Push for Kamille “Cupcake” McKinney law
An online petition is asking that a federal law, mandating 24/7 video cameras in apartment complexes, including public housing, be named in honor of three year old Kamille Cupcake McKinney.

Some Alabama lawmakers object to mandating all apartment complexes install video cameras, but they admit to being moved by McKinney’s death.

"As a parent we all are broken hearted. Just thinking about our own children when you see something like that. Its heart breaking. It just breaks your heart,” Sen. Cam Ward (R) Alabaster said.

“I get the passion, wanting to do something. I think you need a holistic approach. One, how you handle someone who shouldn’t have been on the street to begin with. Two, how do you handle proper lighting. Three, proper security measures,” Ward said.

“Anything to help deter the crime is a good thing. But, I’m going to wonder how long it’s going to last. I guarantee you it won’t there too long. You are going to have target practice when it goes up,” Rogers said.

The Birmingham Housing Authority has beefed up security, in part by agreeing to a $3.6 million agreement with the police department for increased patrols.

McKinney's cousin Shuntae Long says the wrong people are behind bars for her murder.

In honor of ‘Cupcake,’ Birmingham activists provide safe Halloween for kids
Just a few blocks from where 3-year-old Kamille “Cupcake” McKinney was abducted earlier this month, the children of Birmingham were given a safe place to trick-or-treat this Halloween thanks to activists.

AQ, one of the organizers of the event, said Kamille’s tragic abduction and death inspired her to give back to the children of Birmingham.

“I’m a mother, I’ve got two Cupcakes myself,” said AQ, 33, who has twins and a teenager. “I felt like we should rock the block one last time to tell our little cupcakes that are still here, ‘Hey, we’re not going to let you out of our sights.’”

Thousands sign petition calling for video cameras at public housing after McKinney's death

Investigators haven't yet revealed how and when exactly she was taken from the area and while cameras are peppered throughout the city, Sergeant Johnny Williams with the Birmingham Police Department says there aren't any cameras located in the area where McKinney was abducted.

"There's a possibility that it could have very much helped that case," said Williams.

"The way Cupcake came up missing, you know it wouldn't hurt to put cameras where they need to be. You know the only people that would need to worry about cameras is the ones that are doing things they shouldn't be doing out here," said Reed.

Some see this petition as profiling, but Reed sees it as a necessity.

"We also have to remember that cameras can't be the catch all, we still need the communities support and input in investigations... but we also welcome those cameras," said Sergeant Williams.

Suspects in murder of “Cupcake” McKinney to appear in court on Monday

Patrick Stallworth is set to appear in Jefferson County Circuit Court Monday morning at 9 a.m. This is an initial appearance date for Stallworth to hire an attorney.

Derick Irisha Brown, who is also charged in the case, is also set to be in Jefferson County Circuit Court on Monday. Last month, Brown was appointed an attorney to represent her on charges of capital murder. Stallworth and Brown remain in jail. If convicted, both could face the death penalty.

Kamille McKinney: Attorney says Patrick Stallworth innocent of child’s murder
The newly-appointed attorney for a man accused of killing of 3-year-old Kamille McKinney said his client maintains his innocence and wants the opportunity to clear his name.

Veteran defense attorney Derrick Collins was appointed Monday morning to represent Stallworth on the capital murder charge. He already had been appointed to defend him on child *advertiser censored* charges filed shortly after Kamille’s abduction. Police have said none of the pornographic images were of Kamille.

“It’s a bad situation for him. He’s very distraught. He’s just confused,’’ he said. “He’s trying to accept the situation he’s in and learning to try to deal with where he’s at.”

Danneman said Monday he was not yet ready to make a statement on Brown’s behalf. He did ask the judge that their preliminary hearings be held separately, which the judge denied.

This what I swore an oath to do. I’ve handled death penalty cases and capital murder cases for 20 years.”

“There’s a question of whether he can get a fair trial anywhere in this state because this case is so publicized,’’ he said.

It wasn’t immediately clear how long he lived at Woodside Condominiums – where he was initially arrested – but management there said he had lived in one building until it burned in September and then moved to his current rental apartment which was padlocked after his arrest.

Kamille McKinney's Suspected Killer Says He Is Innocent
One of the suspects accused of kidnapping and killing 3-year-old Kamille McKinney says he is innocent. The attorney for Patrick Devone Stallworth says his client wans to clear his name.

Stallworth, 39, and his girlfriend, 29-year-old Derick Irisha Brown, are charged with capital murder of a child under the age of 14. If Stallworth and Brown are convicted, both could face the death penalty.

The coroner's investigation showed Kamille was killed the same day she was kidnapped.

Gag order issued in Kamille McKinney trial
A Jefferson County judge has issued a gag order in the capital murder cases against two suspects accused in the murder of 3-year-old Kamille “Cupcake” McKinney.

Circuit Judge Clyde Jones issued the order Tuesday morning, citing pretrial publicity of Kamille’s disappearance and subsequent murder and the arrests of 39-year-old Patrick Stallworth and 29-year-old Derick Irisha Brown.

The order, Jones wrote, is to ensure a fair and impartial trial. It prevents the Jefferson County District Attorney’s Office and defense attorneys for Stallworth and Brown, from making further statements about the case.

UPDATE: Gag Order issued Suspects in murder of Kamille McKinney make second court appearance
Jefferson County Circuit Judge Clyde Jones has issued a Gag Order in the capital murder case involving Kamille “Cupcake" McKinney.

The Gag Order reads:

After consideration of the recent amount of pretrial publicity in the above-matter, the Court hereby finds it necessary to ensure a fair and impartial trial for both parties to enter a Gag Order which hereby prohibits any member of the District Attorney’s Office or Counsels for the Defendants from making further extrajudicial statements concerning any and all matters pertaining to the above-styled case. Any violation of the above will immediately result in sanctions being imposed against the offending party.
