Trezell, 35, and Jacqueline West, 32, the couple found guilty of five of the seven counts in connection to the deaths of Orrin and Orson West, must wait for their sentencing following a postponement, according to court officials.

The couple was scheduled for sentencing on July 13.

It's unclear why the sentencing was postponed. An email from Kern County Superior Court said an attorney requested the continuance, but didn't specify if it was a prosecutor or defense attorney. It declined to say who requested rescheduling the hearing or why because a gag order limits them from commenting.

Judge Charles Brehmer, who presided over the criminal trial, could discuss the reason behind the delay during a hearing on Thursday.

The reason for the postponement may be discussed and another sentencing date set Thursday morning.

Sentencing postponements are a common occurrence and can be requested due to attorney unavailability or additional time needed to file motions, among other reasons.

The Wests face 15 years to life, but prosecution could decide to retry them on charges on which the jury failed to reach the verdict, adding decades more to their sentence if found guilty. The prosecution may announce today whether they will retry the hung charges. #WestsTrial

Oh, honey, those sweet boys are more than likely in the garbage. I'm so sorry, even if they did tell, it's unlikely you're ever going to get that closure you want by burying them with dignity.

I hope someone helps the family buy a plot or a park bench or something, somewhere they can go to reflect and leave flowers, if that's what they need. The boys won't ever have a traditional gravesite, IMO.

Still hoping along with Rosanna, that the sentencing delay is related to one of them "talking" ... it's not impossible is it?

MOO, too little, too late. The time to talk and make a deal was BEFORE the trial. Not after being convicted of murdering a child.

I still want the answers of why the Wests got these boys so fast, and were able to adopt them, when it appeared that they did not work, and already had four children to care for...doesn't seem like a good placement for two young toddlers with special needs.
 
It was a nightmare placement for the boys.

But ideally two little children with a lot of needs would be with a stay-at-home or part-time employed parent. But a loving patient one, who would actually bond with them and actually taken them to various therapies and appointments, etc.

Maybe somewhere along the line someone hoped this family would be that for them?
But JW and TW weren't properly vetted, and the adoptions were much too fast, and there wasn't enough follow-up and no one made sure their needs were being taken care of at all.
 
For the second time this year, a federal judge dismissed a lawsuit filed against the Kern County Department of Human Services and the California Department of Social Services by the biological family of Orrin and Orson West after they claim social workers negligently placed both boys with their adoptive parents.

It's a decision that an attorney vows to appeal, he told The Californian on Tuesday.

Orrin and Orson West's biological mother, Ryan Dean, biological grandmother, Dana Moorer, and biological grandfather, Leif Dean, sought $100 million in their second attempt to hold accountable those they say violated their civil rights by removing Orrin, 4, and Orson, 3 from their custody, which led to their wrongful death.

Judge John A. Mendez of the Eastern District Court dismissed the federal lawsuit seeking $100 million on Aug. 24, after also tossing out the biological family's first complaint seeking $40 million in January. Allegations were dismissed against defendants Dena Murphy, the director of KCDHS at the time, Kim Johnson, the director of CDSS, and Anna Zavala-Garza, a local social worker.

The DSS workers in Kern County really need to be held accountable. This same department aided and abetted abuse in the Gabriel Fernandez case, as well. Little Gabriel was subjected to long-term, very obvious abuse and a horrific murder. That case was also dismissed.

I knew at the beginning of this case that there was a pile of something wrong in this case. But it looks to me like the judge is more about protecting the system than actually holding anyone accountable.

So many of these cases with adopted children dead, we hardly ever see the "rest of the story". The Nubia Barahona case, I have been following since 2011, her killer has yet to even go to trial.

With judges reluctant to allow civil action to go forward, perhaps it’s time to start holding blatantly negligent case workers accountable criminally.

There are many dedicated case workers out there who are trying their best to do their jobs in a system that’s badly broken. FGS there are children’s lives at stake and something needs to change.
