ARAPAHOE COUNTY, Colo. — An Aurora dentist accused of killing his wife by poisoning her protein shakes pleaded not guilty to the charges against him on Monday afternoon.
James Toliver Craig, 45, made the plea in Arapahoe County Court around 4 p.m. Monday in front of Judge Shay Whitaker, who accepted it after discussion about possibly continuing the arraignment once again.
Both parties agreed that the jury trial will run across three weeks in the spring of 2024: April 23 through April 26, April 29 through May 3, and May 7.

Until recently, going back to the Colorado State Constitution, there was an exemption to that rule. Judges could order people accused of first-degree murder held without bond. But after a squabble over the term Capital Murder (implied a penalty of death (abolished in CO)), and a state Supreme Court ruling in July, the justices concluded that even defendants in those most serious of cases should have a chance to post bond.

From the docket heading, I'm inclined to believe there was a Order granted in El Paso County and the petitioner, most likely representing one or more of the minor children, is seeking to amend the Order to correspond with the requirements at trial in Arapahoe County.
I know that the couple had six children -- not certain how many are minors: The couple had been married for more than 20 years and were parents to six children - five girls and a boy - aged eight to 20.

Defense attorneys want key evidence tossed in murder trial of Aurora dentist
Less than three months before the start of a first-degree murder trial of an Aurora dentist accused of poisoning his wife, an Arapahoe County district judge is deciding whether or not to admit some key evidence in the case.
On Tuesday, James Craig's attorneys argued to suppress Google searches found on the dentist's work computer for several poisons and whether or not they were detectable. Those queries were discovered by detectives through searching the hard drive of an office computer but made from an account called jimandwaffles@gmail.com. The account was a new one, created on Feb. 27, three weeks before Angela Craig died.
The searches included “how many grams of pure arsenic would kill a human” and “Is Arsenic Detectible in an Autopsy?”
During their search, detectives also played a YouTube video accessed through jimandwaffles@gmail.com which showed The top 5 undetectable poisons showing no signs of foul play, according to the arrest affidavit.
Some of these searches, the defense said, were discovered illegally by investigators whom they contend went “beyond the scope” of what they asked for in the search warrant.

Craig, whose hair appears to have greyed since earlier hearings, listened intently to the proceedings, at times even chuckling at some of the comments made by his attorneys. His ankles were shackled and his hands were cuffed from behind, but he was able to lean over to put on his reading glasses to read paperwork on the desk in front of him.
Friends of Angela Craig were in the courtroom to watch the hearing, which took up most of the day, but none of the Craig’s six children were present in person.

Eighteenth Judicial District Judge Shay Whitaker did not rule on the motion to suppress the searches, but said she would make an order soon.
Craig's trial is set for April 23, with jury selection starting April 19 and it could last until at least May 7.

In their continuance motion, Craig's attorneys said that they became alarmed when they were "suddenly and unexpectedly unable to reach Mr. Spiller" and then realized that he had become ill around Feb. 22.
Spiller, who was retained in the case last September and is "an indispensable witness," according to the motion, told attorneys that his prognosis was good. But in order to secure Craig a fair trial, his attorneys asked for a continuance.

I watched his testimony in the Wisconsin trial, and while Spiller put on a bit of a show for the defense the prosecution was able to rebut him pretty much completely. His degree was from a degree mill, he was making calculations that the toxicology association said were inappropriate, and he misinterpreted the data from a scientific paper he disagreed with.

*Status Conference Hearing (@ 9am MT) - CO - *Angela Dawn Pray Craig (43) poisoned (potassium cyanide) by husband & left her brain dead & taken off life support (arrived at hospital on Mar. 16, 2023) & died Mar. 18, 2023, Aurora. *James Toliver Craig (45/now 46) arrested (3/19/23), charged (3/23/23), formally charged (7/12/23) & arraigned (10/9/23) with 1st degree premeditated murder after deliberations & tampering with physical evidence. Held without bond. Bond set at $10M on 6/28/23. Plead not guilty (10/9/23).
Jury selection set to begin on 4/18/24 & 4/19/24.
Trial set to begin on 4/23/24 (thru 5/7/24) 4/24, 4/25, 4/26, 4/29, 4/30, 5/1, 5/2, 5/3 & 5/7/24. No court on Mondays.

1/10/24 Update: Next motions hearing on 1/30/24 @ 9am. 1/30/24 Update: An Arapahoe County district judge is deciding whether or not to admit some key evidence in the case. On Tuesday, Craig's attorneys argued to suppress Google searches found on the dentist's work computer for several poisons & whether or not they were detectable. Those queries were discovered by detectives through searching the hard drive of an office computer but made from an account called jimandwaffles@gmail.com. The account was a new one, created on 2/27/23, three weeks before Angela Craig died. Some of these searches, the defense said, were discovered illegally by investigators whom they contend went “beyond the scope” of what they asked for in the search warrant. Eighteenth Judicial District Judge Shay Whitaker did not rule on the motion to suppress the searches, but said she would make an order soon. Next status conference hearing on 4/5/24 @ 3:30pm.
3/7/24 Update: Attorneys for Craig accused of poisoning his wife a year ago want his upcoming trial delayed because the toxicologist they hired to testify had a stroke. Craig's murder trial is currently scheduled to begin 4/18/24. Defense expert Henry Spiller, a former director of poison control centers in Ohio 7 Kentucky, has testified about the dangers of tetrahydrozoline in other trials — perhaps most recently in the November trial of a Pewaukee, Wisconsin woman accused of poisoning her friend with eye drops in 2018. In their continuance motion, Craig's attorneys said that they became alarmed when they were "suddenly & unexpectedly unable to reach Mr. Spiller" and then realized that he had become ill around Feb. 22. Next status conference hearing on 3/8/24 @ 9am.
