I'm also following another "no body" missing woman case (Kelsey Berreth of Woodland Park), and I came across this news clip describing what CBI told the Judge regarding both DL and KS cell phones, and the story it will tell to the jury, I'm anxious for the show to begin. DL's motions are smoke and mirrors, and I believe jury will see right through him. MOO

PUEBLO – A judge is hearing from attorneys on both sides of the Donthe Lucas murder case today as they bring forward motions that could impact the length of a potential trial and the number of witnesses called to testify.

News5 has a crew in Pueblo to report the latest in the case. These hearings are expected to last through Friday. As of a recess for lunch, the courtroom is closed to the public and the media.

The Pueblo courtroom was closed for the hearing

The entirety of the first day of the scheduled two-day motions hearing for Donthe Lucas — the man suspected of murder in the February 2013 disappearance of Kelsie Schelling from Pueblo — was spent in closed court, meaning the judge had the public and media leave the courtroom, and only the parties directly related to the case were allowed to hear testimony.

Pueblo District Court Judge Thomas Flesher ordered the court closed before prosecutors from the 10th Judicial District Attorney’s Office and Lucas’ defense counsel began presenting a people’s notice of hearsay statements of the victim motion.

Guillermo Garibay, one of Lucas’ attorneys, said the decision to close the courtroom was agreed upon because the material that was being discussed at the hearing could be inadmissible at trial and that both sides don’t want that information being exposed to the public at this time.

Deputy District Attorney Michelle Chostner said in court that the motion relates to the prosecution’s legal theory about what happened in the case. It also was noted by attorneys that the motion had to do with Schelling’s past and her character. The media was not granted access to testimony regarding the motion because of the courtroom closure.

The court called upon Schelling’s friends to testify and some were seen leaving in an emotional state.

Laura Saxton, Schelling’s mother, was allowed to stay in the courtroom due to the Victims’ Rights Act, but she said following the hearing that she could not discuss any of the testimony that was given.

Saxton said her biggest hope at this point is that Lucas’ trial does not get delayed again, and added that is something that could be discussed in court today.

The motion was not finished by the end of the day Thursday, so the court will start up again with it this morning.

Other motions that are expected to be considered by the judge at Lucas’ hearing includes a motion to suppress evidence related to photo displays, a motion for discovery alleging government misconduct, a motion to suppress statements by Lucas, and a motion for sanctions due to destruction of evidence in the case.

Donthe Lucas motions hearing to continue in June

PUEBLO, Colo - A two-day motions hearing in the Donthe Lucas case has been extended to June 13 and 14.

Lucas is charged with first-degree murder in relation to the February 2013 disappearance of 21-year-old Kelsie Schelling. He has pleaded not guilty to the crime.

On Friday, Pueblo District Court Judge Thomas Flesher was asked to determine if the identification of Lucas coming back to his grandmother's old house can be used at trial.

Three witnesses took the stand, including lead investigator CBI Agent Kevin Torres.

He told the judge on April 7, 2017, the new owners of the south Pueblo home where Lucas used to live called police after an African-American man came to their home asking if he could look at the backyard.

Torres said two family members were shown a picture of Lucas through a photo message, where he was identified.

Days later, law enforcement showed a family friend, who was inside the home during the encounter, a photo lineup. The friend identified Lucas.

The defense argued the validity of the identification and said the family knew who Lucas was prior to the alleged encounter, due to the popularity of the case and previous searches of the home. They also questioned the way the lineup was conducted, indicating it may have been suggestive in nature.

Prosecutors told the judge the family's prior knowledge of the case shouldn't affect the judge's ruling.

The house in question is located at Manor Ridge. It's where investigators believe Lucas strangled Schelling to death.

The judge has yet to make an official ruling on the motion.

There's no word yet on whether the new hearing date will affect the July 30 trial date.

"I just hope it happens in July," said Laura Saxton, Kelsie's mother. "I am tired of waiting."

Schelling's parents have doubled their standing reward for the location of their daughter's remains from $50,000 to $100,000.
