DA schedules tentative press conference regarding West case

The Kern County District Attorney’s Office will hold a press conference Thursday if the sentencing of Trezell and Jacqueline West moves forward as scheduled and the gag order is lifted.

The Kern County District Attorney’s Office will hold a press conference Thursday if the sentencing of Trezell and Jacqueline West moves forward as scheduled and the gag order is lifted.

The Wests are scheduled for sentencing at 8:30 a.m. after being convicted in the death of one of their adopted children and the abuse of another. Sentencing has been postponed twice before.

Torres Stallings and Hennessy have filed a motion to continue the hearing.

Torres Stallings said she received information last night.

Smith is objecting to the motion to continue, saying the items the defense has listed should not be characterized as new information. Brehmer has agreed and denied the motion in that regard.

Torres Stallings said last night she received info about the possibility of juror misconduct and they want to conduct an investigation.

She said a private investigator contacted the individuals who needed to be contacted, not a juror on the panel, but other people close to that person.

Based on 2 interviews, Torres Stallings said she did not believe it was enough to ask for a motion to continue for further investigation, and upon receiving the info doesn't think it could potentially warrant a motion for jury misconduct.

Smith asked the court to find all circumstances in aggravation true, including the crime had a high degree of callousness and they induced a minor to assist in the commission of a crime.

In response, Torres Stallings said there was on statement by the Wests' eldest child that his parents told him to be quiet. They didn't threaten the boy, she said.

The judge said all circumstances of aggravation have been proven for Trezell and Jacqueline West.

Brehmer said he has reviewed and considered statements filed on behalf of Orrin and Orson's biological family, the declarations and letters submitted on behalf of the Wests.

Hennessy said there is no cause not to proceed with sentencing and made no other comment.

Torres Stallings said she is asking the court to “fashion a scheme that involves some kind of probationary sentence” with minimal incarceration.

She acknowledged it's not usual for an attorney to ask for probation in a homicide case, but she believes this case was unusual in a number of circumstances. She said they have maintained from the beginning Jacqueline West was innocent.

Torres Stallings said she doesn't agree with the verdict but respects it.

“I understand the sanctity that is involved when 12 members of our community deliberate on a difficult case such as this.”

She said she's asking the court for the one and final request Jacqueline West has asked for, a “fair and just sentence.”

Torres Stallings said she's concerned for future clients that they better have surveillance video of people taking their children or no one will believe them.

It's been the defense's position that the boys were kidnapped and the Wests had nothing to do with them going missing.

If Jacqueline West is sentenced to prison, she's asking it being in Oregon or on the East Coast so she can be close to family, Torres Stallings said.

Wiping her eyes, Torres Stallings finished her statement.

Eric Smith said Jacqueline West is not a suitable candidate for probation because she's convicted of murder and abuse, and she was part of the murder of one of the boys and is guilty of willful harm to the other.

“The jury did not believe what they had to see and they continued to fabricate that they did nothing,” Smith said. He said she deserves more than the maximum under the law, which is what he's requesting.

On count 1, Trezell West is sentenced to 15 years to life. That count is second-degree murder.

On count 2, involuntary manslaughter, he received 3 years, punishment stayed.

On count 3, child cruelty, he received 4 years to run concurrent.

On count 6, child cruelty, he received 4 years to run consecutive.

Total sentence is 15 years to life plus four years.

I hope I never have to follow a case with this woman ever again. I have never disliked a defense attorney this much since Jose Baez.

The little boys didn't get to see 4 years. 15 isn't enough. Give 'em both life.
