PUEBLO — Almost eight years to the day a pregnant Denver woman disappeared in 2013, opening statements are starting in the murder trial of her ex-boyfriend.

21-year-old Kelsie Schelling was two months pregnant when she drove from Denver to Pueblo to see her former boyfriend Donthe Lucas. February 4, 2013, was the last time Schelling was seen.

Her body has never been found.

Her car was seen on surveillance camera footage on February 5, 2013, driving through an ATM. Schelling's family alleges Lucas was driving and took $400 out of her account.

That same day, cameras capture her car parked at the Walmart in Pueblo. The car was then moved and would sit in a parking lot at St. Mary-Corwin Medical Center from Feb. 7 to 14, before it was discovered.

The community organized search efforts to try and find Schelling and her family filed a lawsuit in 2015 against the Pueblo Police Department and the Lucas family. The suit criticized the way the investigation was handled but was ultimately dismissed.

In December of 2017, almost four years after Schelling's disappearance, Lucas was charged with her murder. By May of 2018, a judge said prosecutors had proved probable cause.

Evidence revealed in the spring of 2018 included medical records proving Schelling's pregnancy, text messages between Schelling and Lucas, and data from cell phone towers. Investigators say the records prove there was never a time when the two phones were not overlapping in the same areas on February 4, 2013. Plus, they say both phones are unaccounted for, during a four-hour window of time.

The lead investigator on the case from the Colorado Bureau of Investigation believes Schelling was strangled by Lucas after he lured her down to Pueblo. The theory would explain the lack of a murder weapon.

Lucas pleaded not guilty to the murder charges in August of 2018, and the judge set a trial date for 2019. However, in January of 2019, both the prosecution and defense said they would not be ready to go to trial by early April 2019, because of an additional 125 witnesses who could possibly be called to testify.

The trial was then scheduled for July 2019, but Lucas' lawyers said they had new scientific evidence and needed more time to review it.

In December of 2019, the judge postponed the trial until May 2020, as a new lawyer joined the defense team. Then, in December 2020, the murder trial was set to start on January 25, 2021.

The defense team has argued there is no physical evidence in this case since no body or murder weapon were ever discovered. Paperwork filed by the attorneys also point the finger at another suspect, Schelling's father, alleging a history of abuse.


Meanwhile, the prosecution claims Schelling and Lucas were arguing for months and her pregnancy was like "gasoline on a fire." The attorneys have said they do not need to prove how she died, just that Lucas was responsible.

On Wednesday morning at the Dennis Maes Judicial Building in Pueblo, opening statements will begin. The jury selection process started on Jan. 25, picking the 12 jurors and four alternates who will serve during the trial. It could last until early March.

There are no cameras allowed in the building and no live reporting from the courthouse. There are also limits on the number of people who can be in the courtroom because of the COVID-19 pandemic.

Prosecution spoke about DNA evidence found in #Schelling’s car, including hair from #Lucas’ mom. However, defense says that’s all normal to find in a car. They say it was common for #Schelling to let #Lucas borrow her car, and even debit card.

Laura Saxton (Kelsie Schelling’s mother) is called as the first witness called to the stand in the Donthe Lucas case: Schelling was “98% certain” Donthe didn’t want to be apart of their child’s life.

Saxton started choking up while discussing the last time she saw her daughter, Kelsie.. 8 years ago yesterday. “Told her i loved her.. and she left to go back to Denver.”

After Feb 4th 2013, Saxton says she called Kelsie's phone several times.. never got an answer. She did received text messages.. Messages were curt and short.. unlike Kelsie

When Kelsie was missing, Saxton called Donthe Lucas.. “I don’t care if you are together or apart but there is a child involved now.” Lucas told Saxton he’d help support the baby.

Saxton spoke on the Pueblo Police Department and her dissatisfaction with their investigation.. she says they were unwilling to coordinate with her on searches to try and find Kelsie.

Former Pueblo Co Sheriff Dan Corsentino conducted his own investigation for Kelsie's family.. and started contacting PPD for assistance . But Saxton says they were unwilling to discuss anything with Corsentino. Filed a civil lawsuit against PPD but was later dropped.

Prosecutor Michelle Chostner is finished questioning Laura Saxton.. Defense is up after a short recess.
 
I'm getting angry recalling the runaround KS's case was given in the early days of Kelsie going missing. :eek:

IMO, the defendant, DL, was athlete royalty. He was viewed as the local kid that would one day hand out courtside tickets to NBA games. Except for his talent outside of the neighborhood hoops didn't flourish. He stalled at junior college. There was no recruiter and no career in sight. He was angry and everything was Kelsie's fault! And how dare she get pregnant.

Donthe Lucas homicide trial begins in Pueblo, Colorado

It’s been just shy of eight years since pregnant, 21-year-old Kelsie Schelling disappeared in Pueblo after driving from her home in Denver to visit her boyfriend and purported father of her unborn child, Donthe Lucas.

Members of Schelling’s family made a similar drive down Interstate 25 to see Lucas Wednesday as he stood trial for Schelling’s murder.

Schelling’s mother, Laura Saxton, has awaited this day for years — she’s long alleged that Lucas was either involved in or responsible for her daughter’s disappearance. She and Schelling’s father, Doug Schelling, even filed a wrongful death lawsuit against Lucas and members of his family in 2016 that was later dismissed.

Deputy District Attorney Michelle Chostner — in an opening statement of which large portions were indiscernible due to poor audio quality on the broadcast made available to media in an overflow room of the courthouse — laid out Lucas’ actions in the days before and after Schelling’s disappearance.

Chostner referenced several text messages from Lucas to Schelling leading up to her trip to Pueblo and outlined details of a tumultuous relationship in which Lucas and Schelling constantly fought, with fights escalating over time.

Citing the text exchanges between Lucas and Schelling, Chostner described Lucas’ efforts to convince Schelling to come to Pueblo both on the day before and day of her disappearance.

Chostner read text messages from Lucas to Schelling, some of which referenced a “surprise” Lucas was anxious to show her.

When Schelling asked about the surprise, Chostner said Lucas replied, “Just wait and see for yourself. You probably wouldn’t believe me If I told you.”

After 24 hours of convincing, on Feb. 5, the day Schelling visited an Aurora doctor for her first prenatal visit and received her 8-week ultrasound, Schelling relented, Chostner said, and came to Pueblo.

“In that moment, she had no idea what would happen,” Chostner said.

Schelling’s phone, Chostner said, then went silent. But after 2:40 a.m., a call was made to a romantic interest of Lucas’ whom Schelling did not know. Chostner called it a "critical" piece of evidence.

“But it's Kelsie’s phone that calls her, not Donthe’s,” Chostner said, citing cellphone records.

For the defense’s opening remarks, Lucas’ attorney Karl Tameler painted a picture of a broken-hearted family desperately searching for answers about their daughter’s disappearance and putting pressure on law enforcement agencies to make a case where none existed.

Tameler called the prosecution’s homicide charge against Lucas “the biggest reach in Pueblo history.”

“You’ve just heard a story,” Tamler told the jury.

“But the story the DA is presenting to you is a fiction they have created … of things they have found over the course of eight years. Random pieces of information that do not add up.”

Tameler also sought to dispel Lucas’ aspirations of playing NBA basketball — he was a standout player at Pueblo Central High School and played basketball at Northeastern Junior College, where he and Schelling met — as a possible motive for the murder.

“His career in basketball is long over by this time,” Tameler said.

“He’s flunked out of the college, is sitting at home, might play the occasion 4-on-4 matchup down at the slabs with his homeboys.
