Defense attorney Jose Baez has filed a second motion to ask a judge to prevent prosecutors from releasing audio of him speaking on the phone to another inmate named Robin Lunceford.

Baez told Judge Belvin Perry on Friday that an inmate provided him information about more potential witnesses and he wants time to investigate that information. Until he has a chance to do that, Baez is asking that the recorded call be sealed.

Meanwhile, the tape is in possession of Perry -- he is deciding whether or not to have a hearing on the issue.

Anthony attorney Jose Baez has filed a second motion to block the release of a phone conversation he had with a state prison inmate. Prosecutors had planned to release the call. Judge Belvin Perry has a copy of the call between Baez and inmate Robin Lunceford, who alleges that two inmates created false information about Anthony.

WESH-Ch. 2&#8217;s Bob Kealing explained that Baez &#8220;in this motion, tells Judge Belvin Perry that this inmate provided him information about more potential witnesses. And he wants time to check out what she has to say.&#8221; Perry is deciding whether to have a hearing on the call issue and has asked the prosecution to respond, Kealing added.

WESH also looked at costs in the Anthony case. &#8220;State records show tax dollars have started flowing for Casey&#8217;s defense,&#8221; Kealing reported. The total from March to June was $3,564. The Justice Administrative Commission rejected a Baez invoice for $490 for a court reporter. Baez would be responsible for any bill that the JAC doesn&#8217;t cover, said attorney Richard Hornsby, who offers analysis for WESH.

A motion filed Friday shows Casey&#8217;s attorneys are even backing off claims that EquuSearch volunteers searched the area where Caylee was found months earlier.

The defense demanded to see all EquuSearch&#8217;s records, even though the judge already gave Casey&#8217;s lawyers permission, they just never did it.

But Kealing noted that the settlement hadn&#8217;t been filed in court, and the attorney who handled the foreclosure case &#8212; free of charge &#8212; wasn&#8217;t commenting.

&#8220;Saving the home that Caylee grew up in is probably the best piece of news they&#8217;ve had in well over two years,&#8221; Conway told Kealing.

Well, Caylee didn&#8217;t get to grow up there. She was 2 when she lost her life.

"I had to take all of my copyrighted photos down from my FB," attorney Jose Baez wrote on his Facebook page, "because it has come to my attention that certain bloggers were taking these photos without authorization and posting them on their websites."

Casey Anthony&#8217;s defense team was very polite during a two and a half deposition, Kronk told WESH-Ch. 2&#8217;s Bob Kealing. Kronk is the former meter reader who found Caylee Anthony&#8217;s remains.

Kronk said he would do it all over again. &#8221;Doing the right thing is its own reward,&#8221; Kronk told reporters.

Kealing noted that Anthony&#8217;s defense team &#8220;slipped away without answering more questions about how today&#8217;s deposition went.&#8221; Casey Anthony is charged with first-degree murder in the death of her daughter, Caylee. WOFL-Ch. 35&#8217;s Holly Bristow said the defense had not returned her calls for comment on the deposition.

Before the deposition, Anthony defense attorney Cheney Mason said the team was &#8220;focusing on establishing reasonable doubt for various aspects of the case.&#8221;

Prosecutors in the Casey Anthony murder case claim her lead attorney, Jose Baez, made untrue statements in court paperwork, and they accuse him of having a "faulty recollection."

Baez in May received a telephone call from prison inmate Robin Lunceford, who claimed to have information helpful to Anthony's defense.

In court papers, Baez said that he was unaware that Lunceford was calling from a prison and didn't know that their conversation was being recorded.

According to prosecutors, however, audio of the conversation proves that the prison and Lunceford repeatedly informed him that the call was being recorded.

Prosecutor Linda Drane Burdick said the state essentially doesn't care if the call is made public, but she blasts Baez&#8217;s legal reasoning to keep it private.

In the state's response, Burdick writes &#8220;that Mr. Baez was &#8216;never made aware that the call was being recorded' is simply untrue.&#8221;

Burdick indicated she has heard the tape, even though defense lawyers haven't.

She claims Baez did in fact hear a taped recording at the beginning of his phone call with Lunceford that warns "this call is subject to recording and monitoring."

Burdick writes that Lunceford "advised Baez she is not telling him everything she knows because these phones are recorded."

Criticism For Casey&#8217;s Attorney Over Jail Call

Baez wants the recording of that phone call kept secret; he says he didn't know he was being recorded. But when prison inmates make calls, they start with a message that the call is being recorded and prosecutors say he had to have heard it, because he followed its instruction to press "1" on his phone to accept inmate Robin Lunceford's call. A month and a half later, Baez denied it. After prosecutors called him on it, he filed new paperwork claiming he doesn't remember.

Baez is now being called into question for the same kinds of inconsistencies his client, accused child murderer Casey Anthony, has been caught in. Baez told Chief Judge Belvin Perry he didn't know he was being recorded when Lunceford called him, so he said it was illegal and asked the judge to seal it. But prosecutors say Baez not only heard the prison's warning that he was being recorded, he was told again by Lunceford during their phone call, and he was expecting her collect call from Lowell Correctional Institution, according to his assistant.

&#8220;At worst, it's an intentional misrepresentation to the court. At best, it's a faulty memory,&#8221; WFTV legal analyst Bill Sheaffer said Tuesday. &#8220;He has damaged his credibility with Judge Perry in either event.&#8221; Baez's claim of faulty memory came after prosecutors told him they had heard the call and heard the warning he got before taking the call. In court at a previous hearing, Baez actually joked that, by asking to seal what he argued is an illegal recording, he was protecting the prosecutor from getting arrested for listening to it.


NEW IN THE CASE AGAINST CASEY
The defense has re-scheduled its depositions of prosecution experts at the Oak Ridge Laboratory in Tennessee. The prosecution experts have tested air from the trunk of Casey's car. They say the results show chemical evidence of human decomposition. This would be the first case ever to use this type of testing, but Casey's defense team maintains there is no proof the tests are accurate.

The financial fallout from the case against Casey Anthony could cost lead defense attorney Jose Baez his home.

Foreclosure documents indicated Baez owes more than $650,000 to creditors. Baez said he blames his foreclosure on the real estate downturn.

Baez purchased his lakefront home three years ago for $670,000. On Wednesday, he admitted it's only worth about half of that amount.

In a foreclosure complaint, Baez's creditor, U.S. Bank, claimed, "the installment, which became due on the note and mortgage on Sept. 1, 2009, and each payment thereafter have not been paid."

Casey Anthony's parents saved their home from foreclosure Wednesday and it only took them a few months to obtain the same loan modification that other homeowners have pursued for years. The Anthonys&#8217; attorney said he thinks it&#8217;s because both parties wanted to keep the case out of court; if it went to court, it would have created a media frenzy.

For the past couple of months, people who live near the Anthony family thought their neighbors were going to move, but last month a new deal was made and now the Anthonys are going to be able to keep their home. Bank of America modified their loan. &#8220;This foreclosure was one of the fastest ones I handled,&#8221; Attorney Mark Lippman told WFTV. Lippman, who represents the Anthonys, said it only took four months to settle the issue. They qualified for the federal program called Making Homes Affordable.

Bank of America started the foreclosure process in February. Documents show the Anthonys bought the home for almost $91,000 in 1991, but now owe more than $115,000. Cindy is on disability and George lost his job. Lipton would not tell WFTV the amount of the new mortgage payment, but said it is 31 percent of their anticipated income.


BAEZ WANTS PARTS OF JAIL CALLS REDACTED
Casey&#8217;s lawyer, Jose Baez, is trying to get portions redacted from some recorded jail phone calls. An inmate told Baez that two other inmates, including Casey&#8217;s jail pen-pal, made up lies about her. But Baez says he can't remember being warned that their conversation was recorded. He's expected to ask a judge to at least edit out his comments before releasing the calls.

CASEY'S EX-FIANCE, KRONK TO BE QUESTIONED
Friday, Casey's ex-fiance Jesse Grund and his father will be questioned by defense lawyers. A paternity test proved Caylee was not Grund's child, but at one point Casey allegedly told her parents she didn't trust Grund and her parents asked detectives to investigate him as a suspect.

Also, Roy Kronk, the former meter reader who found Caylee's remains, will return for more questions. Kronk was also once talked about as a suspect.

WESH&#8217;s Bob Kealing reported that Baez is in danger of losing his Kissimmee home and that a foreclosure document shows that he owes $655,000. Creditor U.S. Bank claims Baez hasn&#8217;t paid the mortgage since Sept. 1, 2009, Kealing reported &#8212; a startling detail.

Baez said the foreclosure won&#8217;t affect his representation of Anthony, Kealing said.

Casey Anthony Meets With Psychologist

A psychologist who specializes in traumatic events has been visiting Anthony in the Orange County Jail.

Defense attorney Jose Baez said attorneys must explore potential mental health issues in any death penalty case. Other than members of her defense team, Anthony has had few outside visitors since she was put back in jail for the final time in October 2008, but earlier this week Anthony met with Dr. Steven Gold.

Gold is a psychologist with Nova Southeastern University in Fort Lauderdale. "Dr. Gold specializes in research, treatment of and training in psychological trauma and trauma-related disorders, disassociation, hypnosis and sexual addiction-compulsivity," Gold's website said.

Gold has written books about child abuse as well as the trauma endured by survivors of the Sept. 11 attacks.

The Osceola County home of Casey Anthony attorney Jose Baez is in foreclosure proceedings in court, the now well-known defense attorney confirmed this afternoon.

Osceola County Clerk of Courts online records also confirmed the foreclosure case, listing it as a foreclosure involving $250,001 or more. The foreclosure complaint was filed May 12, according to the online records.

When asked about the foreclosure case, Baez said, "I think it's personal."

"It has nothing to do with my case, my business and anything that has to do with Casey Anthony," he said. "I'll probably keep the house, even though it's worth half of what I owe."

Casey Anthony's jail account no longer in the negative

It appears Casey Anthony's jail account is back in the black, as her mother deposited $140 on Wednesday.

A money order dated Tuesday has replenished her account, which dipped into red ink recently. A copy of the $140 money order released Wednesday shows it was purchased by Anthony's mother, Cindy Anthony.

Orange County Jail spokesman Allen Moore said in an email that Casey Anthony's account balance Wednesday was $94.49.

Jose Baez May Lose $670K Kissimmee Home

The case against Casey Anthony could be taking a financial toll on her lead defense attorney, Jose Baez. Court records show Jose Baez's house, which he bought for $670,000, is in foreclosure. His top client, Casey Anthony, hasn't been able to pay him in months, but taxpayers are funding Casey's defense.

Baez and his wife live less than one mile inside the gates of Kissimmee Bay, which is a country club community in Osceola County. It's a private community and it's close to his office, but now he could lose it.

Defense attorney Jose Baez borrowed $603,000 three years ago, to buy the $670,000 house. The home has a screened-in pool and a fireplace. His monthly mortgage payment is $4,500. The problem is court records show he hasn't made a payment for about one year, since August 2009. But that didn't stop him from skipping his client Casey Anthony's hearing on June 21 because of his vacation in Paris, according to his co-counsel.

Even though the ABC Network paid Casey more than $200,000 for all of her photos and videos of Caylee, Baez said the fee he was paid for handling her check fraud and murder cases was less than $90,000.


CASEY VISITED BY DOCTOR
Casey's had few outside visitors besides her defense team, until last Friday. Dr. Steven Gold specializes in psychological trauma, dissociation, hypnosis and sex addiction at Nova University in Fort Lauderdale. He met with Casey for nearly four hours.

Jail records show Casey bought medication three times since mid-May and visited with the nurse twice. Her jail account is no longer overdrawn, thanks to a $140 check her parents deposited Wednesday.

An attorney for former meter reader Roy Kronk said his client is ready to testify Friday under oath and take questions from Anthony's defense team.

After Kronk's first session, Anthony&#8217;s defense filed paperwork suggesting the man who found Caylee's Anthony's remains should have been investigated as a suspect.

An Orlando criminal defense attorney said Friday is the day Anthony&#8217;s defense team can solidify their theory that Kronk is someone they could point the finger at in Casey's trial.

&#8220;Either he's the guy, or he's not the guy,&#8221; criminal defense attorney Richard Hornsby said.

Kronk&#8217;s attorney, David Evans, said he is anxious for his client to get it done. Evans said Kronk is still living in Orange County, but he has not been working, and has stopped volunteering with dishonorably discharged veterans. Legal experts said they doubt Baez would even be allowed to withdraw from the case.

An amendment went into effect this month in Florida that bans judges from appointing attorneys where an indigent client has already retained and paid a lawyer. Experts said the idea is to prevent a private attorney from pulling out once a client&#8217;s money runs out.

WESH-Ch. 2 headlined its Baez story &#8220;Foreclosure Fallout,&#8221; a follow-up on the station&#8217;s Wednesday report about Baez facing foreclosure on his Kissimmee home.

But the main point of Bob Kealing&#8217;s reporting tonight was that Baez can&#8217;t withdraw as the attorney for Casey Anthony. She is charged with first-degree murder in the death of her daughter, Caylee. &#8220;I would be shocked if Judge [Belvin] Perry let anybody withdraw now,&#8221; criminal defense attorney Jeff Deen said in offering analysis for WESH.

Kealing and Deen pointed to new law passed in reaction to the Anthony case. The law aims to prevent a private attorney from leaving a case when a client becomes indigent.

Deen explained: &#8220;If you start out with a private lawyer and you pay that lawyer, and then you go to the court and ask that the state pay your costs, if that lawyer now tries to withdraw, it&#8217;s not permitted by statute anymore that the person would get a state-appointed lawyer.&#8221; The law went into effect July 1, meaning that Baez&#8217;s window for getting out had closed. Kealing said that Baez had not responded to requests for comment.
