Judge: Frazee warrant to remain sealed for now
The judge in the case ruled that Frazee and his attorneys could have access to the arrest warrant – something prosecutors did not object to. But the judge also ruled that it should remain sealed to the public.

Prosecutors and defense attorneys also discussed the motion for consumptive testing in the case for evidence that could be destroyed once it is tested. Both sides agreed that there was no need to rush the tests, as prosecutors said the piece of evidence was not as critical as they originally thought. The judge did not rule on the motion on Friday and the discussion is expected to continue up until Frazee’s preliminary hearing, which was set Friday for Feb. 19 at 9 a.m.

“This is an ongoing process as we look at multiple items that will be tested,” Viehman said.

“So as we go through items and communication with law enforcement and the lab, many times the urgent nature of things may change because we may realize that piece of evidence or item either doesn’t have the significance that we once thought it did, or maybe the lab is telling us that it’s not going to be an issue, [that] they’re going to be able to complete things in a more timely manner,” she added.

Patrick Frazee gets access to affidavit with reason for murder charges
We asked why Frazee wasn't given access to the document in the first place, and the district attorney's office said that it could have put a potential witness in danger, though we weren't given specifics about why a witness would be in danger.

After we reported that a woman in Idaho was under investigation for potentially disposing of Berreth's cell phone, a prosecutor hinted that her involvement is on record in the affidavit.

"I can't really speak to any of the information in any of the probable cause affidavits because those remained sealed at this time," said Jennifer Viehman with the 4th Judicial District Attorney's Office.

During a motions hearing, Teller County Deputy District Attorney Jennifer Viehma said the prosecution completed an unspecified portion of the investigation and no longer needed to withhold the affidavit. The affidavit, which outlines the facts that were the basis for Frazee’s arrest, remains sealed to the general public.

Frazee is scheduled for a Feb. 19 preliminary hearing. His attorney, Adam Steigerwald, requested more time because of the size and complexity of the case.

In another matter, attorneys settled concerns over a piece of evidence that they feared would be destroyed in scientific testing. Prosecutors determined there is enough to give a portion to the defense team for separate analysis.

Family friend names Twin Falls County woman investigated in connection to missing Colorado woman
A family friend confirmed to KMVT Friday that the FBI is investigating KKL in connection to missing Colorado woman Kelsey Berreth.

KKL lives within Twin Falls County. She is a registered nurse at St. Luke’s Health System. A hospital spokeswoman confirmed Lee is on a leave of absence.

As of 4:30 p.m., a Twin Falls County Sheriff's Office spokeswoman said no one by KKL's name has been arrested.

Reports: Twin Falls nurse suspected of disposing missing Colorado woman's cellphone
ABC’s Clayton Sandell reported that the Twin Falls woman has known Frazee for years and that the two worked together for a time in Colorado.

CNN also reported Thursday that a Twin Falls woman was involved in the investigation, citing “a source with knowledge of the investigation.”

The Times-News has received multiple anonymous tips that the case involves a 32-year-old registered nurse at St. Luke’s Magic Valley Medical Center whose Facebook account was recently closed.

St. Luke’s spokeswoman Michelle Bartlome confirmed that law enforcement has contacted the hospital. Bartlome, however, said she “wasn’t in a position to disclose” which agency made contact.

Twin Falls Police Lt. Terry Thueson said Thursday his department had “assisted in obtaining search warrants” but said Twin Falls police are not actively investigating the case.

Lori Stewart, spokeswoman for the Twin Falls County Sheriff’s Office, told the Times-News the two departments have a joint special investigation unit but did not say if the property searched is in the city or county.

Gooding County Sheriff Shaun Gough said his office is not investigating the case and the FBI has not contacted him.

The Idaho State Police is also not involved in the investigation, ISP spokesman Tim Marsano said Thursday.

Woodland Park Police did not respond to a request for information about the Idaho woman.

Berreth’s parents file wrongful death suit against fiancé
The parents missing Woodland Park mom Kelsey Berreth filed a wrongful death lawsuit against her fiancé Patrick Frazee.

Attorneys for Darrell and Cheryl-Lee Berreth filed the lawsuit Friday in US District Court in Denver.

The suit is seeking an unspecified amount for the Idaho couple’s grief and suffering following the death of their 29-year-old daughter, whose body has yet to be recovered.

The lawsuit alleges Berreth was “murdered on or about November 22, 2018, at the direction and/or hand of Frazee in or about Woodland Park, Teller County, state of Colorado.”

The couple is also suing for negligence, alleging “Frazee enacted physical, mental, and emotional acts of violence upon Kelsey Berreth prior to her death, Frazee breached the duty of care with which a reasonable person should conduct himself toward another human being.”

Authorities have not named KL in connection with the case. Nor have they accused her of anything publicly. Nor is she under arrest. However, her name surfaced on KMVT-TV on January 4, 2019 after an earlier report on ABC News that reported on a woman tied to Frazee without naming her.
“A family friend confirmed to KMVT Friday that the FBI is investigating K(K)L in connection to missing Colorado woman Kelsey Berreth,” the KMVT report alleged.

Who is KJL? Posts on Facebook show her photographed at a county fair with horses, although she appears to have deleted her Facebook page at some point. Before it was deleted, it said she “worked as an RN.” Her name has circulated in a true crime sleuthing group devoted to the case for some time.

KJL has an unencumbered license to work as an RN in Idaho, according to licensing records. Her license to practice nursing is scheduled to expire in August 2019.

According to a post on Facebook, K is a former Miss Magic Valley Stampede Queen. That position is a rodeo queen. She was married, but she petitioned for divorce from her husband in 2016 and indicated there was a minor child in the marriage, according to Idaho court records. The only other things that come up for either KL or KK in Idaho records are minor traffic cases involving speed and insurance.

An old newspaper article described her as high school body president, and active in volleyball, basketball and rodeo.

This is the nurse at the center of the fiancée murder case who is suspected of disposing of the dead woman's cellphone.

Divorced mother-of-two KL is being investigated over her role in the mystery of the disappearance of Kelsey Berreth.

KL, 32, is believed to have been having an affair with Patrick Frazee who has been charged with Berreth's murder even though her body has not been found.

KL, who lives in Twin Falls, Idaho, has not been formally identified by police as the woman they are investigating, but sources confirm she is the woman involved.

Now DailyMail.com can reveal that that person is KL, who works as a pre-op nurse at the St. Luke's Magic Valley Medical Center in Twin Falls. She has now been placed on a leave of absence, the hospital confirms.

She was born KK and married rancher CL in October 2010. After having two children the marriage ended in divorce in June 2016 according to court records.

During their marriage the couple lived in an isolated six-bedroom farmhouse overlooking a canyon in Kimberly, Idaho, seven miles east of Twin Falls. 'No Trespassing' notices were posted at the house on Thursday and a brand new chain was strung across the long drive.

DailyMail.com spoke with two people who know KL professionally, and they both said that they had been told that Frazee was having an affair with her. The couple had met at a rodeo.

Berreth parents file federal suit against Patrick Frazee
Kelsey Berreth's parents, Cheryl-Lee Berreth and Darrell Lynn Berreth, filed a civil suit in federal court against Patrick Frazee, Friday.

The civil suit accuses Frazee of wrongful death, negligence per se, conspiracy, and infliction of emotional distress. The documents allege Frazee either committed and/or collaborated in Kelsey's murder.

The suit also accuses Frazee of inflicting physical, mental, and emotional acts of violence on Kelsey prior to her death.

In the filing document, the plaintiffs state that “Frazee wrongfully caused the death of Kelsey Berreth and, as a direct and proximate result, Plaintiffs have sustained damages.”

The document goes on to state that the Berreths “incurred economic loss and damages, to include but not limited to net pecuniary losses and other economic losses, and non-economic losses and damages, to include but not limited to solatium, grief, emotional distress and suffering, and loss of quality of life.”

Additionally, the lawsuit argues that Frazee “engaged in such extreme and outrageous conduct before, during, and after the murder, that he did so recklessly and with the intent of causing Plaintiffs severe emotional distress.” The document then states that the Berreths continue to suffer due to Frazee’s conduct.

Local lawyer explains wrongful death lawsuit against Patrick Frazee
Well known local personal injury lawyer, Mike McDivitt says in cases like these, getting a guilty verdict won't affect the outcome of the civil suit.

McDivitt says, "if the evidence shows there was a murder by Mr. Frazee, that's a legitimate wrongful death claim on behalf of Frazee's little girl whose mother has now been killed. That little girl will presumably be represented by grandparents which I think that's what this complaint is accomplishing."

McDivitt says winning the civil case doesn't hold the same standard of proof a criminal case would meaning the plaintiffs don't have to prove their case beyond a reasonable doubt to jurors.

"The standard of proof in a civil is lower, it's by a preponderance which means more probable than not," he says.

No matter what happens inside the courtroom, Frazee, guilty or not guilty, the evidence that comes out could help determine whether or not any money is awarded to the Berreth family.

"As the proceedings go through, and evidence is developed in the criminal matter that will give the plaintiffs in the civil matter, a great opening as to the evidence necessary to prove the civil case," McDivitt says.

Berreth family files wrongful death lawsuit against Patrick Frazee
Lawyers for Kelsey's Berreth's parents have declined to comment on the lawsuit that was filed Friday.

Here is the statement sent to 11 News:

"To protect the integrity of the criminal prosecution, we have no comment. We will share all our information with the local, state and federal authorities and no one else until all facts are made public. Our federal lawsuit speaks for itself and we will not add any detail at this time.
