"In yet another update on the Malibu Creek State Park Shootings case you will only read here on The Local Malibu, it was decided on September 4th, that Anthony Rauda, accused of killing Tristan Beaudette last summer while camping at Malibu Creek State Park, will be spending considerably more time in jail.

The wheels of justice came to a grinding halt in a Van Nuys Courtroom on Wednesday when the judge proceeding over the matter agreed to push the preliminary hearing more than 6 months out, into the new year, further denying the alleged shooter’s right to a speedy trial.

However, in an interesting turn of events, it seems the defense is the one that asked for additional time. The request was apparently made in advance to the hearing and it was granted.

The Preliminary Setting and/or “Readiness” Conference was moved until March, 2020.

It is a well known fact that Anthony Rauda, who appeared in court Wednesday behind glass and strapped to a chair as he has been in previous court appearances, has requested to change attorneys openly stating he does not trust his public defender...."

November 5, 2019: Man Indicted for Murder of Camper in Malibu State Park, Trying to Kill Others

A man has been indicted for the fatal shooting of a camper and attempting to kill 10 others in connection with a series of shootings over a two-year period, the Los Angeles County District Attorney’s Office announced today.

A grand jury returned the superseding indictment against Anthony Rauda (dob 7/30/76) on Oct. 21 for one count of murder, 10 counts of attempted murder and five counts of second-degree burglary. The indictment was unsealed today.

The defendant pleaded not guilty to the charges at a morning hearing and is scheduled to return for a pretrial hearing on Dec. 5. Case BA476023, which contains the same charges, supersedes case LA089735.

Deputy District Attorney Cynthia Barnes of the Major Crimes Division is prosecuting the case.

Rauda allegedly shot at unsuspecting campers or motorists dating back to November 2016 when he is accused of wounding a man who was sleeping in a hammock in the Malibu State Park area. Less than a week later, he allegedly fired into the sleeping area of a vehicle.

Rauda also is accused of shooting into vehicles on three different occasions in 2017. No one was injured.

The defendant allegedly shot at a Tesla on Las Virgenes Road on June 18, 2018. Four days later, he is accused of killing Tristan Beaudette, 35, who was shot and killed while in a tent with his two daughters in Malibu Creek State Park. His children were not injured.

Rauda also has been charged with several burglaries that occurred in the Calabasas area.

If convicted as charged, Rauda faces a maximum sentence of more than 265 years to life in state prison.

The case remains under investigation by the Los Angeles County Sheriff’s Department.” (BBM)

hmmm... strange I had those charges already in my notes from Jan. 22, 2019 when he got arraigned. Nothing changed as far as I can see on the charges.

Court site has next hearing (Further Proceedings hearing) on 8/14 & Preliminary hearing on 9/17. 8/14/19: The case will now move forward to a Preliminary Setting Conference on September 4th, followed by a Preliminary Hearing set for Sep. 17th, 2019, which was cancelled.

The grand jury transcript related to the indictment of the alleged killer of a research scientist from Irvine — who was shot while camping with his two young daughters in Malibu Creek State Park in 2018 — will be unsealed, a judge ruled Monday.

Defense attorney Harry McKee argued that the transcript and exhibits were prejudicial to his client, but Los Angeles Superior Court Judge Charlaine Olmedo denied his motion to keep the information under seal.

LOS ANGELES — A man charged with killing a father who was camping with his daughters in a Southern California park had to be subdued in court on Monday [3/30/20] after the judge refused to allow him to defend himself without a lawyer.

Anthony Rauda attacked a deputy during the hearing and was restrained, NBC Los Angeles reported.

The case was continued until May 5, the news station said.

At a previous court appearance, he wore a mesh hood to prevent him from spitting or biting.

If convicted, Rauda faces up to life in prison.

(nuhnk proh tuhnk) adj. Latin for "now for then," this refers to changing back to an earlier date of an order, judgment or filing of a document. Such a retroactive re-dating requires a court order which can be obtained by a showing that the earlier date would have been legal, and there was error, accidental omission or neglect which has caused a problem or inconvenience which can be cured. Often the judge will grant the nunc pro tunc order ex parte (with only the applicant appearing and without notice). Examples: a court clerk fails to file an answer when he/she received it, and a nunc pro tunc date of filing is needed to meet the legal deadline (statute of limitations); a final divorce judgment is misdirected and, therefore, not signed and dated until the day after the re-marriage of one of the parties-the nunc pro tunc order will prevent the appearance or actuality of a bigamous marriage.

3/30/20 Update: Rauda had to be subdued in court on Monday [3/30/20] after the judge refused to allow him to defend himself without a lawyer. Rauda attacked a deputy during the hearing & was restrained. The case was continued until May 5. Had a Review check hearing on 4/15 which was vacated due to the coronavirus. Then pretrial conference & trial setting hearings on 5/26.

5/1/20 Update: Pretrial conference hearing on 5/5 & trial setting hearing on 5/26 have been cancelled. Next Advancement hearing on 5/12, Check hearing on 6/3 & pretrial conference hearing on 6/22. 5/10/20 Update: Hearing on 6/3 has been cancelled.
