At link Assistant DA is quoted speaking to the judge regarding the accused, "He's not charged of being a smart murderer. His incompetence is not evidence of his innocence." It"s not a funny crime, but that ADA made me laugh.Suspect in Cash App Founder Bob Lee's Death To Stand Trial
A judge ruled Tuesday that murder suspect Nima Momeni will go to trial.sfstandard.com
To my knowledge, they did not. I think the next step is setting a trial date/appointing a judge (probably a different judge? that's how it often works in SF/most of California).Did the new defense team argue for bail for NM, or is that something that they will push for on August 15 at the next hearing. I am still catching up on the MSM articles in full, at least the ones that I have access to, and aren't behind a paywall.
I suppose the idea is to create a clear pathway to Second Degree Murder (he was in a sustained fit of "passion"?)
Yes, I think this is the reason. If that knife was from his sister’s kitchen, that will be a tough sell, however. JMO.

I agree, but what if the defense suggests that either one of them may have taken the knife from the sister's residence - that it could have been NM or Bob Lee, himself? Would that muddy the waters at all?
I know that some states don't allow for "crime of passion" defenses. Does California allow it?
Under California Penal Code § 192 PC, voluntary manslaughter is the unlawful killing of a human being that occurs during a sudden quarrel, in the heat of passion, or based on an honest but unreasonable belief in the need to defend yourself. seek to have the charge reduced from murder to manslaughter.
Bob Lee case: Judge rules Nima Momeni to trial in fatal stabbing of tech exec
After attorneys for Nima Momeni argued that he should face a reduced charge of manslaughter Tuesday, the judge in the case ruled that the suspect would go to trial on a murder charge for the fatal stabbing death of CashApp founder Bob Lee last April.www.cbsnews.com
Nima Momeni due in court tomorrow.
If I am reading this article correctly, it sounds like NM's attorney in statements to the media has conceded that the prosecution has proven a charge of manslaughter. I wonder if this is what the family was expecting with this new high profile attorney on the case?
