Sydney student Jamie Gao boasted of 'massive' ice deal before his alleged murder

The trial of former NSW detectives Glen McNamara and Roger Rogerson has heard alleged murder victim Jamie Gao had boasted of a “massive” impending drug deal to family and friends.
The body of UTS student Gao, 20, was found floating off Cronulla in May of last year.
On the opening day of the accused’s trial, Crown prosecutor Chris Maxwell told the jury they had participated in a joint criminal enterprise to murder Mr Gao.

Mr Maxwell said the Crown could not prove which of the two accused pulled the trigger but that it did not matter because both men were centrally involved in the joint criminal enterprise to commit the crime.

He said that if the jury was not satisfied that Mr Rogerson was guilty of murder they could find him guilty of accessory after the fact to murder because of his alleged involvement in the disposal of the body.

This is confusing, if they both plotted to kill Gao, isn't it a murder charge, does it matter who pulled the trigger? Why should Rogerson be found guilty of a lesser charge? :mad:

Rogerson deserves to live out the rest of his life behind bars! JMO


Watched 'The Seven Five' recently. Imo, Rogerson is the Oz equivalent to Michael Dowd. :aktion1:
 
Roger Rogerson shot Jamie Gao 'in cold blood', co-accused alleges

Roger Rogerson allegedly shot drug dealer Jamie Gao “in cold blood” before threatening his co-accused Glen McNamara, a Sydney court has heard.
Mr McNamara’s barrister made the claims in his opening address, alleging his client saw Mr Rogerson pull out a gun and then shoot 20-year-old Gao inside a Sydney storage shed.

He said McNamara was a man of good character, with no criminal convictions, who had left the police force honourably.
"Unlike Rogerson who we will be suggesting was sacked."

"What is abundantly clear is that Mr Gao was shot dead behind the closed doors at a point in time during that 30 minutes," Mr Maxwell said.

"It's clear, you might think, that Jamie Gao was shot by one of the accused. It will become apparent that the prosecution cannot establish which accused was the shooter. But it doesn't have to prove which one was the killer."

He said that this was because Mr Rogerson and Mr McNamara were part of a joint criminal enterprise to murder Mr Gao and then steal the 2.78kg of methyl amphetamine he had brought to sell to them.

After the murder, police allegedly found the drugs in Mr McNamara's car wrapped in two brown pillow cases.

Both Mr Rogerson and Mr McNamara have been charged with commercial drug supply in addition to murder.

Mr Rogerson is charged in the alternative of accessory to murder.
Both accused have pleaded not guilty to all charges against them.

Rogerson and McNamara blame each other for Jamie Gao's death

Mr McNamara's barrister Kara Shead told the jury on Tuesday: "Roger Rogerson shot and killed Jamie Gao".

"He then threatened Mr McNamara's life."

Ms Shead said Mr McNamara, 56, was "terrified" and agreed to help Mr Rogerson dispose of Mr Gao's body.

Mr Thomas said Mr Rogerson, 76, opened the shed door and saw Mr Gao "dead on the floor with a handgun lying near him".
"He says Mr McNamara appeared to be shocked and said a gun had been pointed at him by Jamie Gao and he was threatened.
"A struggle occurred and Jamie Gao was shot twice.

She said Mr Gao was a member of an Asian triad and Mr McNamara met him several times as he conducted research for his upcoming book on Asian gangs and drug dealing in Sydney.
Ms Shead said Mr Gao had become increasingly worried because he had skimmed money off the top of some drug deals and was also a police informant. He was concerned the triads were after him.
Mr McNamara was unaware of any alleged drug deal between Mr Rogerson and Mr Gao and did not know Mr Rogerson was in possession of a handgun until the shooting, Ms Shead said.
Mr Rogerson also denies any knowledge of a drug deal, Mr Thomas said.
He said Mr Rogerson went to Rent-A-Space that afternoon at Mr McNamara's request because Mr McNamara was also concerned about the triads and wanted Mr Rogerson to watch out for him.

Earlier on Tuesday, Crown Prosecutor Christopher Maxwell QC said the prosecution couldn't prove which of the accused fired the .22 calibre handgun, fatally wounding Mr Gao. But he said even if it was Mr McNamara during those three minutes Mr Rogerson was outside the shed, the latter is also guilty of murder.

He said that this was because Mr Rogerson and Mr McNamara were part of a joint criminal enterprise to murder Mr Gao and then steal the 2.78kg of methylamphetamine he had brought to sell to them.

"These two men were engaged in a joint criminal enterprise to kill or at least cause grievous bodily harm to Jamie Gao".

The first witness to take the stand was Mr Gao's cousin and close friend Justin Gao.

He said he had no knowledge of Mr Gao having a history as a drug dealer: "He always made it clear to me that he would never stoop to that and he was better than that".

CCTV played in Rogerson trial allegedly shows final moments of Jamie Gao's life

On the opening day of the high-profile trial, crown prosecutor Chris Maxwell QC told the jury CCTV cameras had captured Mr Gao heading inside the Padstow storage shed with Mr McNamara at 1.46pm on May 20, followed close behind by Mr Rogerson.

Just over half an hour later the two older men drag out a silver surfboard cover, in which they had allegedly hidden Mr Gao's body, the court heard.
The footage then allegedly shows them loading it into the boot of a parked station wagon.

Footage played to the jury then showed the pair making a visit to Kennards Self Storage to buy a two-tonne chain block and returning to McNamara’s apartment. At 6.24pm, there is an image of Rogerson and McNamara stepping into the lift of the Cronulla apartment block with a six pack of beer.
Vision from 7am next morning was then shown, with McNamara and Rogerson seen getting in and out of the lift. The white Falcon is captured leaving the carpark. An object in blue tarpaulin is visible in the boat towed behind.
It is alleged that shortly after this, the body of Gao was unceremoniously dumped at sea, 2.5km off Shelly Beach in Cronulla.

ROGER Rogerson remarked to Glen McNamara in the aftermath of Jamie Gao’s murder that he had “such nice daughters, really lovely, lovely girls” while “tapping” a dark coloured lump in his pockets, McNamara’s daughter told a jury yesterday.
Jessica McNamara, 25, told the Supreme Court jury that her father “turned pale” when Rogerson made the comments about her and her younger sister Lucy at the kitchen table of the McNamara family’s Cronulla apartment, in Sydney’s south, on May 20, 2014.

McNamara will allege to the jury in his evidence that Rogerson shot Gao and then turned the gun on him, threatening his life and the safety of his daughters if he did not co-operate with him.

Jamie Gao possibly died sitting down and wearing a latex glove, court hears

When they unzipped the silver Ocean & Earth surfboard bag Jamie Gao was hidden in, he was wearing a watch and a clear, latex glove on his right hand.

Police allegedly found the drugs in Mr McNamara's car wrapped in two brown pillow cases.
Mr Rogerson and Mr McNamara have been charged with commercial drug supply in addition to murder.

University student Jamie Gao had been missing for four days when police discovered two brown pillow cases and a green backpack under the seats of a white, Ford station wagon.
The car was parked in the basement of a Cronulla apartment block – where former policeman Glen McNamara was living.

Altogether the crystal-like substance weighed 2.78 kilograms and was later confirmed to be the drug known as ice.

A former solicitor for accused murderer Roger Rogerson, threatened the daughter of his client's co-accused, Glen McNamara, the NSW Supreme court has heard. On her third day in the witness box, Jessica McNamara described a visit by Rogerson's then solicitor Paul Kenny, to her Cronulla home. During the visit Ms McNamara said Mr Kenny said to her "it's not the triads you need to be afraid of, it's Roger". Ms McNamara told the court Mr Kenny said to her "he knows where you live".

Glen McNamara told daughter Jamie Gao had been 'trying to do something terrible to me'

In one of the calls, made on November 5, 2014, McNamara said: "I'm certainly sorry that ... he's deceased but I had nothing to do with it.

Imo, Rogerson and McNamara are prolific liars. I think they planned the killing of Gao, and it was Rogerson who pulled the trigger.
As the trial moves on it's obvious these two men have loyalty to no one but themselves, they're quick to point fingers and deny any responsibility, what planet do they live on?! How much they've gotten away with over the years is anyone's guess. Can greed, arrogance and a total disrespect for the law begin in old age, I don't think so.
First McNamara said Rogerson threatened him with the gun after killing Gao, now he's saying Gao was going to do something terrible to him, so wouldn't that mean Rogerson saved his life? Oh for pete's sake, what a farce.
 
What weapon did Jamie Gao have that could have harmed McNamara?

I agree that Rogerson probably owned and fired the gun and they agreed that McNamara would do the rest.
