9/20/22 Tuesday, Trial Day 5: State witnesses: Forensic DNA Analyst Alicia Cadenas. Rolando Roman who testified he’s never met Clements. Yet somehow photos of his young children had ended up in a secret file on Clements’ computer. Det. Miguel Flores, the lead investigator in the case recalled.

9/22/22 Thursday, Trial Day 7: On Thursday, the day got started with Judge James Marner formally excusing juror 9. Judge Marner said the juror was feeling “under the weather,” but was not displaying symptoms of COVID-19. That leaves 8 women & 7 men, including 3 alternates.
State witnesses: Adriana Nunez, a Tucson mother whose daughter (5 yrs old) was potentially photographed by Clements in 2013. Corina Rivera, who said she dated Clements in 2012. Vanessa Gregory was one of the children (10 yrs old at the time) who appeared in photos found on one of Clements’ devices. Detective Josh Cheek with the Tucson Police Dept. (TPD). Det. Cheek said he investigated some of the images derived from Clements’ computers.
State rested their case.
After the jury was dismissed on Thursday, the defense filed a motion to have Clements acquitted on the kidnapping and first-degree murder charges. When considering the motion, Judge Marner said he must weigh the evidence in which a reasonable person can conclude the defendant is guilty beyond a reasonable doubt. Judge Marner sided with the State & denied the motion of acquittal.
Friday morning, the defense will call its first witness Dr. Rebecca Hsu to the stand.

Day 6 -

Wednesday morning, the state called its 16th witness to the stand. Marie Yocum is a latent print examiner for Pima County Sheriff’s Department (PCSD). Yocum estimates she has compared over 1,600 fingerprint impressions during her employment with the PCSD.

The 17th witness for the state was a retired digital forensic examiner. Russell Blaylock said he searched Clements’ iPad, MacBook and iPhone while working for the Tucson Police Department (TPD).

FBI Special Agent Patrick Cullen, who was the state’s 18th witness, also searched Clements’ electronic devices.

Two mothers also took the stand on Wednesday, bringing the state’s witness count to 20.

The two women testified they were notified by law enforcement that Clements had photos of their children on his computer. One mother said she had never met Clements before, and claimed her daughter was 5 years old when the photos were taken of her outside of an apartment.

The other mother said she went on a date with Clements once, and said he must have taken a photo of her and her son from her Facebook page as she did not send it to him.

The trial will resume Tuesday, 9/27/22 & the defense will call at least two more witnesses -- DNA analyst Mike Spence & cell phone/mapping expert Karl Epps. After that, closing arguments will begin & the jury will begin deliberations.

TUCSON, Ariz. (KOLD News 13) - The trial of accused Tucson child killer 40-year-old Christopher Clements continued Tuesday, Sept. 27, with the defense calling its final two expert witnesses.

The defense rested its case around 3:30 p.m.

On Tuesday, the defense called its final two witnesses.

Dr. Michael Spence is an independent forensic DNA consultant who was hired by the defense to look over the reports from DNA Labs International. That’s where samples from Maribel Gonzalez’ body were sent in 2014.

The defense then called on Karl Epps, a digital forensic examiner in Arizona.

Epps said he was asked by the defense to analyze cell tower information from Clements’ phone. He was emailed the AT&T call detail records, Epps said.

During a jury break, Judge James Marner asked Christopher Clements if he wanted to testify.

“You have the absolute right to testify, and you have the absolute right not to testify,” said Judge Marner. “You would be subject to cross examination. You can’t just come and answer questions from your own side. If you choose not to testify, the jury cannot prejudice you in any way. Counsel, what does your client want to do?”

“Not testify, your Honor,” said defense attorney Joseph DiRoberto.

Once the defense rested, the state called a rebuttal witness back to the stand.

Sy Ray, the director of LexisNexis and creator of ZetX, said Clements’ phone was located west of the I-10 between 12:30 a.m. and 2:30 a.m. on June 4. He testified it is possible Clements’ phone was located at Maribel’s recovery site.

The state’s plans to call another witness for a rebuttal on Wednesday, Sept. 28. Detective Miguel Flores is expected to take the stand again.

The state and defense should move into closing arguments Wednesday afternoon.

After a lunch break, the case resumed with closing arguments. The jury was then handed the case and deliberations began late Wednesday afternoon. The jury did not come back with a verdict, so deliberations will continue Thursday, 9/29/22.

During closing arguments, prosecutor Tracy Miller brought up a photo of Maribel to show the courtroom.
