Did the new defense team argue for bail for NM, or is that something that they will push for on August 15 at the next hearing. I am still catching up on the MSM articles in full, at least the ones that I have access to, and aren't behind a paywall.

To my knowledge, they did not. I think the next step is setting a trial date/appointing a judge (probably a different judge? that's how it often works in SF/most of California).

It would seem to me that they have a big hurdle to overcome after Attorney One tried a defense of "it was an accident" (which appeared to at least admit of the facts of the case and admit of Momeni's being the one who did the deed).

I didn't listen to all of the defense's courthouse post-hearing interview, because I only found a snippet of it (I'm sure the entire thing is probably up somewhere by now). It seems they are very much trying to put to bed the spin that Momeni had performed an "honor killing." To me, this seems belated and best to let it lie, in terms of PR. So far, I think the overall take most people have is that there are drugs somehow involved, a dispute of some kind, and that Bob Lee somehow still trusted Momeni enough to get into the car with him.

Ih the local news article from Kron-4, it seems as if the defense wanted to establish the heavy duty nature of the partying that was going on and the presence of other Bad Actors at the party>


I have to admit that so far, I'm not getting the relevance of there being a drug dealer in the midst of a drug party. Momeni became very angry at him and may have threatened to kill him? that's how I read the article. I don't see exactly how showing that Momeni has a temper and goes about threatening to kill people is helping Momeni. Even the Judge responded that he had heard nothing about an "honor killing."

I do wonder if Defense Team Two has a clear idea of how demonstrating the volatility of their client as part of the defense might work against him. If he's mad enough to threaten to kill people associating with his sister, why does he then kill Bob Lee? I suppose the idea is to create a clear pathway to Second Degree Murder (he was in a sustained fit of "passion"?) I don't think most juries will buy that (but I sense a possible plea bargain, which is likely in SF in any case). Minimum sentence is 15 years.

Outside the courtroom, Bob Lee's ex-wife and mother of their two teenagers, Krista Lee, spoke to reporters for the first time since his death.

Her voice cracked with emotion as she offered her support for the prosecution's efforts.

"They are doing the best they can and I don't think there's anything sloppy about this," Krista Lee told reporters Tuesday.


She maintained Momeni is her husband's killer.

"He admitted to it saying it was self defense. He stabbed him multiple times. It's disgusting," she continued.

Lee said she has no reason to believe her ex-husband and Momeni were friends prior to her ex-husband's death.

"I don't think they were friends," she told reporters. "I had never heard him mentioned. Bob and I were very close. I never heard him mention that name. We spoke all the time. I don't think it was self-defense."

As she left the courtroom, Lee expressed her satisfaction with the outcome.

"I'm very pleased. Not that he's dead, but that his murderer will go to trial," Lee said.

I think so too (I agree with both you and @arielilane). I also think Momeni thinks he's going to somehow get off. It's obvious the knife matches the set in the sister's kitchen (probably right down to the wear pattern). It is odd but truly par for the course that SFPD hasn't tried to lift fingerprints from the knife (according to the defense, yesterday, if I understood correctly - I was reading SFStandard's reporting).

Momeni's lawyers will surely try to show there was no intent (and that he took the knife with him for self-defense). I wouldn't be surprised at all if Momeni takes the stand in this one.

I agree, but what if the defense suggests that either one of them may have taken the knife from the sister's residence - that it could have been NM or Bob Lee, himself? Would that muddy the waters at all?

I know that some states don't allow for "crime of passion" defenses. Does California allow it?

Yes. Basically, we do.

Under California Penal Code § 192 PC, voluntary manslaughter is the unlawful killing of a human being that occurs during a sudden quarrel, in the heat of passion, or based on an honest but unreasonable belief in the need to defend yourself. seek to have the charge reduced from murder to manslaughter.

I think they're going to try and get it down to that.

If I am reading this article correctly, it sounds like NM's attorney in statements to the media has conceded that the prosecution has proven a charge of manslaughter. I wonder if this is what the family was expecting with this new high profile attorney on the case?

I don't see it as a concession that the state has proven manslaughter. I think it's more like "don't let the State ask for anything more than manslaughter - we will show you why."

I see it as an attempt to persuade the judge to basically mandate the floor of the plea bargain.

This may be a one-sided attempt at a plea bargain, so the Court may hear that the State disagrees strongly and thinks the case is actually First Degree Murder. It's not clear to me that this is something that a Judge in California would normally do - so it'll be interesting as heck, in any case.

IMO, if the Defense is successful here, they will then do hardcore plea bargaining and try to get it even lower. There are at least two kinds of manslaughter in California - I'm sure the defense would be thrilled if the Judge dropped the First Degree Murder charge and made it manslaughter. I just don't see how the Judge could organize the trial properly if he excluded all the State's evidence that this was premeditated (IANAL, but I don't think the Judge could allow evidence of premeditation if the charge were only manslaughter).

OTOH, if the Defense is prepared to plead guilty to voluntary manslaughter...I think the State will have to agree. It's definitely a weird tactic (IMO)>
 
Nima Momeni, the man charged with murder for stabbing tech executive Bob Lee to death earlier this year, pleaded not guilty — again — at his re-arraignment this morning.





Attorney Tony Brass, one of Momeni’s four lawyers, today moved to waive Momeni’s right to a speedy trial. A trial date will be set on Oct. 2. Momeni will remain in jail until then.

someone obssesed with weapons with some criminal past and crazy about the wellfare of his sister..yet he went into his car after a fight
all the elements of dark side of money and sex and drugs
