A volunteer attorney appointed by the court has since arranged for biweekly checkups on the child's health and development, and reports those findings back regularly to a Cook County judge.

In Cook County court Tuesday, Peter Schmiedel, Stella's court-appointed guardian, reported the baby was a little underweight but healthy after a recent hospital visit. But he also informed Judge Neil Cohen that Mack's boyfriend, 22-year-old Tommy Schaefer, of Oak Park, had instructed Schmiedel to cease communicating Stella's health to the court — something Cohen found troubling.

Mack's attorneys said Mack wants to keep open communication with Schmiedel, the guardian, and it is Schaefer who wants to impose a ban on the regular health updates. The agency responsible for checking on Stella also provides the mother and daughter with medical services and food packages, attorneys said.

Cohen said if Mack's attorneys work on an order stating Mack's consent alone would be sufficient enough for the communications to continue, he would sign off on it.

"I really don't think this child should be used as a pawn," Cohen said. "(Communication) could only serve to Heather's benefit."

So what's up with TS? Trying to cause trouble for HM because he's not getting his "medicine"? :thinking: And did I read that correctly, Cohen is prepared to take TS's parental rights away on this matter?

Very strange that TS wants to block Stella's health information!

Even stranger is that it appears that HM not only doesn't have a problem with it, Cohen is supporting efforts to legally bypass TS's wishes on the matter.

Lover's quarrel?

Isn't some of the current court activity related to sorting out the 'slayer statute'? It seems that Cohen has tried to prevent delays by refusing to give HM any more $$ until the issue has been settled one way or the other.

The 'slayer statute' thing has gotten complicated. Originally, they just had to decide of the charges she was convicted of in Indonesia were the same as US disqualifying charges.

However, HM has complicated it by saying that even if she did murder her mother, she's entitled to the money because the money was her father's, not her mother's.

Then there's the activity related to HM and TS trying to get some kind of settlement - you know, all those ridiculous demands HM made in the letter she sent the court: a copy of her father's will and an audit, because she's sure her mom hid or stole $10 million.

I'm not sure any of this involves the FBI evidence.

However...I can't wait for the Bibbs trial to start. I think this has really complicated things for HM. The Indonesians ignored the text messages - that bogus (paid for) excuse about the message possibly having been tampered with. We know that's nonsense - the FBI wouldn't be bringing a case based on texts without making darn sure they were genuine.

If Bibbs goes down, it means that HM will always have a potential 'conspiracy to commit murder' or similar charge hanging over her head if she decides to come back to the US. From recent comments, I think she's prepared to stay in Indonesia - anywhere but the US.

Here's another possible chance for 'teflon' HM to escape justice. I don't know Indonesian law; under US law, a child born in the US is automatically a US citizen. IIRC, that child can eventually be used as an 'anchor' to allow its non-citizen parents/family members to enter the US permanently. It may be (I hope not!) that Indonesia is similar and that Stella is an Indonesian citizen and HM will be allowed to live there based on her daughter.

HM will need to get and continuously renew a Visa for both her and Stella to stay in the country upon her release from prison. I'd like to believe they would automatically deport a convicted felon from their country at the time of their release from prison but something tells me they will not. Especially if this foreign felon is sitting on a million dollars courtesy of her pawn..oops I mean daughter. It will also not surprise me if she gains early release, with parole to be served in the country, on humanitarian grounds, to raise her little bundle of cash...oops...I mean daughter.

As for TS, I believe we've seen the Daily Mail article that there might be trouble in paradise for the lovebirds and perhaps this is the first inkling that this might be true. HM is receiving "care packages" from Stella's "volunteer" attorney (???) over there in Bali so of course she's good with continuing this practice, especially if funds are cut off. TS is receiving nothing it seems. And he's pissed off with HM so he wants her to receive nothing as well. At the same time, perhaps he wants them to do something to get Stella out of the prison and out of the country? If she's not going to be his cash cow, then he sure doesn't want her to be HM's.

I looked through some of his FB posts. I was particularly curious, of course, to see if he said much around the time of the arrest.

Poor baby, it spoiled his birthday, because he was on house arrest. He alluded to being in trouble and asked for people's prayers.

Here's one notable (and highly ironic) comment:

Robert Bibbs is TS's cousin - the one who took TS to the airport.

The FBI arrested him and he has been placed on home confinement until his trial and forbidden to talk about the case or contact folks involved (HM and TS).

RB had 'advised' HM about the best way to murder her mother and get away with it. IIRC, HM first started trying to find a contract killer in February. RB was hoping for a cut of HM's money.

RB and TS were texting as TS was standing outside SWM's hotel room door on the fatal night. RB texted encouragement, and after the deed was done, texted TS that it was OK to not feel bad about killing SWM, because she wasn't a good person.

I believe he's charged with 'conspiracy to commit murder'. You should scroll back a few pages and read the texts the FBI presented to the court already. Apparently what's on the affidavit is only a small part of what they'll bring up in court.

On the day he was arrested, in front of FBI agents, TS called RB. The FBI told him to take the call - TS told RB "don't say a word" - right in front of the FBI.

This is all very important. HM and TS and RB are now dealing with the feds, not Indonesian corruption or US incompetence. All three of them could be subject to the same charges, based on the text messages. That means that even if she gets out early, HM likely will still face federal charges if she returns to the US.

I think the maximum sentence for this is 20 years, although RB probably won't get anywhere near that. HM and TS won't get off so easy.

eta: You may that even though the FBI went to Bali to investigate, the Indonesians were 'persuaded' to ignore the incriminating text messages because they allegedly might have been tampered with. As I posted earlier, there's no way the FBI's taking RB to trial without having already verified the authenticity of the messages.

I cant believe this saga is still playing out - :facepalm: (I've been away for a while)...

Its probably a good thing that the FBI went quiet on this publicly and it didn't come out in the Bali trial - or wasn't needed as the Courts in Bali had enough evidence to get them a sentence anyway.
As I recall also, criminals cannot stay in Bali after their detention, they are deported back to their Country of origin - so if there are charges pending, HM may have an FBI escort back to the USA if there are charges pending, because she is a flight risk.
 
Another good thing about the Bibbs trial: it gives the FBI a chance to make their case even stronger. Courtrooms and judges and juries can be unpredictable. Any unanticipated weaknesses should come out during Bibbs' trial.

That means if/when TS and HM come back to the US, the FBI will have a really good case prepared.

I know the rules say criminals get deported, but if HM gets her hands on $$$ or she has the right local connections, who knows? It's not like Indonesia is all that great about sticking to the rules.

Very interesting! Thanks so much for this review of the Bibb person, I had somehow missed this part. I had to stop reading about this case because baby momma and baby daddy drama was taking away from Sheila's murder. Jmo

One other interesting little tidbit: IIRC, the FBI wasn't able to access HM's phone. I don't recall ever reading what the issue was; I assumed perhaps she had password-protected it. We know she had at least one cellphone confiscated in prison already, but we do not know if it was her original phone. We don't even know where her original phone is right now.

AFAIK, the text messages the FBI have retrieved are all from TS's or RB's phones.

TS has already taken a hit for HM (well, HM's $$$) - will RB do the same? Or will he do anything he can to protect himself?

I am really hoping this goes to trial and he doesn't get a plea deal. If it goes to trial, unlike Indonesia, we should have more visibility of what's going on.

I think Bibbs will sing like a canary to protect himself. Obviously TS is worried about that too since he told Bibbs, "don't tell them anything" when he answered the phone in front of the feds.

TS and Bibbs thought HM had ELEVEN million dollars. Turns out, the trust, (which she hopefully won't get), was only worth $1.56M. A third has now been spent. So, the trust is down to a million bucks, which is still a lot of money to TS and Bibbs. However, I am sure that TS has figured out that he has no claim to the money. He's not married to HM. Bibbs truly has no claim. I think he was relying on TS's generosity.

If Stella gets the money, TS may be hoping he can get his hands it. But HM is a master manipulator. Stella will be 10 when HM gets out, (if not sooner). Stella will be 18 when TS gets out. That gives HM 8 years to spend all Stella's money. Not that I think it will even come to this. Let's face it-the lawyers are gonna get a huge chunk. Judge Cohen seems in tune with this and wants to preserve funds for Stella. But, I don't think there will be that much left for her.

Thing is, Stella didn't hire any of these lawyers. So Judge Cohen has to approve any requests they make for money, technically on behalf of HM who supposedly did hire them. He's already turned down Favia once. Did Elkin ever get anything? And yet both are still in there fighting for HM. Except Favia keeps trying to suggest that she's Stella's lawyer. It's very complicated I'm sure.

I don't think Elkin has been paid. Cohen refused to pay Favia's bill because technically, Favia says she is working for Stella. Well, at this point, Stella has no money to pay 'her' bill. Favia is now working pro bono for Stella. It doesn't take much of her time, she knows Cohen and Wiese and everyone else would be OK with Stella getting the $$ if HM isn't in control, so Favia's hanging in there, hoping Stella will eventually get the $$ and Favia will get her payday.

The whole business about the 'mystery millions' is very strange. HM has a lot of faults, but she is not stupid. It's hard to understand how she could have gotten this wrong - thought that there was an $11 million inheritance when it was so much less.

There's an interesting timeline. HM already knew TS in February (before Rachel was killed) and was looking for a hitman. I'm not sure she and TS were actually a serious item at that time.

Fast forward a few months, and TS is reminding RB about 'crazy' HM and telling RB that she is serious.

Here's what's interesting to me about those conversations. It doesn't sound at all like TS was planning a longterm relationship with HM. They refer to her as 'shorty' or 'shawty' and they know she's rich. Once TS has decided to do the Bali trip and killing, he tells RB to start packing his bags - no mention of traveling as a threesome. He even goes on to say that he expects to have the money in his own name in a year or two, but qualifies that a bit - a million or two will be under his name.

Sounds like ol' TS thought he was quite the player, gonna go to Bali, do a quick job, get some $$ under his own name, and move on with his bro RB. Looks like the 'playah' got played.
