""I highly doubt he found anybody who was in that exact spot and until he presents a witness list under oath, I'm very questionable of anything he claims," Hornsby said.

Mason said he plans to present the new witness list to Perry on Friday."

Who doesn't love an honest DEFENSE lawyer with a logical point of view!!!

It is obvious to me that they have yet to find anyone who can testify under oath that they searched the exact area and did not find Caylee- if they had they would not be carrying out these indiscriminate desperate phone calls to everyone on the TES list.

I just watched the video and CM is now stating 15 - 20 new witnesses that will claim to have searched the Suburban St. area and will say that there was no body there.

I remember when TES did the second search and how disappointed we all were when Tim Miller announced that he was canceling any further search of the area. It was November 9, 2008 and he was interviewed saying that "this area was under water the first time we searched and we planned on searching it this time, but there's areas that are still under water. We almost lost an ATV today, and it's too risky to have horses in here because if little Caylee is in this area, a horse stepping on her could push her into the mud."

That was a little more than a month prior to Caylee's remains being found. Tim Miller couldn't have known then that a month later Caylee's remains would be found and found right there in that area that he had described as being still under water and too dangerous to search as they had almost lost an ATV there that day.

Cheney Mason states that there's 15 - 20 people who searched that area and didn't see a body there. The area where Caylee's remains were found was under water on November 9, 2008. These searchers couldn't see the remains due to the water.

Furthermore, before any of the searches, (first search end of August - first week of Sept.) Caylee's body would have been reduced to bones and likely scattered by animals or the elements. If the searchers were looking for a body, they could have walked right past a bone and not have known it was part of what was left of Caylee.

Didn't HHJP say no more hours without a complete accounting of what was done with the previously granted hours?

JB asked for 300 more hours at the hearing Oct 29th. JP gave him 60 additional hours instead for the guilt phase investigative cost.
http://www.ninthcircuit.org/news/Hi...s, Mitigation Specialist, and Other Costs.pdf

I recall JP saying he wanted a complete accounting for something before he gave more money or hours - could it be for the penalty phase investigative or mitigation hours because it doesn't specify in the pdf?
I'd have to go back and watch the hearing and I'd rather stick pins in my eyes.

Exactly. You have someone who is an expert, AN EXPERT at searching and finding missing people and you are going to discount what he says. TM made this statement prior to the remains being found. If these searchers admit NOT seeing any water then it is safe to assume they were not in the exact spot. Personally, I think CM stated that just to get the judge to agree to extra time and money to try and find someone, anyone who will say they were there and no body. jmo

Pretend you are a hard working, tax paying member of the jury and Mr. Miller takes the stand, with his photos, areal photos that detail the exact area under water. You are being passed these 8x 10 photos of the conditions at the time, it is clearly flooded, no question. Now listen to Mr. Miller, a man you may never have heard of, who has devoted his life to searching for missing people after his own daughter was missing and found dead.

Now who are you going to believe?
My money is on Tim Miller, all day long.

"I was in that house for four days and Casey is going around smiling like she is going to a cheerleader competition, playing on her computer, cooking stuff in the kitchen. Never once in those four days did she ever mention the name Caylee", Mr. Miller explained to Craig Rivera.

I totally agree. Tim Miller has absolute credibility as far as I'm concerned. The damage Casey did to his organization was unbelievable, and that's why her two minute laughing spell on monday was particularly vile.

I'd have to go back and watch the hearing and I'd rather stick pins in my eyes.

Judge - I already granted in prev Order dealing with this, when Baez argued Motion, they were given time for mitigation expert - told mit expert would be doing portion of penalty phase investigation for mitigation and that was Jeanene Barrett - 384 hours approved.
I assume they exhausted 384 hours?

Finnell - no they have not - I talked to Barrett - used 1/3 to 1/2 of that
has significant number of hours left
trying to put forth total budget - anticipate maximum amt services
she is addressed in para 4 - asked for addl 4 hours
still a lot of work to do - talk to witnesses - extensive number of mitigation witnesses

Judge - how many witnesses?
how many already talked to?
we went through very detailed hearing - counsel asked for 384 hours - I gave them what they asked for - to get addl hours, you need to show me how 384 hours was utilized, and what you need the other addl hours for, before I will extend the count

Finnell - we can do that with miti expert - need Barrett to make a more detailed accounting to me
asking for services of private inv in para 1 - in addition to mit expert

Judge - in state inv given cap of 300 hours
how much utilized

Baez -comletely exhausted - asked for 300 more
may ask for more later on

Judge - to expend tax payer funds, demonstrate how you used it and particularized need for balance of it - some do under seal - not expose work product to State

Baez - to date our inv has done background inv on witnesses, got public records on issues, 2-day process did Equusearch inspection - all day events - intensive follow up 40 % done with TES - we found addl 150 besides 32 - need to follow up - many do not want to get involved - trying process

Judge - only caution - when you are expending tax payer funds - not allow you to go on fishing expeditions - must be particularized needs - not drilling hoping you found oil when no signs of oil
*************************
JAC - private inv not exceed $ 5,000 - court already entertained
Judge- have to show me how utilized it, one instate for $ 300
need to give me accounting of that - use same in state inv

Baez how many left on in state inv
Baez - no more hours left - depleted - need more hours
not just Equu issue or request - great number of witnesses of State
Judge - as soon as you show me how you used the last- I be here all next week - not have
Finnell not being able to do anything - start her off with 100 hours for penalty phase
Baez - sidebar with actual records

Judge - Baez give you another 60 hours, see what you do with that
when you get close to running out, have a telephonic hearing, notify JAC

Yes! And if a searcher says there was no body were they looking for a complete, intact, body, or were they looking for small bones?

Even by the time of the first search in late August, first week of Sept, Caylee's remains would have been reduced to a skeleton and likely not intact. By the time of the second search, there would be little left for an inexperience searcher to recognize.

I"m not so sure these searchers knew what they were looking for.

ITA! Tim Miller is an honest and honorable man! I'm sure that his testimony will be a highlight of the trial. If the defense tries to attack Tim's veracity or expertise, they'll be shooting themselves in the foot.

I count Tim Miller as a victim too.......not just for the loss of his daughter, but as a victim of a vicious attack by Cindy Anthony.

I was under the impression that HHJP had stated, at a prior hearing, that after phoning searchers (from TES records), and maybe finding some that needed further investigation, that Jose and crew would have to run the names and information past HHJP. Whatever happened to that? We even have a poster here who's hubby got a personal visit from the PI. So was that person run past HHJP, or is Jose et all just doing whatever he wants to do? :furious:

"It doesn't matter how many people walked by here, anyone could have missed it. It happens all the time, in this dense foilage," Mark Furhman said.

The chances of someone not coming forward in low these two years to say they searched that exact area and suddenly be overwhelmed by JL's charm enough to want to step forward now is not even remotely credible. The ADA will make very short order of discrediting Cheney's "key" witnesses once they set them down for the deposition with photos of the area under water.

Cheney is going to have egg on his face, what is new?
Next!

Well let's put our thinking caps on people .... one would think that IF a person saw Caylee's remains PRIOR to Roy discovering them, would not they have come forward to collect the reward money and get to be Caylee's hero instead?

This isn't rocket science here folks. There isn't another honest person around who saw Caylee's tiny bones before Roy did. Nadda, zippo, notta one.

Once defense has telephone numbers they could do background checks on the TES volunteers to see if they have had some problems with LE in the past. It has been proven there WAS water in that area. There are too many people to testify water was there along with the fact that a hurricane had gone through the area. For someone to say they searched that area and did not see a body/remains proves nothing. If they did not see water....they were not in the right area. FISHING for "Flounder" if you ask me. jmo

It really is amazing the nonsense the Anthonys, ICA and Baez and Co. have contrived and expected us to believe. :banghead:

This entire line of investigation doesn't make any logical sense to me. Can anyone explain why it is even being pursued? So what if someone else put her body there? Then what would that mean to the guilt or innocence of Casey being the murderer? She still could have murdered Caylee and had someone else place the body there. It does not speak to her innocence in the least. The very most it would suggest was that she had an accomplice.

To prove my point from the opposite perspective: If Casey had been caught red-handed disposing of Caylee you know the defense would argue that it didn't mean Casey killed her. They would say it only proves that she was forced to try to hide the body.

So please can anyone tell me why we, in Florida, are forced to spend so much time, effort and tax money on trying to prove or disprove a fact that would mean little or nothing anyway? Is it that there are so many proverbial trees in the way that we can't see the forrest . . . or is it just that the defense team takes great pleasure in harassing and demoralizing innocents?

Quote Chaney: "Well, if we’re able to establish a reasonable doubt, as to when the body got put there, and it comes at a time when Casey couldn’t have done it, we know conclusively somebody else had to do it. If we know somebody else put the body there, it’s a question of who and how and when. That’s all we’re pursuing. We don’t know. I wasn’t there. You weren’t there."

http://www.thehinkymeter.com/2010/0...em-and-a-review-of-the-water-analysis-report/

All the "ifs" in the world re the water level, the timing, the person and placement of the body still does not give any weight as to who actually murdered Caylee. moo

And to further illustrate the futility of this all. They are spending taxpayer money to investigate and accuse almost random private citizens of being involved in a crime that occured well before those citizens had ever even heard the name of the victim. (and make no bones about it, these investigations are a form of attempting to shift blame). The citizens came out as part of a plea to help find the victim months after the crime ocurred.

And even creepier with this approach. They are investigating whether someone else could have put the body there after KC was arrested. Ummm THERE IS VIDEO FOOTAGE OF HER HIRELING AND ACCOMPLICE WANDERING AROUN THE AREA OF THE REMAINS WELL BEFORE THE BODY WAS DISCOVERED!!!. Even if the area wasn't under water. Even if there was a remote possibility that the body was placed there after she was arrested... IT STILL LEADS DIRECTLY BACK TO HER!!!

Well, hummmm, Faefrost, there was that little matter with DC and his little pokey stick. Funny how JB just never seems to talk about that???? jmo
