicate that the two were abusing a similar substance.
