I have a question (sorry if it's been answered) concerning Dustin Kent, the initials are always confusing - so I'm typing his name. He was arrested 3 times. Now, when I read the charges, the last arrest doesn't include incest. So, he was arrested for 3 different incidents or 3 different people? I'm not trying to sleuth victims here, I just don't understand his charges or the method of them at least.
WBB and DW are they only ones not being charged with Incest?
Without having the benefit of the actual warrants in hand as issued and going only by the charges identified on the BCSO & Metro websites - the information above is accurate (as far as we know).
We know there is more than one victim (as stated by LE) so it is likely there are non-family members in addition to family members who are victims.
Alabama Code - Section 13A-13-3: INCEST
A person commits incest if he marries or engages in sexual intercourse with a person he knows to be, either legitimately or illegitimately:
(1) His ancestor or descendant by blood or adoption; or
(2) His brother or sister of the whole or half-blood or by adoption; or
(3) His stepchild or stepparent, while the marriage creating the relationship exists; or
(4) His aunt, uncle, nephew or niece of the whole or half-blood.
To put it more simply - in Alabama all family relations are considered incestuous with the exception of
cousins by blood or marriage as well as
nieces, nephews, aunts or uncles by marriage only.
It was my understanding that DK not being charged with incest in his first arrest in Baldwin County may have been an oversight (although... it may be accurate).
DK's third arrest (this time in Mobile) did not include a charge of incest (again - this could have been an oversight or it may be a non-applicable victim).
DW was initially charged with incest but that was later removed due to an error. There is no way to know if it was an administrative error or upon further investigation it was technically not applicable.
WBB is not related to any family member by blood or marriage (AFAWK) so a charge of incest would not be applicable, at least not at this point.
