If someone is facing a charge of murder (as opposed to manslaughter), under Australian Law, intention to murder must be proven for a successful conviction to occur.Full intention to kill, intention to cause grievous bodily harm, reckless indifference to human life, or (for manslaughter) severe negligence.

There's certainly a great deal of suspicion and speculation, but that doesn't equate to proof of untent.
