Suspects in Kamille McKinney killing make first court appearance

Patrick Stallworth, the man charged with capital murder in Kamille McKinney killing, told the judge, “I don’t understand how I’m being charged with the murder of this child.”

Both Stallworth and Derick Brown, the woman charged in the child's death, are being held in jail without bond.

According to court documents, little Kamille died on Oct. 12 of asphyxiation.

As the community grieves the tragic loss of Kamille "Cupcake" McKinney, a beautiful girl taken from us far too soon, join us as we honor her memory and support her family.

Kamille “Cupcake” McKinney was abducted while attending a birthday party in Birmingham’s Tom Brown Village public housing community on Saturday, Oct. 12, 2019. Her abduction spurred a massive search effort that lasted for nearly two weeks. The entire state of Alabama was devastated to learn from Birmingham Police on Tuesday, Oct. 22, 2019, that Kamille’s remains had been found in a dumpster. The heart-wrenching news has touched not just the Birmingham community but has resonated nationwide.

Jefferson County District Attorney Danny Carr spoke to CBS 42’s Robert Sherman about the investigation into Kamille “Cupcake” McKinney’s murder.

Carr says investigating authorities believe McKinney died of asphyxiation.

If found guilty of capital murder, the two suspects charged in McKinney’s case could face the death penalty, the DA said.

Kamille 'Cupcake' McKinney's funeral is Sunday; warrants reveal how 3-year-old died
The funeral for 3-year-old Kamille "Cupcake" McKinney is set for Sunday afternoon, and the child will be buried at Elmwood Cemetery in Birmingham, Alabama.

There will be no public viewing, the funeral home handling the child's arrangement said.

The funeral is planned for New Beginning Christian Ministry, where pastor Sylvester Wilson said the church has a 700-seat sanctuary and can use its fellowship hall as an overflow auditorium.

“It’s open to the public. I already know that our church is nowhere big enough to hold this crowd,” said Wilson. The child’s mother previously attended the church, he said.

Also, Crime Stoppers of Metro Alabama said it was establishing a permanent reward fund in the girl’s name to help in future child abductions. The group said it had received more than $35,000 in donations linked to the girl’s disappearance.

“There is no silver lining in the Cupcake tragedy,” Frank Barefield, chairman of the organization’s board, said in a statement. “However, we are deeply moved by the public’s generosity during the investigation of her kidnapping. WBRC obtained court documents showing that Derick Brown, 29, had lost custody of her three children in July 2018 after a relative reported her for putting one of them in a washing machine as punishment. A day after the Department of Human Resources took the children and placed them with a relative, Brown allegedly went to the relative’s home, pointed a gun at them, and took her kids back.

Though Brown was released from custody shortly after the indictment, her bond was revoked on October 13 when she was identified as a person of interest in the disappearance of Kamille McKinney, 3. Days later, the toddler’s body was found in a dumpster at the Woodside Condominiums in Center Point, where Brown and her boyfriend, Patrick Stallworth, 39, were reportedly staying.

In December 2010, Birmingham police charged Brown with robbery and fraudulent use of a credit card, both felonies. While awaiting sentencing, Jackson’s probation from the 2009 theft case was revoked, resulting in her spending six months behind bars.

Earlier this year, Brown wrote a letter to the judge presiding over her felony case. In it, she explains that she didn’t want to lose her children and revealed that her own childhood involved sexual abuse, treatment in mental health facilities, and years in the foster care system.

Purple and pink flowers and balloons adorned Kamille's tiny casket at the 3-year-old's "homegoing service" at New Beginning Christian Ministry. Colorful cupcakes and an artistic rendering of little Kamille sat alongside the white casket.

The girl's uncle, SL, reminisced about the soft voice she used when she called for "Uncle Steve." Addressing his sister -- Kamille's mother, AT -- and her father, DM, SL said he was only a phone call away if they ever needed to talk.

Social media images for what loved ones opted to call a celebration of life rather than a funeral, showed New Beginning Christian Ministry covered in flowers, including a giant wreath in the shape of the snack she is nicknamed after.

B’ham barber uses passion for cutting hair to comfort the family of Kamille McKinney

Lee said he was contacted by Mayor Randall Woodfin’s office to cut the hair of Kamille’s brother.

Lee, a barber and artist of more than 25 years, said he free-handed the design of a cupcake with pink and purple frosting and white angel wings, which he shaved into the back of A's head Friday night just ahead of Kamille’s funeral Sunday.

“He paused and was like, and he said, ‘Oh my gosh, I love it.’ And that put a smile on my face,” said Lee.

‘You can’t have a worse crime than this’: Legally what happens next in Kamille McKinney’s murder case?

While Carr and his team work to make their case, Stallworth and Brown are being held without bond.

At least one defense attorney thinks it’s possible they are being kept out of the general population. “A three-year-old, you can’t have a worse crime than this,” said Attorney Roger Appell.

While he’s not directly involved in this case, Appell has handled several other capital murder defenses in the past. He thinks a plea bargain is unlikely.

"This one is going to be very, very difficult to settle because of the high visibility of this. And we’re talking about a three-year-old child. This case absolutely makes no sense,” said Appell.

Public sentiment certainly doesn’t appear to be in favor of a deal. By Monday afternoon, an online petition calling for “no plea deal” and the “maximum punishment,” had already been signed thousands of times.
