While the intent of Congress was certainly to“move things along”, the actual effect of this legislation may very well be the opposite; it should further complicate the pre-trial and trial stages of these cases, giving the defense attorney the opportunity to truly investigate her case at a level she has been unable to do before, thus creating a more complex trial, an even more complex record and expanding rather than contracting the scope of litigation.

That folks.....is their strategy..........technicalities, creating work overload, and accusing anyone and everyone of misconduct. They have IMO....nothing else!

I think, Cheney still has a strong feeling about Casey being guilty, but he is on board to help prevent her from getting the DP. IMO

A defense non strategy is having the trial start the day after MOTHER'S DAY next year...yikers I wouldn't want that day fresh in jurors heads when starting a trial.

Snipped
The defense specifically wants Perry to provide it access to George Anthony's grand jury testimony, as well as records from the volunteer search group Texas EquuSearch.

So does the bolded above mean that George and Cindy are next in line to be the SODDI?

What!!! JB can't ask GA directly what he said to the GJ when they meet up face to face to exchange letters? :waitasec: Oh for the love of .......... there are no proper words to use here which meet TOS standards.

Oh, DANG! I hadn't even thought of that! Talk about the biggest karma kick in the butt EVER. Oh, I hope the prosecution says something about that in their opening statements. Wouldn't that be a powerful way to get everyone's attention?

"How ironic that they day after Mother's day, a day Casey Anthony should have celebrated for the sixth time, the trial for the murder of her own daughter starts. And she sits as the accused, a mother no more for three years now by her own hands. Some will try to say she was the mother of the year, but those of who celebrated Mother's day just yesterday remember that real mother's of year love their children, and certainly don't murder them. The evidence will clearly show that not only is Casey Anthony not a good mother, she could only be called a mother as a product of biology without ANY maternal instincts. Her only instinct was for her own interests, certainly not befitting of a real mother worthy of celebrating on Mother's day."

That's just an example, but still. I don't think there's any defense strategy that will possibly work when you add in Mother's Day to the duct tape, lies, bloody money, and so on. Thanks for bringing that point up, MD Mommy! Wow, the defense is even worse off than I previously thought!

not to mention the irony of Caylee going missing the day after Fathers day....

It does shout out from his body language while CM is sitting next to KC at the table. No love lost between those two. jmo

I was just about to state that same thing...there really isn't alot of compassion towards either...even kc is different when he is there--there are not so many smiles and such....

That said I am glad that the Judge did state she has to be there --- anyways we don't just talk about her appearance -- I have seen comments about the rest of the group....not just her--

I agree. I imagine she thinks he cramps her style. NO chit chat or pencil battles. Suddenly she's not quite as thrilled/amused with attending Court, and would like to be excused as she is so busy at the Jail...

ITA Judge Perry is not so relaxed and jovial, no sense of humor. At least not like Judge Strickland. And I do notice how he takes every opportunity to remind the court that this is a murder trial, a death penalty case in which there are two options if found guilty. Death and LWOP. I do not think Casey can deal with it. She knows the cameras on her. I do not think she's capable of honest emotion unless it's for herself. JMO.

Go JBP for making her attend all necessary court dates! :gavel:

JP is on high alert with all that has been going on. I believe he has gotten where he is today because he is straight and to the point, no nonsense. Not to say anything negative to JS but he expects the attorneys to act in a professional manner in his court or else. He is demanding structure where defense was permitted to do what they wanted in the past. jmo

Personally, from the take I got from the letters, is that she is excited and happy to go to the hearings. Not only does she get to see her family but it's a huge change from the same same same of the jail. And she gets to wear regular clothing.

I think that it is Baez that doesn't want her to attend the hearings, which is a great way to exert control over his client.

The letters were written a year and a half ago. She has been exposed by these letters. Her remarks about her brother and her father, her mother are all out in the open. I believe she could sense that JS was a fair judge and she was not facing reality. This judge let's her know what she is in for should she be found guilty. This judge has clearly sent the "elephant in the room" packing. Don't think KC likes hearing the truth. Wants to hide away in her cell. jmo

Yes LC ITA. I thought JS was a very good judge, but do agree his court was relaxed, maybe a bit too much and lacked structure/organization that JBP has. Nothing against JS just two completely different types of judges ruling the bench. I also think that now the harsh reality of exactly what she is facing is smacking her in the forehead squared. Now it isn't just words death penalty and lwop, it is actual reality. Maybe Casey is even beginning to realize she will never ever again walk free as a bird as she had convinced herself.

I am so glad and thankful for it too. IMO it was a great move on the part of the defense in as far as seeking justic for Caylee and helpful to the prosecution IMO.

You know I was suspicious of the letters from day one. First of all Casey just latches on to people and then uses them IMO. I think the RA was just unfortunately another tool for Casey to use. Warped none the less. It seems clear that she was attempting to twist on more of her storytelling. I just don't get what she expected from it in reality? I am not sure why but my gut feeling is that the defense is going to completely use GA,CA and LA. I have a sense they are going to get thrown to the wolves! JMO

I agree. Although of course this is just my opinion, I think there are two reasons why Mason asked for her to be excluded from the hearings:

1) Now that there is more talk about what Casey is up against, thanks to JP, she simply does not like being reminded of what is really going on. The truth hurts.

2) I also think Mason schooled Baez on the fact that ICA does NOT look sympathetic in court. I believe Baez let it slide, so as not to offend ICA, and never told her to cut out the inappropriate grooming, smiling, giggling, etc. I believe either Mason or AL finally told Baez to get her together. I believe they realize that she just isn't a very good actress, and the less of her we see, the better....

Watch out JB,I think the same bus that you and AL are using to run over GA/CA will be
used to drive over you, with CA in the drivers seat if she is convicted. If anything happen
in his offices,(while she was there 6-8 hours a day),in the prison while he was visiting her
she will use with another lawyer to throw JB under ,believe me Casey is not going "down"
by her self.JMO

This Article’s specific premise is that death-qualified jurorsperceive individualizing evidence as more trustworthy, thus allocatingmore weight to such evidence. If an identifiable difference exists, thiswould be particularly noteworthy considering that an increasingnumber of legal scholars and forensic skeptics are now questioningwhether the forensic individualization sciences are supported bylegitimate and verifiable scientific laws, principles and research.Accordingly, because excludables are more critical of evidence in jurydeliberations, removing them unquestionably affects how capitaljuries evaluate forensic individualizing evidence.http://www.law.siu.edu/research/28winterpdf/colley.pdf
Which explains why they want so many INDIVIDUAL experts.and....

In particular, as thesecases highlight, hair misidentification has played a substantial role inmore wrongful convictions than any other individualization science.232The heightened inquiries surrounding the forensic science communitycan also be attributed to several crime lab scandals involving fraudulentor inept forensic scientists.

Which explains why they are making such a HUGE deal over the stray hair that can't be identified!!!!!!!!!!!!!!!!!!!!!!

Ewwwww. This might be a great defense tactic and it's right up KC's alley
("My brother and father might have molested me since my training bra was out of place when I was too young to have *advertiser censored* or my breast implants...ooops, I mean when I was 14")

I can hear it now. "I was sexually abused by that evil man, Mr. Baez, and I was terrified of him so I, uh, I, uh didn't ask for different legal representation even though I recognized that he was incompetent."
