BREAKING: Patrick Frazee is facing five charges. 2 first-degree murder charges and 3 solicitation to commit murder charges. According to court documents, Frazee asked one or more people to commit murder & through the course of an attempted robbery Kelsey Berreth died @KKTV11News
Attempted robbery?
1st degree murder is basically premeditated, deliberated and intentional. Felony murder is when someone other than a participant dies during the course of some other crime like robbery. It does not speak well of their theory of the crime that they cannot pick one?

Boulder Felony Murder Lawyer | Colorado Murder Attorney

"... First degree murder is “with intent and after deliberation” taking the life of another. Although we don’t call it premeditation, that is what it is somewhat akin to. The theory being is that prior to taking the others person’s life one must have the intent to kill and deliberate on that intent. ....

...Felony murder is a separate category of murder and does not have the same mens rea as the types of murder that were discussed above. ...Felony murder is when, during the commission of certain, enumerated crimes, (Aggravated robbery, burglary, arson, kidnapping) a person is killed. The person charged with felony murder does not have to participate or even know that the killing is about to occur. It is also irrelevant whether or not the person charged with felony murder wanted to actually commit the murder. ..."

Felony murder rule (Colorado) - Wikipedia

"... In the state of Colorado, the common law felony murder rule has been codified in Colorado Revised Statutes § 18-3-102. The statuteclassifies a homicide as first degree murder when committed during one of these predicate felonies:
• Committing or attempting to commit arson, robbery, burglary, kidnapping, sexual assault, or a class 3 felony sexual assault on a child
• Or if in the course of one of these crimes or the immediate escape from it, anyone causes the death of a person other than one of the participants..."

Ok.....so supposedly KB texted from Idaho..... Yet there is supposedly died from an "attempted" robbery at her home.

So confused now.....

I think all I can say is “google”, you’ll find some things that can’t yet be discussed here. MOO

What the heck? he really did think he was smarter than everyone else. But if it was set up as an attempted robbery why did it look like nothing was stolen or removed when the brother went there? Since when do "robbers" attempt to cover up the scene? Having trouble buying this, is it only coming from one reporter?

It’s really too bad we can’t watch. The reporting on this case has been horrible so who knows if we’ll get the correct information.

Wish I could like this a million times. We’re relying on people who have gotten basic facts wrong about this case in the past.

Will we be getting to see the actual documents or just these people’s versions of what they heard in court? Can’t wait for all the news to conflict lol

I am a bit behind in all of this, but 2 first degree murder charges is confusing when there is only 1 death. How are they allowed to charge him like that?
