Cohen's concern in Chancery Trial is not about the baby, it is strictly a trust fund release issue. He is not in a Guardianship court case. $ only. Baby Stella case will probably be in Bali as well, unless Guardianship is filed in Bali (hence Favia) I am thinking. In short, you can not blame Cohen outside of his jurisdiction.
Yes, but you know, reading your and Kamille's post made me think about this again.
If HM wants money for 'X', she asks the trustee. 'X' could be a new car, TS's defense, toys for Stella. It's still HM's money legally. The trustee won't necessarily give it to her, but that's the process.
Scifo wants payment for his services to HM, he goes to the trustee with HM's knowledge and authorization (based on her hiring him).
Why would Favia, a lawyer, think she could bypass HM and go straight to the trustee for her $126K? There's nothing illegal about HM going to the trustee and asking for $126K for a lawyer she hired to represent Stella; the trustee would treat it like any other request for money coming from HM.
But Favia didn't do that. It appears she went directly to the trustee, possibly (probably?) without HM's knowledge, to get her money. Which didn't work, of course, because it is HM's money, not Stella's, and only HM and the trustee together get to decide how it gets spent.
This woman is genuinely shady, IMHO.
