The court directed Blagg’s defense to file an argument about why the stay should not be granted — in effect arguing for the bond set by Bottger on Thursday — by a Sept. 17 deadline. The District Attorney’s office will have 10 days to reply to the defense’s answer after it’s filed.

In seeking the emergency stay last week, Mesa County District Attorney Pete Hautzinger argued that the order letting Blagg post bond violated a portion of the state constitution intended to protect victims and their families. He argued that Jennifer Blagg’s mother was not given a chance to be present last week when Blagg’s bond was set, though she had planned to attend a bond hearing previously set for Oct. 27.
The Supreme Court gave Blagg’s defense until Sept. 17 to argue against the stay.

GRAND JUNCTION, Colo. - The woman accused of the jury misconduct that's forcing the retrial of Michael Blagg appeared in Judge Bottger’s Mesa County courtroom on Tuesday.

Her lawyers waived advisement on a contempt of court charge and also requested that a new judge be assigned to her case. The defense is claiming the judge has strong feelings towards Charlesworth’s actions that is leading to a retrial, and he won't be able to stay impartial.

Michael Blagg denied bail pending new trial in wife's death

A judge has ordered Michael Blagg jailed without bond pending retrial in his wife's shooting death.

After Blagg's conviction was thrown out last year, Judge David Bottger had ruled the case had reverted to its pretrial status, including the reinstatement of a $500,000 bail. Monday, Bottger said he had erred and was now ordering Blagg held without bond.

The Blaggs' 6-year-old daughter was reported missing in 2002 at the same time her mother disappeared and is presumed dead.
No charges were filed in her disappearance.
Jennifer Blagg's body was found in a Mesa County landfill.

Juror in Michael Blagg murder case found guilty of contempt of court for lying about background Apr 30, 2015

GRAND JUNCTION, Colo. -
A juror accused of lying about her experience with domestic violence, triggering a retrial in a murder case in Grand Junction, has been found guilty of contempt of court.
The Grand Junction Daily Sentinel reports a judge ruled that Marilyn Charlesworth "willfully failed" to accurately answer a questionnaire before jury service in Michael Blagg's 2004 murder trial.
She is scheduled to be sentenced June 26.

Michael Blagg’s retrial won’t be happening in Mesa County.

Chief Judge David Bottger on Thursday told lawyers he’ll start the process of searching for a new venue to host a second trial in one of the highest profile murder cases in Mesa County’s history.

Bottger Thursday also vacated a six-week retrial previously scheduled to start April 4, 2016, in his courtroom.
 
July 2016:

Evidence suggesting that Michael Blagg set his house up as a natural gas-fueled bomb to kill his wife can’t be admitted in Blagg’s second murder trial, a judge ruled on Friday.

Mesa County District Judge David Bottger turned down a prosecution request that they be allowed to present testimony about a July 17, 2001, incident in which Jennifer Blagg called Xcel Energy to deal with an apparent gas leak in the garage of the Blaggs’ Redlands home.

Allowing the evidence into his trial would establish an argument that would be “roughly equivalent to Mr. Blagg declaring to the world, ‘I want to kill my wife,’” Bottger said.

Fifteen years after his initial not-guilty plea, 13 years after he was convicted and sentenced to life in prison and three years after a judge ordered him a new trial, Michael Blagg pleaded not guilty again Thursday to all charges related to the 2001 murder of his wife, Jennifer.

First Judicial District Judge Tamara Russell scheduled Blagg for a four- to six-week trial to begin Feb. 20, 2018.
