Simon is an awesome witness! Knew the difference between garbage and decomp! He smelled the pontiac, and smelled a strong odor, but peeked in and didnt see anything suspicous. Didnt give it much more thought until GA and CA came to pick up the vehicle...

LBD asking to approach with a stipulation . . . shows to JB . . .
Stipulation June 30 2008 Johnson's towed kc car from Amscot to tow yard . .
SB looking thru records . . .tow sheets, impound sheets. . .property removal . . .Tag Talk document records from Orange Co to notify who registerd owner of veh. . . Orange county impound sheet . . copy of title, GA's signature to reclaim veh. . . .
Actions taken by wrecker . . .driver fills out papers . . data entry clerk . . when tow truck driver brings car in . . VIN & license plate number . . .data entry clerk runs tag talk to find out owner . . .paper is filed in daily files . .. specific area where veh. stored. . . veh. are segregated in that yard . . .document in processing marked and stored accordingly in their own individual locations . . . other locations are for private tow vs. police tow . . .etc. . . .photo (LG) overhead view of storage facility on Narcoosi Rd . . since then there has been some work done to Narcoosie . .

State of FL gives tow companies opportunity to recoup losses .. Johnsons would title and resale on or crush it and scrap it out . . .SB would make decision . . . depending on year of vehicle there was a cut off period either 35 days or 50 days .. . 3rd business day . . . handled by main office . . .process paperwork . .3rd day letter generated sent to Registered Owner of veh. . . charges to date and whre it was located . .. 98 Pontiac Sunfire . . .2 weeks . . .normally 3 or 4th day pay a little attention to it . .. high turnover of vehicles in and out . . .round about 4th or 5th day we had vehicle . . .gave a cursery inspection . . .title veh. . . get keys and expense f getting it titled . . not permitted to enter it . . .remained locked . . .wasn't our car at the time . . visual external and through the glass of the car . ..didn't have the keys. . . .doors of car were locked . . .pulled handle . . . as I was looking around the veh. there was nothing noticible at all . . .until I put hand up to windshield to shield sun from glass. . . I smelled odor coming from car . . .other than 2 yr haitus . . .he worked 30 years . . refuse & recycle of garbage with Waste Mgmt co., exposed to wide variety of odors. . .in 30 yrs . . dead body in vehicles . . .6-8 times in his career . . .misfortune of tow car with dead body also been to thousnads of deaths @ vehcile accidents. . .car stored after someone committed suicide and not found for several days . . .he smelled that odor . . .has been in Waste Mgmt had all manners of garbage and items left in their car . . . range of experiences items left in cars . . tow for many LE agencies over the years. . . DUis breakdowns, food left in car . . .exposed to multiple scenarios . . most people don't expect to have their car . . .get in wreck after getting groceries . . food left for a week in the car . . .he can distinguish between trash/garbage & decomp human remains (object-overrule) in his opinon/experience . . .human decomp is unique distinctive smell . . he knows the difference when he smells that . . . when hand to glass to shield sun noticed an odor . . .odor consistent w/decomp . . car is well sealed . . strength of smell . . little minimal but smell there . . . looking in veh. noticed nothing . . .but he smelled it . . .at that point it is just a car in the yard . . .made inspection determined what they would do with that car . . .treated as everyother car in yard. . .all had been correctly stored/processed . . someone came to pick up veh. . on 7/15th . . he believes . . .wants to review Johnson's records . .. confirm 7/15/08 . . .Mr & Mrs. A came to pick up veh .. . SB had contact w/both of them . . thru bullet proof glass initially . . .SB was in his office off dispatch clerk office . . heard clerk engaging in conversation with people @ window who were becoming aggitated . . .he tried to keep confrontation to minimum . . clerk turned to SB gave look asking for help . . .CA was aggitated and upset why so expensive . . .why not notified when they had car . . .not beligerant but very upset . . .looked @ calendar . . date car came in . . .days of the week and stuck in mail over 7/4 holiday . . .they were out of town for couple days . . . Johnson had followed due process . . .took a few days for them to get the letter . . . went to veh. w/ one of the A's . . .

Listen. If you have NEVER EVER EVER smelled human decomposition in your entire life--the second that you do you will know EXACTLY what it is. You will not question if it is an animal or garbage. You will instinctively know that it is a human being decaying.
