Yup, I would much rather see her adopted by someone in the states who will take her away from the disfunctional bio family .. But if the alternative is her staying in Bali with someone who will take her to visit the prison frequently, I'm team Kia lol

I don't know why I feel this way, but I'm glad Kia Walker is trying to get custody of Stella. It seems like the best option, although none of the options are truly good. I think Kia may be a bit crazy, but she is a big woman. Looks like a strong woman. As long as she is sober, ( I have no reason to think she isn't), she should be able to kick HM's *advertiser censored* if she ever comes around.

I am wondering how much of the trust fund is left. In June, 2015, the news said $400K had been spent in legal fees and there was about a million left. http://abc7chicago.com/news/guardian-must-represent-heather-macks-baby-judge-says/781079/

That was 20 months ago. Maybe that is why HM looks so sad. All the money is gone!

I do believe the best thing for Stella is if there is enough money for her basic needs and education, and that is it. In a trust that is approved by Cook County. Otherwise, she will spend her life dealing with people trying to suck her dry. She is already going to have so much emotional baggage. I want the best chance for her to having a happy, normal, loving life.
Great post! I agree completely. Best option is the one to go with. Family in the U.S. far away from her mother for long enough to attach to someone during her early impressionable years. No more money could turn out be a real positive for Stella.

Ha! I bet all three of them (TS, RB and KW) have been working HM since last year. And I bet TS DID manipulate her into making that video at some point and then held on to it to be released when the time was right. Probably told her she needed to do it as a testament of her love to him when he was dissing her last year and it appeared she was actually upset about the breakup. She probably thought that by doing his silly scripted video, knowing no one would believe it, that she would have her hooks back in him to do her begging. Looks like the player got played. Oh wait, they're both players so.... well they deserve each other.

And KW's motive in this better have nothing to do with a trust fund. I know she tried to get HM to hand over Stella back when she was born so that she could bring her back to the US to raise her and HM was having none of it. I remember the stories back then when KW was at the hospital visiting her. So I'll give KW the benefit of the doubt for now since, at that time, she likely assumed that all the money would stay with HM.

But oh the irony if Stella is raised by her paternal grandmother and then is given the balance of the trust fund when she turns 25. And HM and TS have to spend the rest of their lives trying to avoid those conspiracy charges in the US or answering to them by doing some more time in a real prison. Now that would be sweet justice.

She looks high as hell. Nevertheless, She's a master manipulator. What if.... TS & HM are split...but she wants him back ...so she records these videos to try to win him back.. TS sees the videos but it doesnt work, he still didn't want her back, so she recanted and said she was coerced by him. He's probably got some new girlfriend and she can't handle it.

I'm thinking this may have happened last year. But your version works too.

Maybe I just SO want to find out that HM was manipulated and used...for once. LOL

In a two-page document, titled "A Clarification", Mack and her lawyer Yulius Benyamin Seran, say the video is fake by design" and "recorded under pressure". "Tommy Schaefer has written the scenario of confession... [for] her to be read."

The statement says Mack did not upload the video and that other parties deliberately created an account with the name Heather Mack to create the illusion that it was Mack's doing.

And it points out that the court verdict against Mack and Schaefer is final and binding and that the video is not "new evidence" to reopen the case.

"Heather Mack is a victim of such fake video and allegedly there is the motivation behind the video published on the YouTube page to affect the ongoing trial in Chicago as well as efforts [to] interfere [with] the process of transition [of] Stella's guardianship," the statement says.

It is signed by Mack and her lawyer.

Just bringing this forward to reiterate that HM herself insists that the video was uploaded to try to interfere with the transition of Stella's guardianship.

It comes after furious prison officials vowed to get to the bottom of how Mack had used contraband to upload a video and threatened to strip her of her annual sentence remissions as punishment. Phones and the internet are banned in the jail.

When prison officials sought to bring her and Schaefer together in one room for what is known as a confrontation of their conflicting versions, the pair refused to meet each other face-to-face.

How can two inmates in an Indonesian prison refuse to meet each other face to face to sort out an issue and the prison officials just say "well okay then" and don't force them to get together to get to the truth. And then both proceed to continue to use their contraband phones and post to the internet? From the available prison wi fi. :waitasec: :notgood:

Attorney: Heather Mack wants to keep her baby in Bali

But a lawyer representing Mack in Bali says the 21-year-old woman wants to keep the little girl in Indonesia.

"My client Heather Lois Mack as the blood mother of Stella, wants Stella here in Bali, so she has chance to meet Stella twice a week or more, so the relationship and psychological of Stella as well as the Mother more healthy," attorney Yulius Benyamin Seran wrote in an email late Saturday.

Seran went on to say the important thing is that Stella "has her right as a child to grow up in healthy environment, not in the prison. We will transfer Stella out soon."

Another one of Mack's lawyers previously has discussed the possibility of a local couple raising Stella until Mack is released from prison.

http://www.chicagotribune.com/news/...her-mack-guardianship-met-20170210-story.html

So HM wants Stella to stay there so that they both can be more "psychological healthy". Ummm...hardly HM. You'll never be "psycological healthy". But at least your daughter had a chance until you decided to get all selfish and keep her in a prison for her formative years.

And who is this "local couple"? Are they willing to take care of Stella and bring her to visit her mother several times a week for no money? Will KW take Stella without expecting the trust to take care of her financially?

The Daily Mail had an interesting line...

She has filed paperwork in Indonesia to become the toddler's legal guardian but Mack is fighting it.
She would rather see her daughter be raised in Bali where she will get to see her twice a week in visits.

Stella may be raised by a local family or have care provided for her by the state.

http://www.dailymail.co.uk/news/article-4217700/Grandmother-Heather-Mack-s-baby-wants-US.html

Care provided by the state? That would be pretty unnecessary considering the child is an American citizen and has plenty of options in her home country.

Where are the sound bites from Elkin and Favia who have a hotline to HM and to the Chicago Tribune? They have no problem showing up in chancery court every month but they don't want to get involved in anything that's been going on this week? No comment? I thought they were representing HM and Stella in court. You'd think they'd want to set the record straight regarding the recent events. From the horse's mouth so to speak. Maybe HM isn't talking to them because she's not been getting what she wants?

Why is she using a previously unknown attorney in Indonesia right now? Who is paying him? How much is she still getting from the trust?

And that her mama murdered her own mother. Ugh, please not Bali. Stella's psychological health will be directly proportional to the distance she can maintain away from HM.

It would not be impossible to trace some aspects of the account that the video was posted from and by, if necessary.
I bet the FBI are doing there own piece of investigating without relying on an answer from HM & TS.

And 'forced' into a confession?
Not a chance.

Real and tragic false confessions are very apparent. The breathing rate, the eyes, the shoulders, the stance, the voice rate and delivery - I've never seen a forced confessor leaning casually against a wall with dropped shoulders saying 'ummm' or still lying in their false confession, while sniffing and playing to the camera.
This has 'Plan' written all over it, with 'Purpose & Intent'.

Power, even if it is destructive, is power - and there I see again HM flexing her ability to manipulate and blame.
There's something going on - yet (IMO) the making of the video and the actual release of the video I think are something that happened like a bad collision.

When was the last time HM's phone (and other inmates phones) were confiscated by officials?

The video may have been made a while ago -
The video may have been made on someone else's phone - it may have been on Heather's phone, but even with the data storage removed or wiped,
it doesn't mean that the data is not accessible later, taken off and kept or copied, and the handset returned to their owner with the copied data removed and the owner none the wiser.

And another thought - in Tommy's letter he did mention that one day the truth would come out, but he couldn't say anything right then.
Maybe it wasn't from his lips - but he knew that the video had been made.

Her lawyer said that because she is her 'blood mother', she deserves to keep the toddler in the same country as her.

I'm sorry, but HM isn't entitled to "deserve" anything. Stella is not an Indonesian citizen. She is a US citizen, and the US should have collected that baby from jail 2 years ago and brought her home. A new mother who killed her own MOTHER should not be allowed to keep her children. Such a disservice to Stella.

Agreed Weezer.
I'm wary that there seems to be a more than healthy elevated and unusual duty of care towards HM in this prison system (still) -

If Stella has to move as intended in March, I hope she has already commenced bonding with her foster parent, otherwise it will be a confusing and upsetting wrench from her birth mother and father which is all she really knows. Poor little baby who is just gorgeous.

I was just looking over the docket to see if anything gave us any clues. I noticed something. Favia and Elkin have not been mentioned since Feb 2016. On this Feb 9, some activity is posted about motions by Goldberg Law Group LLC for HM. I looked them up and did not see either Favia or Elkins name mentioned as attorneys. I wonder if they were done long ago since they figured out they will probably never be paid?

BTW-the court date is this Friday. Monday is Presidents Day, so I don't expect to see an update here until next Tuesday at the earliest....unless something happens this week.

SBM

I just looked up the Goldberg Law Group LLC and what did I find? One of their specialty areas is visitation and custody rights for grandparents!

This is the first paragraph on their home page:

"At Goldberg Law Group in Chicago, our skilled legal team uses its decades of experience to serve a diverse clientele in three distinct practice areas: Professional Licensing, Health Care Litigation and Family Law (with a concentration in Grandparent Visitation)."

Elsewhere on the the site it says:

"Are you a grandmother or grandfather seeking custody of a grandchild, or increased visitation rights in Illinois? Goldberg Law Group in Chicago works hard to protect your rights."

So, Kia Walker's attorneys?

See:

http://www.goldberglawoffice.com/

I know the lexisnexis docket that Weezer Fan linked to in a very recent post lists the most recent activities with "participant: Heather Mack" but does that mean she initiated them? Or can it be that the activity specifically refers to her or requires her to answer?

The date of the most recent activity is Thursday, the day the Chicago Tribune reports that Kia filed for custody.

"In re RLS, is an Illinois Supreme Court case that sets the standard for grandparents and to get guardianship. A grandparent will be able to get guardianship if they can show that the parent is unable or unwilling to care for the child. There is no clear definition to show unwilling or unable, but some courts have awarded guardianship where the parent has a drug abuse problem, mental health issue, history of child abuse or is unable to feed, clothe or shelter the child."
