Idaho nurse charged in connection to Colorado mother Kelsey Berreth's disappearance
A nurse in Idaho will face one charge of tampering with physical evidence in connection to the disappearance of Colorado mother Kelsey Berreth.

Krystal Jean Lee Kenney, 32, was summoned to appear at Teller County District Court on February 8 on a count of tampering with physical evidence, according to Colorado prosecutors. Kenney was scheduled to appear before Judge Scott Sells at 8:30 a.m. for an advisement hearing, Lee Richards, spokeswoman for District Attorney Dan May, told the Denver Post.

A criminal complaint claimed that Lee “unlawfully and feloniously destroyed, mutilated, concealed, removed or altered physical evidence” between November 24 and November 25 of 2018. Felony charges were filed against Kenney on Monday.

Authorities did not comment on what specific evidence Kenney allegedly tampered with. However, investigators previously said that Berreth’s cellphone had pinged to a location in Gooding, Idaho, three days after her disappearance.

Investigators suspected a woman had disposed of the cellphone, a Twin Falls Sheriff’s Office spokeswoman told NBC News.

Berreth is believed to have either been killed by Frazee or during a robbery he commissioned, according to NBC News. The 29-year-old’s body has not been found, but investigators believe she is dead.

A recent interview of one of Berreth’s good friends from a national news source suggested that there was tension between Berreth and Frazee. The person, claiming to be the missing woman’s best friend, said that Frazee was emotionally abusive towards Berreth. The person also said in the interview that as soon as she heard of the Woodland Park woman’s disappearance, she immediately thought that Frazee was to blame.

On the other side of the legal spectrum, local residents who claim to have sat behind bars with Frazee say that he swears by his innocence. Frazee has maintained he didn’t play any role in his fiance’s disappearance.

Rumors circulating the small community say that one of the items that was removed from the waste transfer station in Divide after Frazee was seen dumping some trash there, including an electric saw. Some also think that the backhoes brought onto Frazee’s property during the search warrant of the 35-acre ranch, where he lived with his mother, were aimed at removing the septic tank on his property for possible clues.

Documents reveal Kenney seeking leverage in court, expert says
Dru Nielsen, Kenney’s defense attorney, filed a list of nine discovery demands this week. Nearly all of them focus on ensuring prosecutors turn over all information and evidence relevant to the case, so they can provide fair representation.

That includes information that could eventually lead to tossing out testimony from witnesses, based on certain factors. The document includes the demanded release of “Evidence that a prosecution witness has a motive or bias because he or she has entered into an agreement with the prosecution, received leniency from the state, or has outstanding litigation or cases with a prosecutorial agency…”

They also seek all handwritten or typed notes about this case from investigators.

But the final demand, the “Revocation of all releases and waivers and assertion of all rights and privileges”, shows the defense is looking to protect Kenney from overreaching prosecution.

“Ms. Kenney hereby revokes and rescinds all releases, waivers and authorizations for the release of information which she may have heretofore made, and she hereby asserts all of her rights and privileges under Colorado’s privilege rules, statutes and principles…,” Nielsen said in the document.

Stephen Longo, an attorney with McDivitt Law Firm, said it appears Kenney is trying to leverage her position as a possible key witness in the case against Patrick Frazee to try and get a lesser sentence in her case.

“Her kind of reversing and not sure if she’s gonna enter a plea deal or recanting statements is interesting, because you wonder whether or not she just doesn’t like the plea deal she’s getting and wants to leverage her position as a key witness against the defendant,” Longo said.

Idaho nurse to be charged in connection with Kelsey Berreth's disappearance
Berreth's fiance and accused murderer, Patrick Frazee, will go before a judge for yet another custody hearing over the pair's daughter, Kaylee, Thursday. The judge could give visitation rights to Frazee's mom and sister.

Krystal Lee Kenney, a nurse from Idaho is accused of disposing of evidence and is scheduled for a court appearance on Friday. Investigators believe she could be responsible for getting rid of Kelsey's phone.

New documents filed in Teller County court this week show that Kenney's lawyers are asking for access to the evidence the state has against her.

Her lawyer lists nine demands with many of them focusing on getting access to evidence relevant to the case, so they can provide fair representation. That includes knowing who investigators have already spoken to. The court documents state it's all to help her lawyers prepare for trial and avoid surprise.

But Criminal Defense Attorney Alex Berry says a plea may be Kenney's best option.

"It's more likely she's doing a straight guilty plea. She may be willing to testify against Frazee and have reduced penalties because of that," Berry said.

While we will have to wait until Friday for her case, we will find out more on Kaylee's future Thursday.

Accused killer Patrick Frazee expected in court for daughter's custody
Patrick Frazee, the Colorado man charged in the death of his fiancée, Kelsey Berreth, is expected to appear in court Thursday for a hearing that may determine who will get custody of their daughter.

Berreth's parents have had temporary custody of the 1-year-old girl, Kaylee, since December. But Frazee's mother is also seeking custody, according to court records. Kaylee remains in the legal custody of the Teller County Department of Human Services.

The pretrial conference, scheduled for Thursday morning, is closed to the public.

Murder suspect Patrick Frazee wears protective vest for custody hearing in Teller County
The judge ruled this morning the child will remain with the maternal grandparents. Another hearing on the matter is scheduled for April 4th.

Frazee, the man accused of killing Berreth, arrived and departed the pre-trial conference hearing surrounded by deputies while shackled and wearing a vest designed to resist bullets and stab attacks.

The Teller County Sheriff’s Office determined the precautions will be needed for the remainder of his criminal case, even though they’ve heard of no verified threats.

The defendant is also no longer in general population at the Teller County Jail for his own protection.

Frazee’s mother and Berreth’s mother are fighting for custody of 1-year-old Kaylee Berreth. Berreth’s mother was granted temporary custody following his arrest. But Frazee’s mother filed a motion to intervene.

Meanwhile, Idaho woman Krystal Kenney is expected to appear at 8:30 a.m. Friday in Teller County in connection to the Berreth case.

The Teller County Sheriff’s Office tells News5’s Sam Kraemer that Kenney is not in custody and she likely won’t be taken into custody at Friday’s hearing.

Berreth's 1-year-old daughter with Frazee will remain with her maternal grandparents, a judge decided in a custody hearing Thursday.

Frazee attended the hearing in his green-striped jail uniform. For the first time, he was wearing a bulletproof vest, which the Teller County Sheriff's Office said will be the norm from here on out.

Couch said Frazee's vest -- and the noticeably higher security in the courthouse -- was because of how high-profile the case had become.

"Out of an abundance of caution, we decided to take the extra security measures. ... Our job is to protect everybody involved, including the defendant."

Krystal Lee, an Idaho woman linked to Patrick Frazee, will be in court Friday in Teller County.

Lee is not currently in custody; Couch said she is coming to Colorado on her own terms.

The 4th Judicial District Attorney posted to social media Lee was facing one count of tampering with physical evidence. In a complaint made public Tuesday, it stated the 32-year-old was accused of tampering with evidence between Nov. 24 and Nov. 25.

She will not be sentenced until the end of Frazee’s trial. The judge in the case said she could be sentenced with

Prosecutors said Kenney destroyed evidence related to Berreth’s disappearance on Nov. 24-25.

Prosecutors have not released information about the evidence Kenney is accused of destroying. We know Berreth’s phone pinged off a tower in Gooding, Idaho, on Nov. 25, three days after she was last seen publicly. That’s nearly 800 miles from Berreth’s home in Woodland Park, and is close to where Kenney lives in Hansen, Idaho.

Idaho woman linked to accused murderer Patrick Frazee pleads guilty
CRIPPLE CREEK, Colo. (KKTV) — On Friday, Krystal Lee pleaded guilty to tampering with evidence, a class 6 felony.

11 News has confirmed that Lee said she "moved the victim's cell phone" in Idaho.

According to the judge, Lee's sentence could be anywhere from 12 to 18 months in prison, community corrections, or probation.

The sentencing will not occur until sentencing for people charged in the case is completed, which "could be 6 months from now or 2 years from now."

Lee is scheduled to back in court on June 24th at 11 a.m.

UPDATE: Magic Valley woman pleads guilty to tampering with evidence in Colorado
Kenney appeared in court at 8:30 a.m. Friday in Teller County, Colo., and pleaded guilty to one count as part of an agreement with prosecutors.

She has agreed to cooperate with police and prosecutors in other court cases and will testify at the trial of Patrick Frazee, who faces murder charges connected to Berreth's death.

Kenney said in court Friday that Frazee "committed homicide" and that she tampered with a cellphone.

Her sentencing will not take place until after Frazee's trial, the prosecutor said. She could face prison time or parole.

The details of the agreement and sentencing have been suppressed and Kenney has said she won't talk to the press as part of the agreement.
