Cohen's concern in Chancery Trial is not about the baby, it is strictly a trust fund release issue. He is not in a Guardianship court case. $ only. Baby Stella case will probably be in Bali as well, unless Guardianship is filed in Bali (hence Favia) I am thinking. In short, you can not blame Cohen outside of his jurisdiction.

Yes, but you know, reading your and Kamille's post made me think about this again.

If HM wants money for 'X', she asks the trustee. 'X' could be a new car, TS's defense, toys for Stella. It's still HM's money legally. The trustee won't necessarily give it to her, but that's the process.

Scifo wants payment for his services to HM, he goes to the trustee with HM's knowledge and authorization (based on her hiring him).

Why would Favia, a lawyer, think she could bypass HM and go straight to the trustee for her $126K? There's nothing illegal about HM going to the trustee and asking for $126K for a lawyer she hired to represent Stella; the trustee would treat it like any other request for money coming from HM.

But Favia didn't do that. It appears she went directly to the trustee, possibly (probably?) without HM's knowledge, to get her money. Which didn't work, of course, because it is HM's money, not Stella's, and only HM and the trustee together get to decide how it gets spent.

This woman is genuinely shady, IMHO.

Stella has a baby-daddy who should also share what he's been getting. He's looking a lot healthier and happier these days, especially in the most recent photos. I doubt that his mother is going to come back to Bali, but perhaps she could send something to the hospital.

Giving birth in Bali, including a competent doctor, the hospital room, food, room service, medicines, tests and check ups, cost a person on this forum 3,224,200 rupiah, which equals US$248.24. That was in 2010.

Yes, I noticed his new bling and Nike t-shirt the other day. I wondered if his mum had sent him some presents, and he wanted her to see them in photos .. and it had made him noticeably happier.

Ponder's lawyer Arie Budiman Soenardi said he would not advise his client to appeal: "(The sentence) is quite light, not far from what the prosecutors had asked, so we will soon advise our client to accept it."

I have spent some time tonight looking at what might happen to Stella. The best info I found was this policy set by the The (US) Department of Justice’s Office of Justice Programs (OJP), in partnership with the International Association of Chiefs of Police (IACP), called Safeguarding Children of Arrested Parents.

Some of the pertinent info states (pg 15):

- Parents have the right to express their preference in where they would like their child to be housed and the person(s) who should provide care and supervision.
- However, some arrested parents do not make the best placement decisions for their child.
- Even when parents make appropriate decisions, some potential caregivers may simply not have the financial resources; physical capabilities; housing requirements; or, when working on a daily basis, the time necessary to provide proper supervision and care.
- However, it is the responsibility of the police and, in some cases, CWS to check with the temporary caregiver to ensure the child’s wellbeing. As such, as soon as reasonably possible, some basic checks of the proposed caregiver should be performed.

I think we discussed this earlier ... Stella will be a US citizen (only). No dual nationality. One parent must be Indonesian for that to occur. The links to the info are further back in the thread somewhere.

That is why I looked up US policy on the matter. Because Stella should fall within US care, being an innocent US child of a US prisoner(s). Which is not to say that the US will not allow her to stay with/near her parents in Bali. That is the unknown.

(I edited my post above, because it may not have been clear that I was speaking of US policy :) )


ETA: Here is the link that gives the requirements to be an Indonesian citizen/national (full or dual). Stella does not fit the requirements.

Just a few thoughts: The only trial coverage we have seen since the calling of witnesses is from TS's trial-not HM's. The things we have heard about HM is all the ongoings outside the court room.

Both trials are happening now. TS's lawyer is not complaining about being paid. Of course, TS doesn't have any money. I realize we have figured out that Soenardi and TS's lawyer are more than likely in kahoots together, but still.... On the surface, how can it appear logical that HM's attorney needs his retainer paid RIGHT NOW but TS is having no problem making it through his trial with his lawyer? MOO

Also-thanks to those on this thread that pointed out that HM's threat of suicide is a threat to the baby and this shows her inability to be a caring parent. I hadn't thought of it that way when I first read it.

That's what the $15K medical bill figure is all about.

IIRC, soon after they were arrested, didn't HM wig out and get taken to a hospital for evaluation? I think her attorneys at the time, possibly at Elkin's urging, tried to get her taken to a private hospital, but the police refused and she was taken to a police hospital.

$15K for hospital expenses = best private hospital in town, plus Favia flies to Bali for the birth.

Yes Mr. Ary Budiman Soenardi. I'm sure once you have the money you want to bribe the judges and prosecutor, while keeping a nice chunk of change for yourself, that proving Heather's "innocence" will not be a hard job at all.

Too bad Judge Cohen doesn't see it that way. They've both got the same prosecutor and judges though. So whatever they do for one, they will do for the other. Ary will also take care of his "associate" TS's lawyer. The end result once the rest of the money is in will be TS getting a few years for a heat of passion killing and HM getting a few more months for the accessory after the fact. This is what I believe.

I did find several listings for Budiman & Co. Different addresses for the listings (one is a hotel), but the same phone number. I cannot find any information saying that Ary Soenardi is or is not an associate of that firm. But Budiman & Co do not have a website, do not have a company profile ... nothing at all showing their staff, their memberships, their professional integrity, their specialties, online. Just listings.

Remember that Indonesian female lawyer that showed up instead of Ary at the first court appearance? I think her name was Nevi? Budiman & Co is one of the two law firms that she has listed as being places where she currently works. 10+ years at Budiman & Co, less time at the other company. I stumbled on the info last night, but I can't find the link again now.

Budiman seems to be a very common name in Indonesia.
