DYER COUNTY, Tenn. (Court TV) — After hours of deliberation over two days, a jury was unable to reach a unanimous verdict on all of the charges against a man accused of murdering his wife more than 10 years ago.

A jury found David Swift not guilty of first-degree premeditated murder, attempted first-degree premeditated murder, second-degree murder and attempted second-degree murder, but was unable to reach a verdict on the charge of voluntary manslaughter.

Nearly 13 years after Katelyn Markham died and 15 months after her fiance’ was indicted for murder, John Carter has admitted to his role in the death of the 21-year-old art student.

Carter, who was scheduled to go to trial in about a week, pleaded guilty Friday morning to involuntary manslaughter, a third-degree felony. He faces a maximum of three years in prison.

The charge is a third-degree felony because the underlying crime is a misdemeanor assault, according to prosecutors.

Butler County Prosecutor Michael Gmoser said after the pleading, “This brings absolute undeniable finality to the question of who is responsible and accountable for the disappearance and death of Katelyn Markham.”

Carter said “guilty” clearly to Judge Dan Haughey on Friday morning, and Haughey set sentencing for July 18.

On Thursday, a jury found Brian Giles, 48, guilty of first-degree murder in the death of his wife, Nancy Giles, who went missing in October 2018. Her remains were found in May 2019 in a shallow grave near a trail on the Inclined Plane hillside in downtown Johnstown, where the couple lived.

The remains have not yet been identified but the discovery comes after Giles’ girlfriend, Jilly Todaro, who also lived in the Kernville residence, disappeared in December 2020, a few days after a reported domestic altercation.

#BREAKING: A #Florida jury found #WadeWilson guilty of two first-degree premeditated murder charges. Wilson went on a killing spree in October of 2019 murdering Kristine Melton and Diane Ruiz. The same jury will determine whether or not Wilson should be sentenced to death.

It took the jury just 2 hours to find #WadeWilson guilty on all counts. The penalty phase begins next week on Thursday. He faces the possibility of the death penalty.



 
Authorities have made an arrest in the killing of Rachel Morin, the Harford County mother of five whose body was found near a popular hiking trail in August, according to her family.

A jury of six women and six men in the murder trial of Karen Read, the Massachusetts woman accused of hitting her boyfriend John O'Keefe with an SUV and leaving him to die in a snowstorm, told the judge at midday Friday that they have been unable to reach a unanimous decision.

Read, 44, of Mansfield, is accused of hitting O'Keefe with her black SUV outside of a home at 34 Fairview Road in Canton on Jan. 29, 2022, following a night of drinking. Her defense contends O’Keefe was dragged outside after he was beaten up in the basement and bitten by a dog at Boston officer Brian Albert’s home in Canton.


Judge Beverly Cannone sent the jury to resume deliberations just after 9 a.m. Friday. Just before noon, the court clerk said the jury had a question, which was later revealed to be about not being able to reach a verdict.

"I am writing to inform you on behalf of the jury that despite our exhaustive review of the evidence and our diligent consideration of all disputed evidence we have been unable to reach a unanimous verdict," Cannone read from the note from the jury foreperson.

Jurors deliberating the verdict in the trial of Karen Read, the Massachusetts woman accused of hitting her boyfriend John O'Keefe with an SUV and leaving him to die in a snowstorm, have again told the judge they are at an impasse and unable to reach a unanimous decision.

"I think this has been an extraordinary jury. I have never seen a note like this, reporting to be at an impasse. I do find that they're now, with the additional time that they went out Friday saying that they were deadlocked, is due and thorough deliberations, so I'm going to give Tuey-Rodriguez," Cannone said.

In delivering the Tuey-Rodriguez instructions, Cannone told the jurors they are the best hope for reaching a verdict and encouraged them to look at the arguments from the other side. If the jury returns again to say they are still deadlocked, the judge must declare a hung jury and dismiss them.
