Defense: Stepmother of 11-year-old Gannon Stauch should be released from jail

A spokesperson with the sheriff's office could not directly speak to the case due to a gag order but told 11 News reporter Ashley Franco that all inmates had access to video visitation, just not all at the same time. In a document provided to 11 News by the sheriff's office, the office confirms that video visits cannot be scheduled for inmates in certain wards during standard duty hours (8 a.m.-5 p.m.), but can be scheduled after normal hours.

Kirby told 11 News Stauch could use her time out of her cell to see legal counsel if she wanted, and said that as of Monday there was no restriction to how long an inmate meets with their attorney via video after hours.

"... We have never barred attorneys from meeting with their clients. I want to make that very clear."

The defense team also argued that they still have not received evidence that will help them provide an adequate defense, such as Gannon’s autopsy report and outstanding DNA results on evidence items.

“Among other missing pieces of discovery, DNA results are still outstanding on a number of key pieces of evidence, and [REDACTED] have not been disclosed to the defense.”

In response, the court granted the defense team’s motion to postpone a June 5 evidence hearing. Although there will still be a hearing on June 5, it will now center around “the best method” to proceed with the case, in light of the COVID-19 pandemic.

@csgazette has requested a copy of arrest affidavit spelling out allegations. #LeteciaStauch was previously accused of escaping from handcuffs and attacking deputy in Kansas in March while being brought to CO from SC.

Among evidence for the escape claim are three hand-written letters, allegedly by #LeteciaStauch. One of them was found in defendant’s cell. In it, she tells intended recipient, “If something comes up on the news like she is no longer at the jail or missing, to not be afraid.”

According to 4-page affidavit, #LeteciaStauch claimed her "G-pa" had set aside $75k in legal fees for a private attorney. Told fellow inmate she would "much rather use the money to survive, if you know what I mean."

EL PASO COUNTY, Colo. — Letecia Stauch, the El Paso County woman accused of murdering her 11-year-old step-son, is facing a new accusation – that she attempted to enlist a fellow inmate to help her break out of the county jail, 9Wants to Know has learned.

In communications with that other inmate, Stauch measured herself to make sure she could fit through the window of her cell at the El Paso County Jail in Colorado Springs and considered breaking it out with a broom handle, according to court documents.

According to a probable cause affidavit obtained by KRDO, a deputy received a tip from another female inmate on May 18 that Stauch was plotting an escape through her jail cell's window.

The inmate told Deputy Katherine Draper that Stauch had been passing notes to her through the door jam. The notes, believed to be written by Stauch, asked the other inmate to aid Stauch's escape attempt and also detailed her escape plan, according to the affidavit.


Draper learned from this inmate that Stauch had already measured herself for the window and was confident she'd be able to squeeze through. The inmate gave Draper two letters she claimed Stauch had written her. In those letters, the writer indicated that a grandfather was putting $75,000 for a private attorney and for her daughter's use. The author wrote, "You have my word to make sure we are MIA." The author also wrote about a visit at the jail she had scheduled at 8 p.m. Deputies say Stauch had a scheduled visit with a social worker at that same hour, so they concluded the letters were in fact written by Stauch.

On May 18, inmate Theresa Borchard asked to speak with an El Paso County Deputy about receiving written plans of Stauch’s escape. According to court documents, Borchard said Stauch’s notes were passed to another inmates as well, and explained Stauch passed the appers under their doors or through the door jam.

Borchard gave two letters to a deputy, which she said Stauch had written. According to court documents, Borchard told the deputy Stauch had been making plans to escape and was looking for help. Borchard claims she had not read any of the letters because she had been in court that day.

Kathryn Strobel, #LeteciaStauch's lead attorney, acknowledges new charge of solicitation of escape, and waives further reading and advisements. Sounds like she's officially charged with that count. Her bond on that charge is $2k.

#LeteciaStauch has no mask. Both deputies are wearing them. We've heard complaints for months now from defense counsel about lack of PPE for inmates.

says masks are contraband because metal strips can be used as weapons. Also, there's a shortage.

NEW: Defense on Thursday filed a sealed motion raising issue of #LeteciaStauch's competency. Judge says it doesn't have enough info for him to rule. He is required to order that she be evaluated for competency.
