At the preliminary trial the defense was trying to get the charges down to second degree, which was better sentence wise then the plea or first degree. The judge stated there was premeditation and denied it. So now his best bet would be that plea deal but the DA wants a plea deal to include remains. I hope he gives up where she is. The family just wants Jepsy home so they can honor her in their own ways. If no plea deal he does stand trial for first degree murder. No wavering on that which mom is very happy about.

3/7/22 Update: Sounds like a plea deal is still on the table, but a final agreement has not been reached. The judge asked, “Are parties still in discussion?” Defense replied: “More or less.” Defense asked for a proof evident, presumption great hearing. A Proof Evident Hearing is scheduled for 4/15/22 @ 1:30pm.
4/15/22 Update: Evidence was presented in a preliminary hearing, including a recording of a phone call between Dane & his ex-wife Alaine where Dane discusses the murder & disappearance of Jepsy. At the end of the hearing, Judge Jessica Curtis ruled that the trial will move forward on 1st degree murder charges, rejecting the defense's argument that the evidence presented showed that it wasn't pre-meditated. Kalungi's next date in court will be his arraignment hearing on Tuesday, 5/31/22 1:30pm.

Her mother Margie Amaga, a current resident of Hong Kong, is grieving from afar after she was informed that her fourth visa application to come to the United States was denied Wednesday night.

"Last night, she just bawled," said Britney Hartman, the owner of Justice Takes Flight. "She just cried. It just broke her heart that we've tried so many times, and she just keeps getting denied. All she wants to do is come here and help support her Jepsy."

Hartman connected with the family soon after Jepsy's disappearance, when Amaga reached out asking for help. Since that moment, Hartman has been in constant communication with Amaga, helping her with her visa applications and attending each court hearing.

"It just, it tears me up," said Hartman. "And then to know that there's this mom across the world who is just trying and fighting every day, not just to survive because her daughter was horrifically taken from her, but now she has to fight tooth and nail to just be able to go to her trial."

The pre-trial is scheduled for September 19, 2022, and the trial is scheduled for October 5, 2022.

She submitted three more applications this year but, was denied on the grounds that she couldn't prove she didn't have intent to flee to the United States permanently from Hong Kong.

Amber Blasingame, a Colorado Springs immigration attorney, says that is the most common reason for non-immigration visas to be denied.

"It could be something like the applicant has an immediate family member that lives in the United States, or maybe they previously overstayed a visit to the United States, or they don't show enough ties to their home country to prove that they are going to be returning to their home country," said Blasingame.

Trial for Colorado Springs man accused of killing wife pushed to 2023​

It's been more than three years since Jepsy Kallungi, a Colorado Springs woman, disappeared.

And it seemed that her husband, Dane Kallungi, 39, would go to trial next month to face a charge of first-degree murder in connection with her strangulation death.

But on Monday afternoon, both the prosecution and the defense indicated that they were not ready for trial and asked Judge Jessica Curtis for a continuance.


Dane Kallungi's jury trial is now scheduled to begin Feb. 7 and is expected to last at least eight days.

Before his trial gets underway, Dane Kallungi will appear in Colorado's 4th Judicial District Court for a motions hearing on Jan. 6.

9/19/22 Update: Both the prosecution & the defense indicated that they were not ready for trial and asked Judge Jessica Curtis for a continuance. Trial continuance-granted. Kallungi waived his right to a speedy trial in court Monday, pushing his new trial date out four months. Next Motions hearing on 1/6/23 @ 8:30am, pretrial readiness conference on 1/17/23 @ 1:30pm & trial will now begin on 2/7/23 thru 2/17/23.
