Now that the state will foot the bill, has the defense rescheduled their long overdue appointment to come to Mr. Nejame's office to review the TES docs?

I love when Mr. Nejame points out the various and sundry problems with their motions. I have noticed that not only do the prosecutors do this, but each and every lawyer for the county, the OS, Tony...actually everyone who takes to the podium mentions how poorly prepared and wrong on the law the motions are. It is an ongoing problem. I would be mortified if that happened once, let alone each and every time I file something.:waitasec: If you stand up at an office meeting and get thoroughly embarrassed because you had your facts all wrong and other members on the team called you on it, publicly, how prepared would you be the next time? Imagine if it were in a court of law when the proceeding was to be broadcast, nationally, and live. My little nephew practices his speeches or essays he may have to read aloud in class. I don't care how busy we are, when he asks us to we drop everything and listen to him do so. Do you know why? We do it because we are happy and want to encourage him not to ever hand in anything he isn't proud of. I'd be willing to bet my little buddy spent more time and enthusiasm researching what veterans we have in our family to make his memorial day presentation than Baez spends looking up proper case law and compiling his argument. My nephew asked my brother to take him on to the base so he could interview some young Airmen and also to the Veteran's hospital to interview some of the old boys ( as he called them ). If a kid of eleven knows to take your time and gather all the facts and research and check his work, can someone tell me what the heck is going on with the defense team? Why haven't even Mort or one of the lawyers from Baez's office or even a paralegal been sent to review those records? IT IS NOT REQUIRED THAT IT BE ANDREA FLOWN IN FROM CHICAGO!

One of new posters has a tag line from an old song "How can you have any pudding if you don't eat your meat? When I saw how incredulous , to use his word, Mark was at what Baez was doing it reminded me. Here we are, a year after this hearing and Mr. Baez is still attacking TES and even Mr. Nejame himself. I guess he'll never learn.

Mr. Baez " As an officer of the court , I feel I have to advise the court....a possible violation 4-1.9 of the cannon of ethics. Mr. Nejame represented Cindy and George Anthony previously and the Anthony family had requested this information from Mr. Miller directly."

Judge: "Let me stop you, let me stop you. You are basically filing an Ore Tenus Motion in court, he hasn't heard this. If you want to make either a bar complaint, or put the court on notice regarding some ethical violation, put it on paper. Send it to me, but that is not noticed for today."

Mr. Baez: "What I am just saying is I ..I ...think it is my specific duty to advise the court of that."

Judge " Alright. You have done so."
Baez: " I wont be filing any bar complaint"
Judge " OK. The court is on notice."

Mrs. Drane Burdick asked the court to strike their motion...

Mrs. Drane Burdick "It provides insufficient factual support. Counsel's assertions as to what was reported in the media certainly is double and triple hearsay......
We ask the court to strike it and if they want to refile it when they have some actual factual or legal support for it they can do so at that time."



The Judge: " The factual basis for the motion is, as I said , thin and the motion is DENIED."

My favorite part is in tape seven. Brad lets the court know that indeed mom and pop do not claim ANY CONFLICT OF INTEREST regarding Mr. Nejame, indeed they specifically waive it. One would think that Baez would have called Brad up and asked about their stance before he stood in open court and made these claims. Good Grief!
 
JB appears to have done only enough to make the court and public opinion think he was actually pursuing the TES documents as a serious part of the defense. I don't think he ever was serious about reviewing them as other posters have noted as well.

I think KC is happy with him because up until now he has gone along with her fantasy, he has probably told her what she wants to hear about the possible outcome of her case.....this way she stays in KC land as long as possible.

KC's counsel is a direct reflection of her..........

In a way JB reminds me of some of the trolls. He seems to know what things to say and ask to get a big reaction. . . and then dismisses the entire exchange as being off topic. He may be lazy; he may be crude and bungling but he does have street smarts. He fights dirty and it's allowed because it's within the scope of the TOS, err, I mean judicial system. :D
 
I think the volunteer searchers for Tes were noble in their efforts and we owe them a great deal of respect. I think the organization by Tm was a noble effort and we owe him a great deal of respect for that. However, I believe that at the end of the day, Tm will have to turn over all records. IMO
 
The fact that they made the appointment is very , very important...because unlike what they pretend....obviously they knew the records were available to them to come and review. I know that Mark will mop the floor with the defense over this glaring fact.

Let's face it. Baez is in over his head. He does not have the ability or experience to defend this case. He does want to drag it out because he knows when it comes to even giving his opening argument, he's going to flop. Okay, it's just my opinion but, I think in the year plus that we've seen him in action - in court and in front of the press, he is not equipped for a case this large and complicated with a defendant who has lied so much through the investigation. I assume if Casey lied to LE, she probably lied to her defense team also. jmo
 
Wow, we were just talking these last few days about if one of the hold ups for the defense to go to Mr. Nejame's office could be partly to pay the fees up front...and why doesn't the defense just get on with it and ask to declare her indigent so we can get case going. Finally...they have done what I wish they would have long ago. Now....how many more months will it take them to examine these TES documents they have demanded for the last six months?:furious:

...thankfully, now that the Judge has them on a set trial schedule, they'll have to actually get it together and prepare for trial!

I think the volunteer searchers for Tes were noble in their efforts and we owe them a great deal of respect. I think the organization by Tm was a noble effort and we owe him a great deal of respect for that. However, I believe that at the end of the day, Tm will have to turn over all records. IMO

He already did. He hand-delivered the obviously important ones and offered the rest for inspection.

I think, but have no legal expertise to base it on, that because the searchers were volunteers, motivated by altruism to search for a small child, that all the records will not be required.
For the same reason that the identities of blood donors remain confidential, so should the identities of these folks because a failure to protect them will cause a greater harm in the larger scheme. Caylee is not the first person TES has searched for but this defense request has the potential IMO, of making it very difficult to find searchers in the future.

If I searched the field outside of Disneyworld, miles away from Suburban Drive what exactly does JB want from me? This is a defense that can`t even get the depos of principle players in the case completed and they want to interview a few 100-1000 more people who may have travelled from NY or Canada to help search. Are Florida taxpayers expected to finance this fishing expedition?

If JB really needed information from searchers, he could have used one of his many media events to appeal to them to contact his office and provided an 800 number for them to do so. He could have kept his appointment with Nejame too. Sorry NTS, but I just don`t think JS will be changing his ruling or even entertain much more of this discussion with the defense. JM gut O

If defense feels a certain person's records are relevant they can request copies for review with the judge and decide if the defense can have the records. Very simple solution to defense's problem. Obviously defense knows what they are looking for or why would they ask, unless of course they are just fishing. JMO

Sometimes, the vast ineptness of the defense team makes me think that the defense is actually working toward, and hoping, that it will be determined that KC did not have competent representation and thus force a mistrial. Of course, it would just start over again, right? (Don't know if I could take THAT...)

in spite of:

her mom
her grandparents
the news media
the lawyers
the publicity hounds
and all the vast array of circus performers supplied as extras who insert themselves into this child's murder story.

I can't even call it a trial yet .. because right now it most closely resembles a 3 ring, complete with clowns, cowboys, slight -of-hand magicians, and trick riders.

The way it has been playing out has not been very good for most of the parties trying to make a buck. At least 2 attorneys have been disbarred or at least in a lot of trouble ethics wise, the Anthony family certainly has been exposed for what they are, AL's book is a joke and she has been shamed for her unprofessional and dishonest tactics/statements, Baez may be in hot water over the $$ issue, Padilla has petered out.

Unfortunately, good people have been tarnished as well, but I don't think Caylee's murder has been the golden goose that many money seeking predators had hoped for.

In my opinion, the crowning glory of this case, of course after the Anthonys are in jail, would be to have some strong legislation which reforms the absolutely disgusting practices in play, specifically by the legal profession and the media, and what defendants are allowed to sell (just blows my mind that thousands of people were searching for Caylee while Casey was loading up her backpack with pics to sell at her lawyers' office of all places). It needs to happen now.

I think in light of this most recent discovery release, and the fact that LE is questioning several searchers about the TES forms and the fact that the forms could have been falsified and MAY have been BY the defense, this MAY explain why Baez did not go look at the documents when he had the appointment and the chance. I know the Laura Buchannon lady that keeps coming up in the documents does NOT seem to have been interviewed as part of this recent release. Wonder why LE hasn't talked to her? Perhaps a figment of Baez' imagination?
