If they reach a verdict today I wonder if we will hear it today or have to wait til Monday.

Who in the world really knows. Like I said, CA cases seem so different than many other states in what they do and at the slow pace they do it.

This has to be so hard on Sierra's family with all of the down times they have had to endure.... not only during the trial phase.. but now in the sentencing phase. Do they ever work a full long day or put in a full week when they are presenting criminal cases or when the jurors are deliberating on very serious cases?

When I did jury duty we deliberated until 1:00 AM and the verdict was read at that time. We were polled by the judge to be sure our verdict was unanimous. We did not have to decide sentencing so our job was then done...but we were either to arrive at a verdict or be sequestered. We all chose to keep on into the night.

I don't know if that court where I served still operates that way but imo if you are in the middle of such important discussion as those that happen during the deliberations phase it makes sense to keep going regardless of what time it is. There are good times for breaks and not so good times and I think it is best for all involved if there are no breaks at those not so good times.

It does seem odd that there is no court on Fridays in many jurisdictions out west. With court dockets being so full, everything so backlogged for much of the year, the shorter work weeks do not make sense to me.

Emi, I've meant to ask. Many of your posts are blank? What does that mean?

I think it is because she posted a tweet from Tapatalk .... did you, Emi? I vaguely remember another thread where we had a similar problem and some of us could not see them. I am not sure on this, though.

Good grief, I have never seen anything like this. So casual, and nonchalant and time off seems far more important than actually deliberating.

Prayers for Sierra's family.

keep in mind they have been through this since end of Januarry
also one of the jurors is an alternate one so not the original juror

Seems to me they would want this over and done with, given they have been living this for so many weeks now. I am glad they are not rushing through the process but good grief they could put in an occasional full day, imo.

I wonder if a juror has a personal/health issue that is not pressing enough for them to leave jury duty but still requires clinic visits, or whatever.

That's a long time to devote to something that isn't really about you or yours. However, an alternate juror at this phase should not hold things up--the alternate has to accept the guilty verdict and consider only what has been presented as mitigating in the penalty phase to arrive at a verdict in this phase. The alternate sat through the trial; the fact that he/she was not in deliberations at the first stage doesn't matter for sentencing. The alternate has heard the same mitigating factors as the other jurors.

I have high hopes for this jury to reach the correct penalty. They seemed to see through the non-sense and found AGT guilty. IMO I saw more of the same non-sense (pesticides or poverty) in the penalty phase. Justice for Sierra, her family and friends!!

From Google Alert - thought I'd share!

If there is a hung jury, Clark says life without parole would be the default sentence.

But he says the DA could then seek to retry the penalty phase after consulting with the LaMar family.

Oh?

 I did not realize there was an alternate put into place!! When did this happen?? What happened to the "original" juror?? What did I miss??!!

Well - see you all Monday, I guess!

Niner, IIRC, the original juror had a trip that had been planned for some time prior to the trial and it was known that he or she wouldn't be available after a certain date. Fortunately, he or she did make it through the guilt phase of deliberations before they were replaced with the alternate. Someone please correct me if this is not right.

*and.... just a note because I have been asked a few times, and since my page has 9.38+ million views...
No, I don't get paid per file view or per page view, I have not been paid a cent.
I actually pay photobucket for the account and extra storage.
The work is not mine anyways. The time is mine though, and it is an effort of love/hate.

We all appreciate your unbelievable hard work for the missing/lost and trials that ensue. Blessings to you. :heartbeat:
