TELLER COUNTY — District Attorney Dan May spoke Tuesday about Patrick Frazee's appeal of his conviction.

Frazee was convicted for the murder of Kelsey Berreth and sentenced to life in prison without the possibility of parole, plus 156 years.

May said that under Colorado law, every First Degree Murder conviction gets an automatic appeal. He added that the process could take a few years and he does not believe the odds are in Frazee's favor.

"After it is an automatic appeal to the court of appeals, theoretically he could then ask the Colorado Supreme Court to review the case. That is not automatic, that's up to them if they want to review it. If he loses his first appeal, each appeal after that the odds become much much less," May said.

That evil thing should be in prison for that whole murder solicitation thing; she had to be involved.

Ignoring the fact that she definitely saw Kelsey's body being burned, and treated her like absolute crap.

I hope this investigation cost her an arm and leg.
 
KK should be shaking in her cowgirl boots. Someone reminded me during the trial I was keeping track of potential appeals. I got ‘em all except I thought they would say Frazee’s lawyer did not perform. I can’t even fathom another trial but you just never know. The appeal was 70 pages and the People’s response 80…and the judges I am sure will review both in addition to the 15 minute arguments.

I hope dear ole' Ma F goes broke trying to hire private investigators and attorneys for her sweet boy. They all made Kelsey's life a living hell. Plus, nobody will ever convince me she didn't know something was up during the Thanksgiving bonfire right outside her window.

Patrick isn't going anywhere, ever, as it should be.

I hope dear ole' Ma F goes broke trying to hire private investigators and attorneys for her sweet boy. They all made Kelsey's life a living hell. Plus, nobody will ever convince me she didn't know something was up during the Thanksgiving bonfire right outside her window.

I have never thought Mrs Frazee played a role and KK played a big role. We never did learn why Kelsey’s phone ended up in Idaho. And the blood spatter expert merely affirmed that the splatter accurred because of KK’s testimony and no gun was mentioned. I also think her body is still out on the ranch land and evidence was burned at the Frazee home. He isn’t going anywhere soon but oh would I be happy if a new trial could catch KK. She alone could have stopped the murder.

Respectfully, I am curious as to motive? (I did not keep up with the trial) Was it ever proven (motive) if it had to do with custody issues??

Custody as a motive was suggested in the wrongful death lawsuit brought forward by Kelsey’s parents. AFAIK, it was not presented in Frazee‘s criminal trial.

The phone was sitting next to KK's phone (and pinging) all the way from WP to Idaho Falls until KK gave KB's gun to a friend, per her affidavit.

“Frazee wanted Berreth’s firearm to appear to be missing in an attempt to lead investigators to believe that Berreth might have committed suicide. Frazee said that because she wouldn’t take the body, she had to take Berreth’s firearm with her and dispose of it,” the affidavit said.

Slater said that after Lee returned to Idaho, she gave the gun to a friend. Investigators retrieved the gun from the man and confirmed it had been purchased and owned by Berreth.

Thanks I had forgotten that is the excuse she told LE about the gun.
