Some TH attorney said last night that Arizona does allow a convicted murderer to waive mitigation. However, psych eval is mandatory and the "waiver process is complex".
I am probably wrong but this smacks of Joe Arp the Sheriff and it has all day. First the bomb threat, then the delay, I heard the judge firmly they were to be there at 9:00 this morning; then it was delayed...now "pushed back" that is just bizarre! We all want to know really what's going on. What is this 20? It's a game now....it's all very immature and this CAUSES speculation!
Nobody knows but everybody's speculatin'. HLN reports that in Arizona she can say she wants the death penalty, and they can stop all of the rest of the phases, and, of course, they'll need to give her a psych eval. to see if she is mentally able to make that decision. Juan, Flores, no one is talking to the media but that won't stop the TH from doing their thing all night long, and JVM will continually watch 'the door' in case she can chase someone down for a "no comment". :banghead:
And the seething anger and pure evil was literally dripping from her when she was saying those things. I didn't think it was possible for one to become more evil than she already was, but I think I was wrong.
And now this seriously evil, maniacal deranged killer continues on with the drama and manipulation, all because this jury didn't fall for her lies, and because she's not satisfied with the verdict handed down to her. :banghead::stormingmad:
I bet this does have something to do with their filing.
They would need a few days to work out the details of getting them all on video.
I mean, no other reason for Deanna to stay with the family at this point...unless she will be involved in the victim impact part. I mean, yeah for support. But it seems more than that.
It doesn't explain the security/police presence but it makes sense knowing what we know about the motion filed. At least to me
she was leading the pack from the jail to parking lot last night, sorry her fast, sure steps unaided--- slap in the face who felt sorry for this woman. I'm disabled and at times, would have welcomed one...never used it. My father has post-polio and has one, refuses to use it while he can still walk.
Perhaps she can only walk short distances, maybe they should have left the wheelchair out of the court-room. Therefore, when she is seen walking full steam, people wouldn't judge her so harshly. jmho

One talking head said she must be found competent at every phase of the trial. She's probably throwing hissy fits, and who gives an interview 20 min. after they are convicted???I don't know the legal side of things, but logically speaking she was evaluated by both DeMarte and Samuels using two similar tests that both arrived at a personality disorder. DeMarte clearly stated that she administered the MMPI to ensure that there were no competency issues.
Psych eval just does not make sense. IMO
