There is some kind of small charge for something like 'assisting a murderer' or 'hiding a suspect' or something that doesn't get mentioned too often. It carries a 9-month sentence, and I suspect that the plan has always been to let TS take the fall and, if necessary, let HM take the fall for the small charge - just for appearances, of course.

IIUC, the sentencing ranges aren't fixed, which is why Soenardi got a major drug smuggler off with 6 years. Even if HM gets hit with the entire 9-month sentence, she's shown she can handle that with no problem. She and her cellmate-friends will party on her mother's money for a few months and back to the US she goes.

Wonder where TS got the new shades? I think he looks worse every time we see him. I'm not so sure HM isn't over him - it's hard to tell. I think he's got a sinking feeling she's going to leave him high and dry - he's looking across from his cell to hers, and she's playing to the photographers and giggling with her 'squad' - oh, and occasionally throwing him a bone by mouthing 'I love you'.

He's in his own kind of hell now. She 'fell' for a bad-*advertiser censored* wannabe; I don't think she's got a lot of use for a cry-baby. I hope his mother is really giving him an earful about expecting HM to stick by him.

Did anyone catch the part where she told him they can talk on the phone now "about anything"??? No more texting that might come back to haunt them? Is she really trying to comfort him or is she just trying to keep him from turning on her?

The Global Organization of Parliamentarians Against Corruption
(GOPAC) is proud to announce that Indonesia will host the sixth Global Conference of
Parliamentarians Against Corruption, in Jakarta, Indonesia in 2015.

“Corruption is a blight on governments, economies and societies the world over and the only
way to combat it is through a strong global collective,” said Ricardo Garcia Cervantes, Chair
of GOPAC. “With the support of Indonesia’s House of Representatives and GOPAC
Indonesia, our sixth Global Conference will nurture the collective and bring together the
leaders needed to further strengthen the fight against corruption.”

Well, good luck with that

I'm surprised and I shouldn't have been.

Somewhere buried in all our links, I read that the bribes actually get split between Soenardi, the prosecution and the judges. I got the impression that the bulk of the money goes to them - as it should, I guess, since they have more power than the attorney. I had the impression that the attorney becomes little more than a procurer and a go-between for the client and the prosecution/judges.

Hardly surprising, then, that almost immediately there's a technical flaw in the prosecution's paperwork, an obvious one that led to confusion and discussion on this forum - but somehow that little flaw, the room number, didn't get corrected on the paperwork finally submitted. Accident? Or the prosecution getting sloppy because they're no longer actually trying to convict HM?

I hope I'm wrong, but it wouldn't surprise me if we start seeing bulletproof evidence disappearing or being thrown out because of mishandling (real or 'purchased).

I guess I just didn't expect the fix to be so blatant and above-board.

My Bolds (1) - Yes, I posted a link - ironic that I was googling Ary B Soenardi at the time, too. Lubbe did not pay out, so got 15 years.
http://www.news.com.au/world/bali-p...indonesian-jails/story-fndir2ev-1227014030151
Lubbe — who’s directed his letter to Indonesian President-elect Joko Widodo or Jokowi — claims the money in his meth case was to be split between the judge and the prosecutor.Lubbe’s lawyer, Ary B Soenardi — the same man who represented Sydney resident Leeza Ormsby on drugs charges — and fellow lawyer Iswahyudi denied they had suggested he pay a bribe.

(2) I think that technical flaw was already in place deliberately - it assume (JMO) that there was never going to be a 'new' lawyer nor was there going to be a delay until one was found.
Any instruction by Judge Cohen now, after the fact, seems more like a weak attempt to avoid the inevitable - that Soenardi was not going anywhere - and to add, it sounds as if Soenardi made sure that the statement supposedly released by HM refusing another Lawyer made it very clear that a change of legals was way too late - he would not be removed at this stage.

Once the money was approved from the US Courts - it was game on (JMO) - though it is $150k less than first submitted for - I wonder what would have happened if it had been approved - I wonder if the goal posts have been moved, or that the additional $150k will somehow be approved later on.

I also agree that HM is not acting as if there will be any repercussions - there is no grief, and if all goes to plan by Ary B Soenardi direction, HM will Shut Up, be remorseful of any involvement, she will stick to her story, and she will polite and respectful - its how it works so as she will be given a very lenient sentence - if any.
Tommy on the other hand I cant see getting less than 15 years.

HM's recent day out reminds me of this article - very interestiing:
Read more: http://www.dailymail.co.uk/news/art...t-execute-say-Balis-Mr-Big.html#ixzz3PUMDoUOc
They won't execute me, says Bali's Mr Big, as the British granny at the centre of 'his' £1.6m drug plot is sentenced to death... so why is he so curiously relaxed?
Brash Londoner saunters round notorious jail seemingly unworried.

(3) I hope too that there are no more 'mistakes' made.
I think they are trying to get it thrown out instead of it going to sentence - where whatever punishment will be given to the pair will be scrutinized - to get this case out of the Courts as quick as possible and to put the blame on a technicality washes a lot of blood from many hands if corruption is involved.
As it is the Media has been slow to cover this story to its full potential.
Maybe a little more investigative journalism wouldn't do any harm, if its the truth that needs to be found in this case, and for Sheila as well.

And interestingly enough, HM has stated that she would like to live in Bali after all this is over? I hope there is some mechanism in place right now that HM can be kept in custody, arrested and deported back to the US immediately to face charges that she has at home - otherwise (I think) she will not go back at all, and I also think she wont stay in Bali either. She is saying that to reduce her sentence. I doubt she gives one tuppence about Bali - she is way too selfish.

Source - Read more...“I hope that she will grow up in Indonesia. I want to stay in Bali after this case. Because I love Bali. Bali is nice. The people are nice.”

On a positive note, maybe this is all being allowed to go ahead to expose this case.
Even a political angle isn't out of the question.
Bali needs to shine on their clearing up of corruption - maybe this is the case that will highlight what Bali is facing.
...or am I just dreaming.
Gotta look good for that World Anti Corruption Conference

Oh no, I don't like this. I expected Heather to buy her way to innocence, but now even Tommy might not be facing the serious charges because of room number typos or whatever. Everyone looks way too happy and relaxed this week.

As ajaylee said, "I hope I'm wrong, but it wouldn't surprise me if we start seeing bulletproof evidence disappearing or being thrown out because of mishandling (real or 'purchased)."

Keeping hope alive that IF they are released ...... there will be enough evidence to charge them from their home country's LE......moo

From the daily mail article:

"Now that they have been formally charged during a brief appearance last week it is understood they have been allowed to make brief contact with one another by phone. Among the mouthed messages she made to her boyfriend she could be distinctly seen saying: 'Call me - we can talk about anything'

They can just call each other whenever???!!!!

You know, I noticed this and even commented on it in an earlier post, but for some reason, reading your post, it hit me a completely different way!!

I thought HM's reference to talking about 'anything' was a sly reminder to be careful not to text anything.

Now I wonder. Where did these phones come from? Or has someone like Soenardi told her these phones are safe - but they aren't. She would buy that - if Soenardi told her conversations could be tapped, but not if she uses the phones he gives her. She'd be thinking how clever she was to find such a savvy lawyer. If Soenardi could get HM on tape incriminating herself, she'd be in a very bad situation. She couldn't exactly call the cops.

.

Wirani and Iswahyudi Edy, who represented Schaefer, also objected to the citing of communications between the defendants on cellphones as evidence of premeditated murder.

According to the indictment, in their conversations and text messages on Aug. 12, Mack and Schaefer discussed plans to kill von Wiese-Mack and set it up to look like a suicide.

Phone communications "are prone to manipulation, given sophisticated information technology," Wirani said.

I guess that we will see next week if these people are being bribed to not even get the case to court - and if the judge is in on it.

"Presiding Judge Made Suweda postponed the trial for one week to give prosecutors a chance to prepare their response."

"The presiding judge has given the prosecution a week to amend the relevant documents."

New to Websleuths but I've been following this case... and wow! I cannot believe this is real life. It's pretty evident HM will be getting off lightly, but it sounds like they think they can get him off as well. Could that really happen? Also, I wonder why he's not wearing his engagement string? It seems that while it's more pivotal for HM, surely TS would wear his too to keep up appearances for her sake, especially since the judge and prosecutors are the same in both cases. I wonder if he's trying to distance himself?

Well, the ring was there last week, as we can see in this pic. And it is gone this week. Maybe his mum is getting through to him.
Maybe he and HM are having a few string-ring-marriage problems.

Welcome whatthewhaat :welcome:

I can't believe this is real life either. You hear so many horror stories about prisons in third world countries and it all starts to look like club med compared to what we've been led to believe. And as always, money talks in those countries. We can expect that but what I didn't expect was the decision by the US judge to release funds to HM against the better judgement of the trustee that the murdered victim put in charge of that trust for the next 12 years. :notgood:

Engagement string...good one :floorlaugh:

Maybe he's been getting flack on the men's side of the prison for having an engagement string? Or maybe it was stolen? :giggle:

Looking forward to hearing your thoughts on things as this moves forward. :)

Maybe he is realizing she is cray cray and maybe he doesnt want live happily ever after with her!

I just had a bad feeling that he is going to kill himself.

I've had that feeling a couple of times too. He looks like he is cracking. Lots of tears. While Ms Swagger just keeps on swaggering.
Maybe his mum will stick around and give him something to cling to. She is probably telling him the news from back home, and trying to get him to be forthcoming with the judiciary. I hope he goes to trial first.

I wonder if its like with this set up she is intimidating him. Rubbing her belly and eyeing him up in the other cell and telling him to call her.
