A Merced County Judge has granted a motion from prosecutors to consolidate the cases of a Merced man charged with kidnapping and killing an 8-month-old, her parents and uncle and his brother, who is charged as an accessory to the kidnapping and murders.

Brothers Jesus Manuel Salgado, 48, and Alberto Salgado, 41, appeared before Merced County Superior Court Judge Carol Ash in Merced on Wednesday. ...

We’re going to prosecute the case the same whether they remain consolidated or not,” said Merced County Deputy District Attorney Katie Gates. “It’s just that it reduces the number of hearings since they will have a preliminary hearing and trial together rather than independently.”

The men are scheduled to appear in Merced County Superior Court for a pre-preliminary hearing on July 19.

Pre-preliminary hearing 7/19/2023 8:30 AM.

Does anyone know what occurred at this preliminary trial?
I haven't seen anything recent in MSM, and criminal case information is not accessible via the online portal. MOO

Scheduled 12/7/2023 in Merced County Superior Court

I am wondering if we're going to see a plea deal in Alberto's case; his charges don't include murder. Until recently, his court dates coincided with his brother's. Something has changed, IMO.

Noting:
  • Alberto Salgado, the brother of Jesus Manuel Salgado, was found guilty of criminal conspiracy, accessory to the crime, and destroying evidence.
  • Alberto Salgado was given a three-year and eight-month sentence, with time served and credits. He will likely serve for 22 months.
  • Jesus Manuel Salgado is due in court on March 4, and prosecutors tell YourCentralValley.com that they intend to push for the death penalty.

Outside of the courtroom family members reacted to the sentencing saying laws in California for this sort of crime need to change.

“If you look at it and other criminals look at it also, if a crime like this only gets three years and 8 months it doesn’t stop others from doing this all over again,” said Balwinder Saini, who is the brother-in-law of the victims.

Despite the sentencing, family members say they are thankful for the community’s support as they continue to fight for some sort of justice.

According to the Merced County District Attorney’s Office, Jesus Salgado’s case is still in the pre-trial stages.

Is that because he is going to testify in his brothers trial?
I am pretty sure he wouldn’t be sentenced until after testifying, if that were the case. It appears that he was convicted and it’s possibly California’s lax laws that are at play here. Of course, that is based on the family’s statements in the articles cited above. MOO
