I wonder what's the hold up on filing the appeal?

:waitasec: I am "guessing" that Jose is trying to get Ms. Fryer to do the appeal ... he had her do the "dirty work" at the hearing ...

:waitasec: If she has any "brains", she would "jump ship" and get away from that bunch as fast as possible ... seriously ... I know she is with Mason's office, and ? maybe ? at one time he had 'credibility' ... but now he is with Jose Baez ... and if she wants a career, she ought to "run" from him as fast as she can ...

correct me if I'm wrong, but it seems to me you need grounds for appeal and it might be sort of hard SINCE SHE ALREADY PLEAD GUILTY! Sorry, being sarcastic. It very well may be that's the case in some part. Seems to me this is a lot of work and JB or someone has to do it for free, maybe everyone's telling JB it's a waste of time? Why do the work if it's going to fall flat?

Sounds like it's coming soon, and according to this, the grounds will be lack of jurisdiction of Judge Perry. Included are some interesting comments/observations from Richard Hornsby.

Within the coming days, Anthony's defense team will appeal the order to the Fifth District Court of Appeals in Daytona Beach.

In that challenge, Anthony is expected to argue that Perry does not have jurisdiction to order probation now.

"It's going to boil down to the the simple fact can you do probation in jail?" Orlando attorney Richard Hornsby said.

Thanks for the links, I just honestly thing the appeal with inevitably be lost, seems to almost everyone it was intended to begin upon release, but hey, crazier things have happened in this case, like an aquitall....:banghead:

No lawyer here, so I have no clue which way it'll go, but I know which way I want it to go! :D

But in a perfect world, I'd wish she wouldn't be able to appeal at all, as it's just one more example of the abuse this team of lawyers keeps piling on the patience of the FL taxpayers (like me). Talk about head-banging! :banghead::banghead::banghead:

I just don't understand how anyone can do probation in jail. The whole idea of probation is an individual going from an environment of total control (jail) in which the individual has no control, to an environment in which the individual now has control over their actions, but must prove to the court that they are able to to do the right thing..............maintain a job, follow all laws, and meet financial obligations.

An individual can't exercise the freedom to illustrate to the court that they're capable of handling freedom and obeying laws if they're in an environment where they have no freedom.
 
I like Hornsby's take on this. She will at least have to start right there in Orange County.

Er....Ms Fryer can't find any grounds for the appeal - no case law, no precedents, etc. etc......:floorlaugh: And "She's feddup and "dontwanna" isn't going to fly.
 
I got an e-mail response today from Simon and Schuster who assured me they will not publish any book by C.A., her family, or her defense team. They have announced this publicly before, but I was glad to hear from them, in response to my protest e-mail.

Clearly FICA has some money to burn if she is going to approve her defense teams continuing efforts to have her probation tossed. For most folks who skated on a first degree murder charge, this would be the next best thing to heaven.

Perhaps it is going to interfere with her next little project.

I seriously think they're looking for someone to take it on (and at State wages or pro bono, no less). Clearly, Baez isn't capable (IMO) of taking this to the next level...CM is probably busy with paying clients and DS...it's just not her area of expertise.

Now why would Baez want to kick JP's order upstairs especially in light of the comments about the DT? I wouldn't want my name and reputation getting slammed twice in the State where I'm practicing law. More career suicide, if you ask me. So...go ahead Baez.

Well, FCA could handle it herself! Oh wait that would defeat the purpose of not going back to Orlando. Wait! The appeals court is in Tallahasee! Yes, she could handle it herself!!:floorlaugh:
 
I think the DT is setting some ridiculous precedents. If every convicted individual appealed every single judgment and sentence, for little to no reason, we would have to pay a lot more in taxes to hire all the new lawyers and judges we would need. It already takes 10-15 years to carry out a death sentence!

JB is intent on pushing this to the ends of the earth! He's making a mockery of the entire judicial system and I wish someone would stop him. Now I read that in the case of Anthony Sowel, his team is going to appeal based on Sowel winking at a juror! It's just too crazy.
