(755 ILCS 5/2-6) (from Ch. 110 1/2, par. 2-6)

Sec. 2-6. Person causing death.

A person who intentionally and unjustifiably causes the death of another shall not receive any property, benefit, or other interest by reason of the death, whether as heir, legatee, beneficiary, joint tenant, survivor, appointee or in any other capacity and whether the property, benefit, or other interest passes pursuant to any form of title registration, testamentary or nontestamentary instrument, intestacy, renunciation, or any other circumstance. The property, benefit, or other interest shall pass as if the person causing the death died before the decedent, provided that with respect to joint tenancy property the interest possessed prior to the death by the person causing the death shall not be diminished by the application of this Section.

A determination under this Section may be made by any court of competent jurisdiction separate and apart from any criminal proceeding arising from the death, provided that no such civil proceeding shall proceed to trial nor shall the person be required to submit to discovery in such civil proceeding until such time as any criminal proceeding has been finally determined by the trial court or, in the event no criminal charge has been brought, prior to one year after the date of death.

A person convicted of first degree murder or second degree murder of the decedent is conclusively presumed to have caused the death intentionally and unjustifiably for purposes of this Section.

The holder of any property subject to the provisions of this Section shall not be liable for distributing or releasing said property to the person causing the death if such distribution or release occurs prior to a determination made under this Section.

If the holder of any property subject to the provisions of this Section knows or has reason to know that a potential beneficiary caused the death of a person within the scope of this Section, the holder shall fully cooperate with law enforcement authorities and judicial officers in connection with any investigation of such death.

Judge denies request for funds for Bali murder defendant's unborn child

An ongoing legal fight over the $1.56 million trust fund of a pregnant Chicago teen accused of murdering her mother in Bali took another twist Friday when a judge denied requests for medical and legal fees related to the unborn child.

Cook County Judge Neil Cohen said the trust, which the teen's slain mother penned months before her August death, does not provide for such payment.

Oakbrook Terrace attorney Vanessa Favia sought $126,000 in legal fees for her role representing Heather Mack's unborn child. Favia had worked two weeks on the Indonesian island last fall.

Favia also sought an additional $15,000 for the baby's expected April delivery and other related medical expenses, which the judge denied.

"The trust doesn't deal with anyone except Heather, as long as she's alive," Cohen said. "I can't rewrite something that's been written."

Cohen noted he already has given Mack $2,240 from the trust for her living and medical needs.

I was trying to find the above quote before... because as I see it - there is no money available for Stella at this point - and SvWM specified her money was for 'no other child' (which would include Stella).
There is also the consideration that HM was not to receive this money until she was 30 years old.

As far as I am aware, it is HM only money - not Stellas - that is until the sentence it brought down.

Now lets see how the dates pan out in the upcoming days - and lets see if there are any more delays - because if you ask me, HM is trying to get something through before the window closes on her.

Id say Mack is trying to get the money moved over to Stella - but I don't think it relies on court dates, or birth dates, but the date of the murder.

Unless that is, that HM and her team does have prior knowledge of the what the Judges decision is - she maybe trying to pre-empt something.

In other news, Canadian teacher Neil Bantleman received a guilty verdict in Jakarta on a crime he likely did not commit and 10 years imprisonment.

Apparently there was no evidence against him. :dunno:

Oh you mean after she was told there was video surveillance and her "masked intruders" story wasn't panning out?

I see they are only referencing her as "aiding" so there is no question with the prosecution that she may have been equally involved or have done it herself. So the judges should go lenient on her because after she lied multiple times, she finally copped to just the help close the suitcase part. I guess they missed the quote from her to the U.S. news reporters that she was innocent of all charges against her.

I would have liked to have seen all the evidence against them brought into a real court of law and for them to have been convicted of the first degree premeditated murder that they are both guilty of and be sentenced to life in prison.

Pretty strong message Indonesia is sending to foreigners with a good size bank account and an axe to grind with a family member. I'd say if your relationship is a little rocky with someone and they suggest a trip to Bali to work things out, you respond with a resounding "oh hell no!"

I really don't want to see Stella put under Kia Walker's care, but I think that's the only arrangement HM will accept, if it comes to it.

If Kia Walker gets control of Stella, she'll have control of Stella's inheritance and she will use it to support TS and HM, as well as herself and Stella. Completely unacceptable.

Nothing against KW personally, but I don't think she'd be so quick to be a doting grandma if TS had knocked up a co-worker at the escort agency he worked for or one of his gangsta-wannabe squad girls from the 'hood'.

I thought it had been established that Stella has no inheritance, hadn't it?
I am not maternal, but I can't stand the thought of that child being in that jail, and if I were related to her I would use anything I could to get her out of there. Human beings are resilient, but I don't have a good feeling about this one. I am so pleased that the doctors have suggested that baby Stella gets sun. Very important for her immune system. She will need that resilience and more if she is to survive being there for her first two years.

But just a reminder, if you happen to be the one with the grind-y ax don't forget to get knocked up (or knock someone up) before ya go! An 8 lb bundle of joy is worth their weight in "get out of jail free" gold! (Apparently babies are like magical unicorns in Bali, and the unicorn portal which birthed this particular baby unicorn is heralded by all as so unique and bewitching that she must be set free so as to properly raise this baby unicorn to adulthood! There can be no other reasonable alternative! None!)

It's astounding that just because she had sex with a dude her sentence is going to be reduced. Just...astounding.

So what's the prognosis? Is she still there in the waiting room with her "guard" who carries her bag for her? (what a joke) What is the baby's condition? Is she being admitted to the hospital or have her and her "mother" returned to Kerobokan? If HM's not maternal, and she's a prisoner, leave her at the damn prison and send the baby alone with the "guard" or better yet the prison doctor. That will prevent her using the baby for excursions in the future.

She's supposed to have had a caesarean section. Another area that must be kept sterile to prevent infection. I guess that was pretty much healed before she left the hospital? Or she's very careful to ensure that the incision area is protected but not so diligent with the baby? She's moving very well for a caesarean. Not even a grimace when entering and exiting these vehicles from the day she left the hospital. Heals quickly or good pain killers?

I'm finding it difficult using Stella for the baby's name. I guess I keep hoping that someone will step in and remove her from the horror she's enduring at the moment and place her with a loving family who will promptly change her name to remove any trace of her early history.
