The defendant "will walk into the view of the camera, this is the entryway to the concession area" ... The defendant "will walk down towards the cashier"... OK so the witness is sort of predicting what Holmes is going to do as he is viewing> He must have watched these videos dozens of times.

Judge says WTTEO This testimony was allowed by the court to assist you...ultimately it is up to you to decide what you see on the video. That is up to you if you find it credible.

The officer did not ever see Holmes buy anything from the concessionary area. He viewd 140 hours of surveillance video

Peoples Exhibit 401 is being admitted into evidence. It is video evidence of people fleeing the theatre....white noise....aaaaargh

Judge annouces a very short break of 5 mins for the Jury. Reminds jury of the admonishments...is that the right word? The Jury have left the room. Judge says he has been asked by a Juror if they can watch the 1st part of the video again> Now the Judge is going to watch the new video - the one of people fleeing the theatre. Back in 5 mins

The judge has viewed the next video and is stating that the video is not particularly predjucial given the magnitude of the charges, and the sentencing options in this case, and that the potential for predjudice is outweighed by the probative value of the video evidence.

He says the next video will not be narrated by the witness. He allowed that to aid the Jury in viewing. He also recaps something he said before which was WTTEO they don;t have to take the witnesses word for what he narrated as seeing> They can accept it or reject it as they choose.

So for example, they don't have to accept his word that the person being pointed out and identified as Holmes, was in fact Holmes.

The Jury are coming back and the next video has been admitted into evidence

Worked with CSI collecting evidence in theater. Checked roof of theater for projectiles on 7/21

No cross from defense and no jury questions.

Witness is asked whether he checked to see whether any projectiles were thrown through the roof of the cinema roof. They did that by getting up on the roof, and found no indication any rounds had been shot into the roof of theater 9

The witness is released but is subject to recall.
