What are they going to charge her with? Pick Pocketing?

She tore a child from its mother's womb before it was supposed to be born and it died. That is murder. A death in the act of a felony assault!!

Who is this prosecutor?!

The child would not be dead if not for her actions. She sliced open a woman to STEAL a baby.

Prosecutor said from the start they can't charge her with murder under CO law unless they can prove the baby lived outside the womb.
Based on the new development I am assuming autopsy didn't show that.
 
The perps husband said that the baby gasped.
That is a sign of life and I think most juries would believe the baby lived outside the womb.
They should have charged her with it (with a lesser included) and let the jury decide. :twocents:

She was 34 WEEKS pregnant. Many babies born at 34 weeks require nothing but a couple days of oxygen!
I think this baby was smothered when the perp realized it was a girl. :twocents:

The coroner's office performed an autopsy on the fetus and said Wilkins was 34 weeks pregnant.

That is a sign of life and I think most juries would believe the baby lived outside the womb.
They should have charged her with it (with a lesser included) and let the jury decide. :twocents:

CO refused to pass fetal homicide law, and autopsy did not find evidence that fetus was alive outside the womb. So, seems that under circumstances, prosecutor's hands are tied.
I don't agree with it either. I think this perp should be charged with murder.
But absence of a fetal homicide law in CO makes that not possible.
 
The intent is what counts in my mind so I never understood why the punishment for attempted murder is less than for murder. At any rate, hopefully they can sentence her to enough consecutive terms that it will amount to a de facto sentence of life without parole.

Which is ridiculous. It is one thing to decide whether or not the fetus you are carrying is one that you want and to terminate but when someone else Cuts you open and steals your child and that child dies that it intentional and foreign.
She should be charged with the murder. Anything less is a travesty.

I agree. But it doesn't sound like DA has a choice here.

Depends on the circumstances of early arrival, my son came at 31+5 (2 days shy of 32 weeks) needed no oxygen, and stayed in hospital only to grow until 37 weeks..

I'm not sure on the U.S. But in Australia, babies must be at least term (37 weeks) or have hit 2.5kg, my son although needing no oxygen did need additional medical care, as this baby would have, I was also given steroid shots to help his lungs cope outside the womb..

In my honest opinion 34 weeks is too early to survive on the outside, without steroid shots.. It could have been very possible the baby was alive and did gasp, but it's lungs couldn't work as they weren't developed enough, and so the baby passed away.

It shocks me there is no murder charge... Ugh
 
The law needs to be rewritten then to allow for murder charges when the death of an otherwise normal fetus after a particular point in the pregnancy is caused in such a manner.

I'm so disappointed that she wasn't charged with murder. The baby would be alive if still in mom's womb, I just can't wrap my head around this.

Michelle Wilkins, whose unborn child did not survive after being cut from her belly in a Longmont attack earlier this month, released a statement late Sunday...

"Aurora is a light being now, nothing but ethereal joy and love," the 26-year-old said... "Forever in my heart."

Wilkins in the post thanked the public for their prayers and positive thoughts, saying they have been deeply felt and have helped her healing. "I can already feel it's going to be a long journey to physical and (emotional) recovery, but I am grateful for every person that has reached out to help in their own way," she said. "You have my eternal gratitude."
