Monday, November 9th:

*Status Conference Hearing (@ 11am PT) – CA – Laci Denise Peterson (27) & Connor (unborn) (missing Dec. 24, 2002, Modesto; found April 13, 2003 in the San Francisco Bay) - *Scott Lee Peterson (30 @ time of crime/47) convicted & found guilty (11/12/04) & sentenced (3/16/04) to the death penalty. San Mateo County Case #SC055500A / Stanislaus County Case #1056770
He was convicted on 2004 of the 1st degree murder of his pregnant wife, Laci, & the second-degree murder of their unborn son, Conner, & in 2005, he was sentenced to death by lethal injection. His case is currently on automatic appeal to the Supreme Court of California. Sits on San Quentin's death row. Calif. Supreme Court denied a new trial in the guilt phase but reversed the death penalty sentence for Stanislaus County. Also the San Mateo Superior Court will now consider whether there was jury misconduct.

10/23/20 Update: Stanislaus County: Peterson appeared via video from prison today for a Zoom court hearing. Judge's orders prohibited any rebroadcasting, live streaming or screen capture. D.A. WILL retry the death sentencing penalty phase in this case. New hearing set for Nov. 6. Peterson acknowledged that he would temporarily waive time in the case to consult with his new attorney, Pat Harris, which gives him time to consult with his lawyer on whether to put off the penalty phase trial until the judge decides whether or not to throw out his conviction.
The court ruled that a San Mateo Superior Court judge must decide whether prejudicial misconduct by a juror occurred when she failed to disclose that she’d been the victim of a crime and obtained a restraining order against the perpetrator. A hearing in that case is scheduled for Nov. 13. Chief Deputy District Attorney Dave Harris, appearing remotely over video conference along with District Attorney Birgit Fladager, said they wanted to wait for the outcome of that San Mateo hearing before beginning jury selection because they might have to retry the entire case.

10/26/20: Stanislaus County Assistant District Attorney Dave Harris will seek the death penalty for Scott Peterson as a judge considers throwing out his conviction for murdering his pregnant wife, Laci because of juror misconduct during a 2005 trial. 11/6/20 Update: The Stanislaus County 11/6/20 hearing was moved to San Mateo County. 11/5/20 Update: Hearing for 11/6/20 at 8:30am, in Dept. 6 of this Court has been vacated, but hearing (Case #1056770) has been scheduled for 11/6/20 at 10am in San Mateo County court.
11/6/20 Update: San Mateo: Judge Anne-Christine Massullo granted permission for Peterson to appear telephonically. Defense attorney Pat Harris present & Peterson appeared via video call. Peterson waives right to speedy trial, new date set for 2021. The hearing on Nov. 6 primarily dealt with determining which jurisdiction Peterson's upcoming legal challenges should take place in. His lawyers argued both the juror misconduct case & the penalty retrial should take place in San Mateo County, the site of the original trial. Barring any requests for more time, jury selection for the penalty phase must begin by the end of November. Peterson will be appearing virtually because of the coronavirus pandemic. His defense team had previously filed a motion for San Mateo County to take over his appeal case immediately. Peterson had a hearing scheduled in Stanislaus County that has been vacated & moved to San Mateo County. Last month, Peterson also appeared remotely from San Quentin State Prison for a hearing in Stanislaus County Court. It was decided in that hearing that the penalty phase will be retried. The California Supreme Court upheld the guilty conviction in its August judgment. But in October, the same court ordered a new hearing in San Mateo Superior Court to determine if Peterson should be retried. The California Supreme Court ruled a San Mateo County judge must now decide if Juror Nice’s actions constituted misconduct and, if so, whether that misconduct was so damaging Peterson is owed a new trial. The judge’s ruling is subject to appeals, so this could be the beginning of years of court battles. If Peterson’s team gets the convictions overturned, Peterson will likely be fully retried. Status conference hearing on 11/9/20 @ 11am with Judge Massullo & status conference hearing on 1/21/21 @ 10am with visiting Judge.
 
So late to this party -- but there is so little crime in Stanislaus County that this is a priority???

Maybe this county can send spare staff members down to San Diego to review the investigation of Rebecca Zahau's death!

(Yes, I understand that any death penalty decision should be carefully reviewed.)

The judge considering whether Scott Peterson should get a new trial is thinking about ordering the convicted killer transferred from San Quentin State Prison to a San Mateo County jail cell. Peterson's attorneys don't think the move is necessary, as his case makes its way through the legal system again.

That was one of the issues discussed on a conference telephone call about the case Monday morning.

On Monday, Judge Anne-Christine Massullo raised concerns that Peterson wouldn’t have “full and adequate access” to his legal team if he remained at San Quentin.

The judge said she wanted to get a transfer done before issues, like a potential uptick in coronavirus cases, make that impossible.

Peterson’s attorneys, however, said that access to their client at San Quentin hasn’t been a problem. They raised concerns that if he’s transferred to jail in San Mateo County it may, in fact, be more difficult to consult with Peterson.

Attorney Cliff Gardner said he would check with jail authorities by Nov. 16 on their policies for visitation of inmates then provide an update to the judge.

Also Monday, the judge granted an extension to prosecutors to file legal paperwork over whether Peterson should get a new trial. They now have until mid-December.

She scheduled a status hearing for Jan. 21, which is the same day another part of Peterson’s case will be back in court in San Mateo county.

There was a chance the judge could have sent him to the San Mateo County Jail to make it easier for his attorneys to meet with him. But Peterson’s lawyer Pat Harris said Thursday that San Quentin was a better place to hold him because of the ongoing coronavirus pandemic.

“It is a better situation than what would occur in San Mateo,” Harris said, while leaving open the possibility that Peterson’s team would seek to have him moved “down the line.”

It marks a reversal from just a week ago when Harris told the court that he was having difficulty communicating with his client. Since then, San Quentin has provided Peterson with a typewriter and allowed him to write letters.

It appears that the so called "new" witnesses aren't new at all. They are the same Laci sighting witnesses that Geragos decided not to call during the trial. Geragos decision wasn't surprising at all considering that two of them saw Laci at the same time almost a mile apart. Which would most likely cast doubt on all of them.There is a mystery witness also being tossed around. I'll take the wait and see approach to all of the above.

Eighteen years after Laci Peterson was last seen alive before being killed by husband Scott Peterson, her family is concerned that he will be freed from prison.

Peterson, now 47, scored two major legal victories this year. The first victory was in August, when his death penalty sentence was overturned, meaning that he would face a new penalty phase trial. The second victory came in October, when the California Supreme Court ruled that a lower court should take a second look at his case to determine whether his guilty verdict should be overturned.

Laci's family is still struggling with this year's developments.

"This Christmas is different than last Christmas," says a source close to Laci's family. "The holidays are always hard for them because Laci was taken from them on Christmas Eve. But now, with the thought that Scott could eventually go free? That's devastating. The family is really worried."

Peterson has always maintained his innocence, and he plans to prove it.

One of the most compelling new witnesses, according to one source who asked to be anonymous, will be Dr. Phillipe Jeanty.

Dean Johnson, a former San Mateo County prosecutor who closely follows the Peterson case, explained the significance of Dr. Jeanty.

“Dr. Jeanty invented a protocol for estimating — if you have a stillborn child — for estimating how old the fetus was. How long the fetus had been in the mother’s womb. He invented this protocol.
A prosecution witness testified, based on allegedly the Jeanty protocol, that Scott’s unborn son, Conner, was a certain age,” he said.

“Dr. Jeanty said the doctor who testified used the wrong data. He used it incorrectly. And he came up with entirely different information. And Dr. Jeanty will say he believed that Connor Peterson was put in the water of San Francisco Bay some days after Scott Peterson went fishing,” Johnson said.

The second new witness who the original trial jury never heard testimony from will be Russell Graybill. Graybill is a mailman who delivered mail to the Peterson’s house regularly.

The Peterson’s dog, Mckenzi, always barked at the mailman. But the day Laci vanished, Mckenzi did not bark.

A third set of new witnesses are neighbors who say they saw a woman and dog matching Laci and Mckenzi’s descriptions out walking after Peterson left their Modesto neighborhood. Laci was eight months pregnant at the time.

Frank Aguilar is one person who claims to have seen Laci out walking the dog sometime between 9:30 and 11:00. Another alleged eye-witness of Laci walking the dog that morning is Diane Campos.

11/13/20 Update: Prosecutors on Friday released their court filing listing the aggravating factors & special circumstances they say should again bring Peterson the death penalty. Prosecutors said they intend to once again introduce as evidence “an edited portion of the memorial service” held after the bodies were found. They also plan to introduce a statement from at least one witness who testified at his original sentencing but has died in the intervening 15 years.
 
Peterson has a hearing coming up on January 21 in San Mateo County Superior Court, where he will likely appear via a livestream from San Quentin Prison.
