I actually don't think he has created doubt - I just think he's done as well in getting a witness to agree with him as he's capable of. He's not very capable, so I think this is an accomplishment for him personally (if not an accomplishment for his defense of ICA)

From a personal point of view I have doubt about this evidence and I do strongly believe ICA is guilty. I just have doubt about this evidence. Its ONE hair, and the witness has only studied this type of science for 6 months. It creates doubt in my mind.

You don't feel comfortable showing this jury a photo and saying root is here, banding is there? Lowe: Not a matter of comfort.
 
Hopefully all this will be quickly cleared up for the jury on redirect.
 
Notice ICA's improved demeanor today, since this testimony doesn't show what a beligerent, liar she is.

ETA: Oh, half day today, forgot. Why, then is he not concluding as he said he would awhile back?

He's pointing out she failed her first proficiency test. Big whoop, I failed my real estate exam the first time around. How many times did he fail the bar exam before he finally passed?
 
I think JB has created some reasonable doubt on Hair banding
 
Why does he not just move the photo into evidence?

because he is not actually trying to get them to see the band he is trying to get them to seem shady and incompetent by withholding the picture.
 
She just sits there blank as they talk about hair from her precious dead child. freaking unreal, IMO:banghead:
 
JB is going to take this to end of day I think. He does not want SA to end the day.
 
I am afraid JB is making mincemeat out of the hair banding. unfortunately this is the first time he has made any inroads into this case but it isn't making it look like the State has much on the hairband
 
Doesn't hair grow after you die? A little bit? Wouldn't that explain why the band is a little above the root?

No, hair (and nails, btw) do NOT continue to grow after a person dies. The skin dehydrates and shrinks back, which gives the appearance of growth, but there is no actual growth.

It was confirmed by another agent, so I'm more comfortable with it than I would be if it was observed by her alone.
 
If she has a failed test in 2000 why does it matter if she is tested every year and has passed every year since? :dunno:

In looking at the photo, she would rather look microscopically. It would be difficult to determine where the root starts from the photo.

It is difficult to determine characteristics of hair changes along the length from a photo if the hair is in the andogen phase.

Photos she brought are demonstrative.

Yearly proficiency test. She agreed she failed her first one in 2000.

Her depo was 4/10. After that - did your lab develop a paper on post mortem hair banding?

JB - photo of Q12- never shown to the jury.....Correct.....banding is above the root? (object not in evidence- lets move on folks)
looking @ photo could you determine where root ends in that photo....band in transition point hair is hardened above the skin line......kerotin is still soft......

would you say it's difficult to view photo to determine charcteristic of hair ....can't capture how it may change along length of hair....limited to view of that photo.....

difficult to know in photo where root ends .....less difficult with hairs completed growth cycle - q-tip .......more difficult on hair not finished growing unless under micro....

articles you refer to don't give you hairs but photos of hairs...correct

proficiency test you failed your first one? in 2000 I did.....after depo taken 4/2010 ....your lab then created a study on post-mortem root band (object- beyond scope -Approach!)
