IOU, Cannot Collect?
From your link:
adam_paulin.jpg

...A quote from the article: “Recently, in her (Mary’s) basement, she discovered an IOU Barry wrote to her mother in the 1970s for monies advanced when he was starting out in business. It is an IOU she has not been able to collect on.”
@Lexiintoronto sbm bbm On seeing a stmt like Mary's, I wonder from an outsider's viewpoint & business angle about unknowns---

1. Did the ^ IOU/doc include typical loan terms? For ex, principal $ amt loaned, interest rate, maturity date, payment schedule, date, acceleration clause, unsecured/collateral given, etc? IOW, terms sufficient to legally enforce in ct?
Or was it "To Honey's mom, IOU. Barry." w nothing further? Standard version on matchbook or deluxe version on back of envelope . lol. j/k .

(Ignore statute of limitations issue.)
2. Does it seem likely if Mother asked BS, politely or otherwise, that he would have been unable to pay or refused to pay?

3. Is it possible Mother forgave the debt and signed a doc to that effect, gave it to BS?

4. If BS did repay Mother, did he not insist she return IOU itself? Is it possible Mother acknowledged payment in full? Did she sign a doc, or endorse check(s)?

5. Did BS transfer stock in Apotex/predecessor co, or other property to her to pay loan?

6. Did BS pay her living expenses as loan repayment?

7. In article, she "has not been able to unable to collect; is "she" Mother or Mary?
(a) Is there evd/documentation of Mother attempting to collect from BS? Filed in ct?
(b) Is there evd/documentation of Mary attempting?

8. When Mother died, & if loan had not been repaid, forgiven, etc, in probate ct, was
(a) IOU debt listed in doc's filed w ct, to collect w other debts owed her/her estate?
(b) was IOU debt treated as an advance, deducted from HS's share of estate, if she signed?

8. Did Mother & BS treat IOU w a wink & a nod, neither intending to pay or collect?

Lastly, did journo KD pose these questions to Mary? If so, did she evade, refuse to answer?
Did she show him IOU or doc's corroborating attempts to collect?

Not concluding anything, just considering possibilities and unknowns.

Many lined up at the ‘Bank of Barry’ Sherman: Inside the $10 billion succession battle
''The families of both Barry’s sister and Honey’s sister were also given financial help. For example, according to documents in a lawsuit filed by the son of Honey’s sister Mary Shechtman (he is seeking information on the Shechtman family trust and a court order removing Mary and her husband Allen Shechtman as trustees and replacing them with a corporate trust company), the Shechtman trust owns 17 houses. Insiders say those were purchased with Barry’s assistance over the years.''

''Mary has disputed characterizations of her as someone who has lived off her late sister and her husband. She said her parents provided seed money for Barry in the early days and over the years she has worked hard on real-estate projects for the Shermans, earning everything that was paid to her. Recently, in her basement, she discovered an IOU Barry wrote to her mother in the 1970s for monies advanced when he was starting out in business. It is an IOU she has not been able to collect on. So frosty is her relationship with the Sherman children that Jonathon evicted her last fall (he said his father had given her a rent-free unit but the management company he hired insisted that Mary pay rental) from a storage unit his self-storage company owns in Ajax. Mary’s spending habits were mentioned in passing in the police search warrant-documents released following a Star court challenge. Honey’s assistant was quoted as telling police that while Honey never spent much money on her credit card “it was Mary who spent a lot of money at U.S. Saks and Barry was never to see those bills.”

WOW... what a KD article :)

it is posted out there breaking copyright laws......... anyway, i wish newspapers had more pricing models. i would have gladly paid $5 or $10 for this one long article. but i hate signing up for monthly fees. i find they spiral out of control...... another good model would be $0.25 per article and you get access to all kinds of newspapers for this.

anyway, as to the article, here's what i got from it,

1) police focussed on "estate issues" as key to murder case......... but never really expanded upon. just sort of hangs there............ similar to "JS and HS hated each other" from KD book. never really expanded upon

2) BS net worth = $10B... $1B (in cash?) in Bahamas....... just estimates of course. i personally think $10B is high (it is C$, not US$ of course).... Apotex plus taking (my estimate) $50-$100MM in dividends each year. then invested in real estate and stocks... apparently BS did make $2B score from Barr Labs (sold to an israeli firm.. presumably Teva)

3) Schacter family.... from old article, patriarch has to drive taxi in florida to make ends meet....... OOPS, apparently they own 17 houses, and BS was very helpful in this......

4) youngest daughter bot expensive car a few days after murders after BS wouldn't give her the money for the car.. she said he changed his mind days before the murders.... i don't see it as motive, just interesting.... personally, i was confused on daughters. i thought Alexandra - toronto-based nurse who's worked with indigineous communities and homeless - was oldest, but she is 2nd oldest daughter, much younger than her sister Lauren. Lauren is whister-based yoga pro and new age nutritional consultant.

5) MS son was using, with permission, HS credit account at big name expensive manhattan stores......

6) there was likely not going to a be a "bank of HS" if BS had died before her....... she was not in favour of giving kids lots of $$$$$.......... it's been stated in earlier article. but older kids got tons of $$$$, 2 younger ones not as much (but i still think alot by any reasonable person's standards)

just some personal observations from the article (not much to do with the case):

1) how often are rich (jewish?) Torontonians in Manhattan? it seems constantly by Sherman, Schacter (schactman?), real estate agent, apotex execs etc. etc.... do some people go 15-20 times per year? i mean NOT for business. just weekend shopping/shows/dinners/etc.

2) what % of the younger population is gay? males especially...... it is incredible the number of times i see/hear reference to man and their "husbands".. don't see it near as much with women and same sex partner........... i am and always have been very supportive of the gay community..... i am just surprised how often i see reference to it these days.

and a further "divorce vs. inheritance" marital comment/question:

i don't understand the logic of inheritance and long-married couples...... say the Xs were married 55 years and Mr. X is worth $10B. if he dumps Mrs. X for young hottie (doesn't really matter), she gets half of the $10B that he/they earned over the marriage. basically Mrs X gets half of the wealth earned during the marriage....... so by the same logic, if Mr. X dies, why does she not get 100% of the wealth earned during the marriage.... and of course, i'm assuming Mr. X had no wealth (or $1M or so when they got married)

btw, i knew someone in Toronto who had a net worth of $20MM. $10MM part-ownership of an investment firm. $10MM houses, cash, stocks, art............ he got divorced but instead of splitting everything 50/50, which would have been a mess, he kept the investment firm position, the wife got 95% of the rest...... and GUESS what happened?................

Respectfully, do you have a link for this? What is the significance of this information? Tx

someone posted and asked how could ms have possibly known about the witness confirmation/attestation being executed after the Sherman’s deaths. she was aware because she knew at least one of the witnesses that signed the codicil/document. So she could have found out that way.

I appreciate the fact that KD is keeping the Sherman case in the news, and reminding us that LE still has a responsibility to solve this case.

But I am the only one here that feels like his articles on this case are becoming a bit like reporting one would see in the National Enquirer?

I wish he would stick to reporting things that relate directly to the murder case, not instead about Mary’s son’s family challenges or what the Sherman daughters kids do for a living,, etc. I am sure the families don’t appreciate all of this stuff being published.

After reading yesterday’s article I almost felt like I needed to take a shower....
Moo

Personally, I'm grateful for KD's articles.

I'm not sure if it is standard practice for police to do videotaped interviews with family members of murder victims soon after their deaths? Does anyone happen to know?

In my interview with Jonathon, he said he had distanced himself from his father’s many businesses in the two years leading up to the murders. Jonathon told the homicide detectives the same thing, according to portions of his police interview released by the courts as part of a Toronto Star challenge to unseal search warrant documents. So removed was he from the business, he told detectives who conducted a videotaped interview with him during the shiva that if they wanted to learn about his father’s business, Jack Kay and Alex Glasenberg were the ones to speak with.
Outline - Read & annotate without distractions

(Note: Shiva lasts for 7 days after the funeral, according to this information below):

Following the funeral and burial in the Jewish religion the immediate family begins the first structured period of mourning referred to as the shiva. This is a seven-day mourning period during which mourners generally cease working to mourn the loss of a loved one. During the shiva, it is customary for mourners observing shiva not to leave the house to go to their workplace or carry out any work-related tasks during the weeklong period.

''When Honey Sherman and her girlfriends drove north to a friend’s cottage for the weekend, she always insisted on stopping off at The Sweet Oven in Barrie to pick up several cardboard packs of butter tarts.

Her husband, Barry, also had a sweet tooth and would wander around Apotex, his company, looking to see if anyone had chocolate. Once he was mistaken for a cleaner. His son Jonathon recalls that when they had lunch to discuss his storage business, they always ate at Swiss Chalet.''

@ approx 3:15 KD talks about how the close friends of the Shermans are supportive of KD's efforts.

Imagine for a moment, that you bumped somebody off, and attempeted to make it look like a suicide. For some time this ruse appears to work, but then it is declared a murder.

Now the cops are investigating, what would your strategy be now?

*Keep a low profile?
*Declare you do not need the money, and will likely give it away now that you have inherited a pile of money?
*Provide an alibi, even to people who did not ask for one?
*Be confident that they will not find enough evidence to lay charges?
*Hope that no more newspaper articles are published?

The Shermans are not alone, unrelated but relatable..

At 93, She Waged War on JPMorgan—and Her Own Grandsons
''It was a June day, and the Atlantic shimmered beyond the balcony of her Florida condominium. Beverley studied an independent review of her accounts as family and lawyers gathered around a table and listened in by phone. The document confirmed her worst fears: Her two financial advisers at JPMorgan Chase & Co., who oversaw more than $80 million for her, had run up big commissions putting her money in risky investments they weren’t telling her about. It was the latest red flag about the bankers. There had been missing account statements. Document shredding. Unexplained credit-card charges.''

''Although some relatives urged Beverley not to make waves, she was resolute. What the money managers did was wrong, she told the group. They needed to pay, she said. Even though they were her own grandsons.''
“They made a lot of money on me, those kids—a lot of money,”
Beverley said in an interview before the ruling.''

haha...……. I see the comment about "wanting to take a shower after reading the article"... I thought the exact same thing word for word (a friend of mind likes the expression)

as per KD and gossip, I don't see how it's any different from authors writing about OJ, menendez brothers, paul bernardo etc. etc.... it's what the public wants. not saying it's right, but it is what it is.

and along the same lines, I have been doing a deep dive on OJ Simpson case (Dunne, Schiller, Gerry Spence, Faye Resnick etc. etc.)…. was watching Kato Kaelin testimony on youtube.com. they are asking (can't remember prosecution or defense or both) him what the 4 police officers who knocked on his door at 5 am were wearing. even though it's not in dispute who/when/what the 4 police officers were at his door...….... talk about minor minor details and irrelevance.

Timeline update. Added in details of the day the Shermans remains were found, and a few other key dates. Almost finished.
Just a note that Toronto Star reporter and investigative journalist Kevin Donovan represented himself, and on behalf of the Toronto Star, in court for the last three years, in an ongoing effort to have police and court documents unsealed in this case.

  • 8:25 am, the housekeeper and a personal trainer arrive at the home and find the house alarm was deactivated, which was unusual. Also irregular is that the newspaper is still outside on the front step. (My note: shouldn’t there be two papers outside? Thursday’s and Friday’s?) A furnace technician arrives to do routine maintenance. Honey’s SUV is parked on the circular driveway, her usual parking spot.
  • The housekeeper goes upstairs to try to locate Honey, but does not find her. The bed is made, but is slightly messy. Normally she would expect to find the bed unmade, and clothes for washing, but there are none. Honey normally would use a sink in the morning, but the sink is dry.
  • The personal trainer leaves.
  • (Time unknown) The housekeeper hears a cell phone ring. She finds Honey’s cellphone on the floor of the powder room by the front door. She picks it up and places it on the counter.
  • The housekeeper starts her cleaning routine upstairs, working her way down.
  • 10:45 am (time approximate) Sherman real estate agent Elise Stern arrives to find two prospective buyers and their agents waiting to tour the home. They start upstairs and make their way to the basement where there is an indoor pool.
  • Stern leads the way down the basement corridor to the pool area. She finds a pair of gloves and a home inspection report on the floor, close to the doors leading out to the indoor garage. She picks them up and places them on a (ledge or table).
  • Stern enters pool area and glancing in, sees what appears to be the the Shermans, unresponsive, in semi-seated position with belts attached to their necks, tied to pool railing. Stern quickly ushers the group upstairs. Stern is unsure about what she saw.
  • (Time unspecified) A gardener arrives who routinely waters the Shermans’ indoor plants.
  • (Time unspecified) The prospective buyers and their agents left before first responders arrived. They were unsure as to what they witnessed (the agent is quoted as saying it looked like a ‘fake’ murder scene or Halloween display, and the clients were upset as they considered it to be a bad omen.)
  • Stern tells the housekeeper about finding the Shermans, and asks her to check the pool, but she is too afraid to do so.
  • The gardener says she is not afraid, and goes down to check, and finds the Shermans obviously deceased.
  • While the gardener is downstairs, Stern calls Honey’s sister Mary.
  • [Note: This is from page 10 of KD’s book—KD writes that Stern called Mary, and Mary told her to hang up and call 911. Mary then calls the Sherman children, reaching Jonathon first. Donovan writes that there is a delay of 90 minutes from the time that the bodies are found to when 911 is called....however, according to the court documents that were released after his book was published, the 90 minute estimate may be incorrect.]
  • 11:44 am or 11:45 am, Toronto Fire Department and Paramedics respond to a 911 call from real estate Agent Elise Stern, made from the Sherman home. “Someone has killed my clients,” Stern shouted. “They are dead.” she frantically relayed to an emergency dispatcher.
  • 11:54 am, Toronto Police arrive at the scene.
  • In the late afternoon, outside the Sherman residence, Police Const. David Hopkinson told the press that had gathered that circumstances of the deaths “appear to be suspicious,” but noted they are not looking for any suspects and that there were no signs of forced entry.Apotex billionaire Barry Sherman and his wife Honey found dead

I think KD is justifying his exposure of intimate details of the Sherman kids and relatives because TPS stated that Barry Sherman's will (and estate) was embedded in their homicide investigation.

He is presenting the background and dynamics of how this extended family functioned, and has now been torn apart. It is all about the money, and I think that is what KD wants to reveal, which seems in line with TPS's statement.

Although KD states that close friends of the Sherman's approve of his investigative pursuit, I think he has has gone too far in revealing some private and personal information that was unnecessary and irrelevant for public knowledge of this case. jmo

i respect your opinion... and i think there is a line between salacious and responsible.. and i don't know where that line is.... and i'll admit. i like salacious.

i certainly don't like the other side of this, where the S's because of their wealth and power seem to have different rules than the rest of us. (i understand because of wealth and status they have alot more prying into their affairs too)

Lexi thanks for the lengthy timeline. FYI the TPS website continues to state that police responded at 12.46, not 11.46 as has been generally circulated.
I don’t know why they can’t fix this if it is an error.......
