Murder charges filed against man in case of missing Colorado mom - CNN
Two friends said Frazee told them that the relationship with Berreth ended months ago -- claims that contradict statements from Berreth's aunt, who wrote on Facebook that Berreth broke up with Frazee the same day she went missing.

"I still refuse to believe that he's done this until I see the evidence," said Tamra Freeman, whose granddaughter played with Frazee's daughter.

Freeman said that Frazee told her the relationship with Berreth ended on New Year's Day 2018, and the only contact they had was related to their daughter. Berreth's mother has not responded to CNN's requests for comment.

Frazee was at Freeman's home two days before his arrest, she said. She recalls him being concerned about what would happen to Kaylee if he was arrested, she said. Freeman said Frazee told her he felt "railroaded" by police, who he claimed seemed to be focused only on him.

Levi Snare said he went through 4H with Frazee when they were children, and he leases a bull from Frazee for his cows. Frazee kept to himself, Snare said, but could hold a conversation when engaged.

"I've known Patrick for a long time, and it doesn't seem to me like he could do that," Snare said. "You're innocent until proven guilty and so people on Facebook who don't even know Patrick need to keep their mouths shut."

Frazee never spoke poorly of Berreth, said Ginger Bruvold, owner of Outpost Feed and Ranch Supply in Florissant where Frazee was a customer. His daughter was always with him and she was always well behaved and appeared to be cared for, Bruvold said.

"I have nothing negative to say about him or his family," Bruvold said. "They are good, honest, hardworking people who have been in this community most of their lives."

Patrick Frazee has a pair of court hearings still this week. Tomorrow, a pre-trial conference regarding custody of the couple’s daughter. Frazee’s mom filed a motion to intervene, requesting custody. A motions hearing in the criminal case is set for Friday. #PatrickFrazee @KOAA

Idaho woman possibly disposed of Kelsey Berreth's cell phone
While Patrick Frazee is being held on murder charges in connection with the disappearance of his fiancée, a 32-year-old woman from Twin Falls, Idaho is being investigated for possibly disposing of the victim's cell phone.

ABC News reports that the woman, who hasn't yet been publicly identified or criminally charged, may have something to do with Kelsey Berreth's cell phone, which was last pinged in south-central Idaho days after Berreth was last seen in Woodland Park.

Woodland Park police previously said they were working on recovering the cell phone from Idaho, but it's not clear if it has been searched at this time.

This is a developing story, and we'll update this article if any arrests are announced or if charges against the woman are made public.

Withholding Patrick Frazee arrest warrant affidavit violates rights, expert says
A district attorney’s efforts to withhold a document that lays out the case against the man they are accusing of killing Woodland Park mother Kelsey Berreth is a rare legal maneuver that may impinge on the suspect’s constitutional right of due process, legal defense experts said.

“To deny the whole (arrest) affidavit is highly unusual,” said Dan Recht, former president of the Colorado Criminal Defense Bar and an expert on constitutional criminal law. “It puts the defendant at a substantial disadvantage. There are constitutional issues to consider.”

Fourth Judicial District Attorney Dan May has asked Judge Linda Margaret Billings Vela to allow him to withhold a copy of the arrest warrant affidavit from 32-year-old Patrick Frazee, who faces five murder charges in Berreth’s death including two counts of first-degree murder and three counts of solicitation to commit murder.

Idaho woman reportedly being investigated in disposal of Kelsey Berreth's cellphone
A 32-year-old nurse from Twin Falls, Idaho, is being investigated for allegedly disposing of missing Woodland Park woman Kelsey Berreth's cellphone in Idaho, ABC News reported Wednesday.

"For now, ABC News is withholding her name because she has not been publicly identified or charged," reporter Clayton Sandell tweeted.

It's unclear who might be investigating the Twin Falls woman .

The FBI contacted the Twin Falls Police Department and Twin Falls County Sheriff's Office on Dec. 15 to ask for help with the investigation, a Twin Falls police statement says.

Detectives from both agencies worked with the Colorado Bureau of Investigations and the FBI "to prepare and serve several search warrants as well as processing some items of evidence," the statement says.

"The Twin Falls Police Department is not investigating anyone regarding the Kelsey Berreth case," spokesman Lt. Terry Thueson said in an email Wednesday.

ABC News is withholding the woman’s name because she has not been publicly identified or charged. The network reports the woman is employed as a nurse.

Berreth’s body had not yet been found, though Twin Falls police said last week they thought they had found possible evidence in connection to the case.

Patrick Frazee will be back in court on Friday for what is expected to be a four-hour hearing on motions in his upcoming murder trial.

And on Thursday he may also be making an appearance at the Teller County Courthouse due to a motion filed by his mother last week requesting custody of her son's daughter Kaylee.

Custody of the 14-month-old baby was granted to the parents of Kelsey Berreth last week after officials announced that they believed the missing mom, 29, was dead.

That same day her fiance, Frazee, was charged with her murder.

The custody ruling was only a temporary one however, after Sheila Frazee filed a motion declaring she wanted parental rights to the infant.

It was a shocking development in the case and one the Berreths have yet to comment on, despite the fact that they will now come face-to-face with Frazee just two days after he was indicted for their daughter's murder.

And he will be joined by his mother, who like her son never once reported the victim missing - despite the fact that Frazee and Kaylee were with her for the 11 days between when Berreth was last seen and her own mother notified authorities.

Idaho nurse under investigation in case of missing Colorado mother Kelsey Berreth: Sources
A woman being investigated for her role in the case of missing Colorado mother Kelsey Berreth has been identified as a 32-year-old nurse from Twin Falls, Idaho, two of the woman’s family members and a law enforcement source told ABC News.

ABC News is withholding reporting the woman’s name because she has not been publicly identified by law enforcement investigators.

The woman has not been charged with any crime and her exact relationship to Frazee is unclear.

Sources told ABC News that the woman is being investigated for disposing of Berreth’s cellphone in Idaho. Investigators had previously said that Berreth’s phone was detected in Idaho on Nov. 25, three days after Thanksgiving when the 29-year-old mother was last seen publicly.

Baby registry gifts pour in for Kelsey Berreth's daughter, Kaylee
The search for missing mother Kelsey Berreth continues and her one-year-old daughter is feeling support from mothers all over the country.

In addition to the monetary donations sent to a Wells Fargo funds, Kaylee is receiving gifts from an Amazon Registry.

It was started by one of the many Facebook groups that discuss the case and trial of Kelsey Berreth.

The gifts are being sent to the Moses Lake 7th Day Adventist Church. They are the same church that has held vigils for the Berreth family in the past.

Included in the registry are over 260 gifts like clothes, a car seat, and hygiene products for young ones. In under a week, people from across the country have purchased more than 200 items.

Ashley Smith, one of the contributors says, "we are mothers and we could not even imagine going through what Kaylee is going through... or their family."

It's likely everything Kaylee owned is stuck inside Kelsey's home in Woodland Park. FBI Evidence teams were seen taking many things out of the home in evidence bags and later sealed the door with tape.

Charges, motions provide preview of evidence against Patrick Frazee
Stephen Longo, an attorney with McDivitt Law Firm, helped explain the charges.

“It suggests to me that he probably asked the same person three times to either help or commit the crime individually,” Longo said. “It’s always possible, based on the three counts, that he asked three separate people.”

The solicitation charges also suggest Frazee tried planning the crime for months, between and including Sept. 1 and Nov. 1 of this year.

Longo said the timeline inclusion could help explain what evidence investigators have uncovered.

“It’s documented somehow, right? Whether it’s email, text message, recorded phone call, something where we have specifics where we can trace the date,” Longo said.

A person could also have supplied that information, he said.

Patrick Frazee back in court Thursday for custody hearing

Both Berreth and Frazee’s mothers are vying for custody of the couple’s 1-year-old daughter, Kaylee. Berreth’s mother was granted temporary custody, but Frazee’s mother filed a motion to intervene. That motion will be heard on Thursday at 8:30 a.m.

The first hearing was not open to the public, Thursday’s hearing will be.
