A reporter for KT11 News posted from the Teller County District Courthouse on Monday morning that Patrick Frazee has been charged with five murder counts: two charges of first degree murder and three counts of solicitation to commit murder. The charges indicate that authorities believe Frazee attempted to enlist at least one person, possibly more, in a conspiracy to murder the mother of his 1-year-old daughter.
The post also said that court documents show authorities believe Berreth was killed at her Woodland Park home in the course of an attempted robbery. It is not yet known if investigators believe there were additional people present at the crime scene.

No, the second 1st degree charge is "felony murder" which is when someone is killed during the commission of another crime, like arson, robbery, etc. MOOHe must have also killed the person he hired to kill Kelsey.
